AN ORDINANCE REPEALING ORDINANCE NO. 99 REGULATING THE
ALTITUDE FOR THE FLYING OF AIRPLANES OR ANY LIGHTER -THAN
Am CRAFT OVER THE CITY OF WEST UNIVERSITY PLACE; PRES-
CRIBING 'A PENALTY FOR THE VIOLATION OF SUCH ORDINANCE AND
DECLARING AN EMERGENCY j P.ROVIDING FOR THE MINIMUM ALTITUDE
FOR THE FLYING OF AIRCRAFT OVER THE CITY OF WEST UNIVERSITY
PLACE, TEXAS; PRESCRIBING A PENALTY FOR THE VIOLATION OF
THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAnm:D BY THE CITY COMMISSION OF THE CITY OF WEST' UNIVERSITY
PLACE" TEXAS:

Section 1. That Ordinance No. 99 of the City of West University Place regu-
lating the altitude for the flying of aircraft over such City, which said '
Ordinance was passed and appreved the 27th day of May, 1935, be, and the
same is hereby, repealed.
Section 2. That from and after the effective date hereof no aircraft of
any type or description shall fly or be operated over any portion of the City
of'West University Place at an altitude less than two thousand feet (2,000)
above the ground level, unless, by reason of mechanical failure of any such
aircraft, the maintenance bfsuch minimum altitude becomes impossible'in
which event all reasonable efforts shall be made by the operator thereof to
maintain an altitude in excess ,of two thousand feet (2,000).

Section 3. That violation of any portion of the provisions of this Ordinance
shall oe punishable by a fine of not less than Twenty-five Dollars ($25) nor
more than Two Hundred Dollars ($200), and each violation shall constitute a
separate offense. '
Section 4. That this Ordinance shall become ~ff'ective and be in f'orce from
and after its date of passage and approval.
