AN ORDINANCE FINDING J\.-TITD DETERMINING THE NECESSITY FOR CERTAIN ElYJERGENCY
CONSTRUCTION TO THE STORM SEWER SYSTEM OF THE CITY ,OFV1EST UNIVERSITY PLACE,
TEXAS; AUTHORIZING THE CITY SECRETARY TO OBTAIN THE SERVICES OF A COMPETENT
ENGINEERING FIRM TO EFFECT THE SAME ON A FORCE ACCOUNT BASIS; AUTHORIZING
PAYMENT OF SERVICE;;RENDERED IN CONNECTION WITH SUCH EMERGENCY CONSTRUCTION;
A1\TD DECLARING AN EMERGENCY.
WHEREAS, 'By virtue of certain work done upon Poor Farm Ditch by Harris
County in the City of West University Place certain emergency construction in the
form of extensions to the storm sewers of said City leading in to the said Poor
Farm Ditch have been rendered necessary; and
~rBEREAS, Because of the emergency created as the result of the work
on Poor Farm Ditch performed at the insta.nce of Harris County, it is necessary
that the said emergency construction be effected on a force account basis; and
WHEREAS, The City Secretary and City Engineer of the City of West
University Place have made inquiriesas to a competent firm of engineers to effect
such construction, and have recommended to the City Co~mission of said City that
the P & L Construction Company be employed for such purpose; and
WHEREAS, The said construction of extensions to the storm sewer system
is a matter vital to the public health and welfare and, therefore, constitutes an
emergency;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
\f.EST UNIVERSITY PLA~:
Section 1. That the City Secretary be and he is hereby instructed to
obtain the services of the P & L Construction Company on a force account basis
to construct the necessary extensions to the storm sewer system as rendered ne-
cessary by work done upon that portion of the Poor Farm Ditch situated in the
City of West University Place at the instance of Harris County, as reco~mended
by the City Engineer.
Section 2. That the City Secretary be and he is hereby authorized, upon being
advised -~ the City Engineer that the said emergency construction has been- completed
and approved, to pay the said P &L Construction Company for such services rendened
out of that portion of the Sewer Collection System Account established to defFay
the expense of such emergencies. '
Section ~. That since the construction of the said extensions to the
storm sewer system constitutes an emergency, this Ordinance shall take effect and
be in force from and after its passage qy the City Commission and approval by the
Mayor.
