HomeMy WebLinkAboutORD 657 - ORD Fixing & Establishing Rates to be Paid for Connections City Sanitary Sewer System ~ ' '1 / J I ~ [I LI \, \ " 195 O'RnTNA Ncm NO - h57 AN ORDINANCE FIXING AND ESTABLISHING RATES TO BE PAID FOR CONNECTIONS TO THE CITY SANITARY SEWER SYSTEM OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS 'AND MONTHLY SEWAGE DISo- POSAL SERVI~ CHARGES FOR TWO CERTAIN SERVICE STATIONS LOCATED IN BRAES BEIGIn'S ADDITION, AN ADDITION IN TEE CITY OF HOUSTON, TEXAS; DIRECTING- THAT A COPY OF THE ORDINANCE BE -FURNISHED TO THE CITY 'OF HOUSTON, TEXAS; AND PROVIDING AN: EFFECTIVE DATE. WHEREAS, By Ordinance No. 552 passed the 26th day of February, 1951, the City'C0mmission of the City of West University Place, Texas estab- lished rates to be paid for connection to the Sanitary Sewer System of said City by ownersbr occupants of residential home sites lying outside of the City limits of said City in accordance with the provisions of ~n agreement entered into with the City of Houston on the 30th day of June, 1949; and WHEREAS, The said Ordinance does not provide for connection charges to the Sanita~ Sewer System of the City of' West University Place by 'owners of commercial property located with out the said City nor for monthly sewage disposal charges for each such connection; and WHEREAS, Application has been made with the City Commission of the City of' West University Place, Texas for connection to the Sanita~ Sewer System of said City by: the owners of two (2) certain service stations located in the 7100 block of Stella Link Road in Braes Heights Addition, in the City of Houston, Texas; and ' WHEREAS, The City Commission of the City of West University Place has been advised that the f'acilities of'the Sanitary Sewer System of said City are adequate to supply the requested service to the said service station owners without burdening or affecting the efficiency of' the Sanita~ Sewer System and is desirous of extending such service to the same; and WHEREAS, Under Baragraph II of the said agree~nt of' June 30, 1949, between the City,ofW st University Place and the City of Houston connection charges for sucheco~rcial property and monthly sewage disposal charges for each such connection are determined by agreements as to such connections existing, immediately prior to and at the time of the execution of the said agreement:, of June 30, 1949; and ' WHEREAS, At, the time of the execution of the said agreement between the City of West University Place and the City of Houston, the City of' West University Place furnished sewage disposal service to certain com- mercial establishments including filling stations located immediately adjacent to the boundary of the City of West University Place, but within the City'of ... Houston, and under agreements with the owners of such property at the' time Gfand prior to the execution of the said agreement with the City of Houston, charged the sum of Two Hundred ,Dollars ($200) f'or connection to the Sanitary Sewer System of' the City of' West University Place and the sum of Two and 50/l(),Oths Dollars ($2.50) per month for sewage disposal service; and WHEREAS, The City Commission of the City of West University Place is of the opinion that such connection and sewage disposal service charges are ,.... r- 11110 'n" 1 . .-, , DrIn I [ Ill... C] ~ ~.., ...[ 196 reasonable and just and should be eff'ective as to the two (2) said filling stations located in the 7100 block of Stella Link Road. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE,..TEXAS: Section 1. That the owners of the two (2) service stations located in the 7100 block of~tella Link Road in Braes Heights Addition, an addition in the City of Houston, Texas, which addition is now serviced, in part, by a sanitary sewage line connected with the sa1iita~ sewer lines and ' facilities of the City of West University Place, Texas 'may be and th.ey.are hereby authorized to,connect to such service line upon the payment to the City of West University Place, at its City Hall, of the sum of' Two Hundred Dollars ($200) for each such connection which is hereafter made. Section 2. That the sewage disposal service charge is hereby fixed and established at Two and 5O/100ths Dollars ($2.50) per month f'or each such, connection, the same to be paid to the City of West University Place, Texas at its City Hall on or before the lOth day of each calendar month. Section 3. That the authorization and provisions of' this Ordi- nance are applicable solely to the two (2) described -service stations, and no direct or indirect connection to the City of West University Place sewage system shall be permitted for other commercial establishments under the ' terms hereof nor under any condition except as may be hereafter authorized by the City Commission of the City of West University Place from time to time. Section 4. That the' charges herein established are the charges to be paid by the owners of the hereinabove mentioned service stations for connection to the City Sanitary Sewer System of the City of West University Place, Texas, and for monthly'sewage disposal service, and noth~g',her.~iln' shall be construed to af'fect the terms and provisions of that certain existing agreement between the City of West University Place and the City of Houston dated June 30, 1949, pertaining to monthly sewage disposal charges for individual residential connections in areas lying within the City of' Houston in Which a standard rate for such charges has been agreed upon between the two Cities. Section 5. That theCi ty Secreta~ be and he is hereby directed to furnish a certified copy hereof to the City of' Houston, Texas for its use and information. Sec'tion 6. That this Ordinance shall take effect and be in force imniediately from and af'ter its passage and approval. PASSED THIS THE 22ND DAY OF MARCH, 1954.
