AN ORDINANCE FINDING AND DETERMINING THAT :EACH AND ALL THE
, PROCEEDINGS HAVE HERETOFORE BEEN HAD AND ALL THINGS DONE
PR~UISITE TO THE HOLDING OF A PUBLIC HEARING TO CONSIDER
AllENDING ZONDlG ORDINANCE NO. 111 SO AS TO PERIlIT THE CON-
STRUCTION OF A CARPORT EXTENDING FR<lI THE FRONT OF THE EX-
ISTING GARAGE STRUCTURE A DISTANCE OF 15- FEET TO THE SIDE
PROPERTY LINE OF '!HE RESIDENCE KNOIIN AS 6647 RUTGERS STREET
TO THE SIDE PROPERTY LINE ON C.ASON S1REET AS APPLIED FOR BY
BRIDE K. CJlEN; FDlDING THAT A PUBLIC HEARING FOR THE PURPOSE
OF CONSIDERING SUCH AMENDMENT HAS BEEN DULY AND LEGALLY HELD;
APPROVING AND .ADOPTING THE REPORT AND RECOMMENDATION OF THE
ZONING AND PLANNING BOARD; FINDING THAT ORDINANCE NO. 111
SHOULD BE SO AMENDED; AMENDING ORDINANCE NO. III SO AS TO
PERMIT SUCH CONSTRUCTION OF SAID CARPORT AND PROVIDING THAT
THIS ORDINANCE SHALL TAKE EFFECT AND BE IN FORCE AND EFFECT
IMMEDIATELY FROM AND AFTER ITS PASSAGE AND APPROVAL.
WHEREAS, Bruce 'K. Owen, the owner of the property knQWD as
6647 Rutgers Street in the City of West Un!versit,. Place, Texas, has
heretofore filed his witten application with the Zon~g and Planning
Board of said City for permission to construct a carport extending from
the front of the existing garage on said property a distance of 15 feet
to the North right-of-way line of Cason Street; and, ,
WHEREAS, the Zoning and Planning Board at a regular meeting
has determined that permission for such construction should be approved,
condition that said carport be constructed as an open area carport and
that the sides and front of such carport not be enclosed and further
conditioned that such structure not extend beyond the side property line
on Cason Street, such line being the North right-of-way line of said
street; and,
_ WHEREAS, at a regular meeting of the City Commission held on
June 23, 1952, 'upon the written request of Bruce K. Owen and upon the,
recommendation of the Zoning and Planning Board it was determined that
a public hearing should be held to consider whether or not Ordinance No.
should be amended so as to permit the applied for construction; and,
WHFBEAS, in pursuance to the direction given him by the City
Commission and in full compliance with the Charter and the Ordinances of
the City, the City Secretar,y did cause to be published in the official,
publication of the City and did mail to each of the owners of property
lying within 200 feet of said existing garage structure, a notice of the
hearing to be, held as aforesaid; and,
WHEREAS, pursuant to such notice a public hearing was held by
the Ci1;y Commission in the City Hall, 3800 University Boulevard, at 7:1,
o'clock P.M., MOnday, July lli., 1952, at which hearing all testimony and
evidence was heard and fully considered by the City Commission as to the
advisabd.lity and propriety of amending Ordinance No. 111 so as to permit

mendatien ef the Zening & Planning Board,is ef the epinienthat Ordinance
No.. 111 sheuld be amende~ so. as to. permit' the censtructien ef the carpert
as applied f'er by the said Bruce K. Owen, previded, however, that such
structure be an epen area censtructien extending enly to. the preperty line
ef the preperty knewn as 6647 Rutgers Street as the same abuts the Nerth
right-ef'-way line ef CasenStreet; and,
WHEREAS, the C;Lty Cemmissien desires to. amend Ordinance No.. 111
to. allow such censtructien and believes that it will be to. the public
interest to. so amend the 'same.
NOW, TBEBEFORE, BE IT ORDA:mED BY THE CITY COMMISSION OF THE
CITY 'OF WEST UNIVERSITY PLACE, TEXAS:

Place, Texas, hereby finds and determines that each and allef' the pre-
ceedings mentiened in the feregeingrecitative,paragraphs hel.ve been duly
and legally taken and performed and that all prerequisites to. the helding
0.1' a public hearing fer. the purpese 0.1' considering the amending ef' Zening
Ordinance No.. 111 have been dene and fully cemplied with.
Sectien 2: The City Cemmission ef the City ef' West University
Place, Texas, finds and, determines that a public hearing fer the purpese
ef censidering an amendment to. Ordinance No.. 111 so. as to permit the cen-
structien by Bruce K. Owen 0.1' a carpert en the property knewn as 6647
Rutgers Street was duly held at 7:15 P.M. en July 14, 1952, at the City
Hall ef the City af' West Universi"ty Place, Texas, in pursuance to. the
ne"tice af such hearing duly and legally made in accerdance wi"th "the Ordi-
nances 0.1' "the City.
Sectien 3: The repert and recemmendation ef the Zening and
Planning Board relative to. theapplicatien ef Bruce K. Owen that Ordinance'
No.. 111 be 8.U1ended so. as to. permit the prepesed cens"tructien by the said
Bruce K. Owen en the' preperty knewn as 6647 Rutgers S"treet in accerdance
with the plans and specif'icatiens submitted by him f'er such censtructien
ef' a carport, is hereby appreved and adepted.
Sectien 4: That Ordinance No.. 111 is hereby amended by the
addi tien ef a subparagraph to. Sec"tien 24 to. be _ known as subparagraph 3-B
and to. read as f'ellows:
"(3:-B) Previded, hewever, that on the prepertY known
as 6647 Rutgers Street a carpert may be cens"tructed by
the extensien frem the frentef' the existing garage en
said preperty seuthward to. the Seuth preperty line ef'
