AMENDING ZONING ORDINANCE NO. III SO AS TO PERMIT THE SUBDIVIDING OF LOT 8, BLOCK 2, WEST UNIVERSITY PLACE FIRST ADDITION, INTO TWO LOTS 109 BY 100 FEET EACH, THE NORTH ONE-HALF OF SUCH LOT TO FRONT ON CASON STRF;:E'T AND THE SOUTH ONE-HALF TO FRONT ON BROMPTON STREET; FINDING THAT A PUBLIC HEARING FOR THE PURPOSE OF CONSIDERING SUCH AMENDMENT HAS BEEN DULY AND LEGALLY HELD; APPROVING AND ADOPTING THE REPORT MID RECOMMENDATION OF THE CITY'S ZONING AND PLANNING BOARD THAT SUCH AMEND:r.m:NT TO SAID ORDINANCE BE P.ERMITTED; FINDING THAT ORDINANCE NO.lll SHOULD BE AMENDED SO AS TO PERMIT THE SUBDIVISION OF SAID LOT; AMENDING SECTION 24 OF ORDINANCE NO. III OF THE CITY OF WEST UNIVERSITY PLACE BY ADDING A SUBPARAGRAPH TO SUCH SECTION TO BE KNOVlN AS SUBPARAGRAPH 14 AND PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT AND, BE IN FORCE AND EFFECT IMl!tEDIA TELY ,FROM AND AFTER ITS PASSAGE AND APPROVAL. WHEREAR, C. L. Berglund has heretofore made written application to the Zoning and Planning Board of the City of West University Place for permission to subdivide Lot 8; Block 2, West University Place First Addition, into two lots 100 by 100 feet each, the North one-half of such Lot to front on Cason Street and the South one-half of such Lot to front on Brompton Street;and, WHEREAS, at a regular meeting of the Zoning and Planning Board it was determined that such exception to the applicable provisions of Ordinance No. III should be granted and such Board did recommend in writing to the Commission . that an amendment to Zoning'Ordinance No. III be adopted so as to permit the subdivision of said Lot as applied for by the said C. L. Berglund; and, WHEREAS, at a regular meeting of the City Commission held on the 23rd day of June, 1952, it was determined that a public hearing should be held to consider whether Ordinance No. III should be amended as recommended by the Zoning and Planning Board to permit such subdivision of'said Lot; and, WHEREAS, the City Commission at such regular meeting on June 23, 1952, did instruct the City Secretary to advertise in ,the official publication of the City and to give written notice to all property owners whose property lies within 200 feet of Lot 8, Block 2, West University Place First Addition, of a public hearing to be held on July 14, 1952, at 7:00 o'clock P. M. in the City Hall of the City of West University Place, Texas, to determine whether Dr not Ordinance No. III should be amended so as to permit the subdivision of said Lot as applied for by C. L. Berglund; and, WHEREAS, in pursuance to the direction' given him by the City Commission and in full compliance with the Charter and the Ordinances of the City, the City Secretary did cause to be published in the official publication of the City and did mail to each of the owners of property lying within 200 feet of Lot 8, Block 2, Vfest Universit,y Place First Addition, a notice of the hearing to be held as aforesaid; and, '----Oil I -I ,lqlll ITrIlI I . E,.: II . ..,1 O' WHEREAS, pursuant to such notice a public hearing was held by the City Commission in the City Hall, 3800 University Boulevard, at 7:00 6 'clock P.M., Monday, July 14,1952, at which hearing all testimony and evidence was hea~d and fully considered by the City Commission as to the advisability and propriety of amending Ordinance No. 111 so as tp permit the subdivision of Lot 8, Block 2, West University Place First Addition, as applied for by the said C. L. Berglund; and, WHEREAS, it appears to the City Commission from the report and recommendation of the. Zoning and Planning Board and from all evidence and testimony presented at such public hear~ng that said Ordinance should be amended,so as to permit such subdivision of said Lot. I~ , I ,--_J NOW, THEREFORE, .BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE: Section 1: City Commission of the Cfty of West University Place, Texas, does hereby find and determine that each and all of the steps and proceedings set forth in the above recitative paragraphs have been duly and legally taken. Section 2: City ,Commission of the City of West University Place, Texas, does hereby find that Section 24 of Ordinance No. III should be amended so as to permit the subdivision of Lot 8, Blo~k 2, West University Place First Addition, into two Lots 100 by 100 feet each, the North one-half to front on Cason Street and the South one-half to front on Brompton Street. II , I U Sec tion 3: Sec tion 24 of Ordinance No. III of the City of West University Place, Texas, be and it is hereby amended by the addition,of a subparagraph to bekriown as subparagraph 14 to read as follows: n(14) Provided, hOWever, that Lot 8, Block 2, West University Place First Addition, shall be' and it is hereby subdivided into two lots leD by 100 feet each, the Ngrth Lot to front on C,ason Street and the South Lot to' front on Brompton Street, and further provided that such subdivision shall be made subject to the said C. L. Berglund executing such utility rights of way and easements as may become necessary because of said subdivision of ,said lot. Section 4: This Ordinance shall take effect and be in force and effect from and after its passage by the City Commission and ,approval by the Mayor.
