AN ORDINANCE LIMITING THE NlfMBER OF FOWLS THAT ANY RESIDENT OF THE
CITY OF WEST illUVERSITY PLACE, 'J:'EXAS, MAY HAVE ,OR Y.EEP ON SUCH
RESIDENT IS PROPERTY: DEFINING THE TERM FOVlL; PRESCRIBING A, PENALTY
FOR VIOLATION OF THIS ORDINANCE; . PROVIDING FOR THE EFFECTIVE DATE
HEREOF: PROVIDING THAT ALL ORDINANCES INCOMFLICT HER.EWI'lH BE REPEALED.
WHEREAS, the City Commission of the City of West tiniversity Place,
Texas, after having heard full testimony from the City Health Board and from
the City Sanitarian and after due investigation has found and determined
that:
The ralslng of fowls within the City L~mits of the City of West
University Place, Texas, has created and is creating an insanitary condition'
conducive to communicable diseases; and,
WHEREAS, after a carefUL and thorough investigation by the City
Commission, the City Sanitarian and the City Health Department, it has been
determined that th~r~. is a n.~?essity for the regulation of the raising of
fowls within the ICi ty Limits ; and, .
WHEREAS, -'it has been determined that the keeping of more fowls on
any property within the City-of West University Place than is herein provided
for constitutes a public nuiBance and a threat to the public health, which
nuisance in each instance shmuld be abated and prohibited.
NOW, ~ORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY'
OF WEST UNIVERSITY PLACE, TEXAS:
Section 1. No person or persons shall keep or have in his, her
or their possession, on any lot upon whicp. he, she or they reside, ' more
than twelve fowls at anyone time and further provided that all structures or
enclosures used for the housing or keeping of fowls and all runs and fenced
yards devoted exclusively to the use of raising of fowls shall be of such
size that no more than one fowl is kept per 250 square feet of such pens,
houses, runs or yards.
Section 2. The term Ufowln as herein used means any member ofL-the
bird family; the use of the singular of such word shall include the plural
and the use of the plural thereof shall include the singular.
Section 3. Any'person or persons violating any part or provision
of this Ordinance shall be deemed guilty ofa misdemeanor and shall, upon
his.or her conviction, be fined in any amount of money not to exceed $100.00;
and each d~ of such violation shall constitute a new and separate offense.
Section h. If any part of this Ordinance for any reason shall be
unconstitutional or ineffective, such unconstitutional or ineffective part
shall not in any manner affect any other part of this Ordinance; and this

Ordinance shall be cumulative on all matters herein legislateduporr
with all ordinances and laws not inconsistent herewith; and all ordinances
and p~rt8 of ordinances in conflict herewith or any part hereof a~e hereby
repealed in so far as such conflict or conflicts exist only.
Section 5. This ordinance shall take effect and shall be in full
force and effect immediately upon its passage by the City Commission and
approval by the Mayor and publication as provided by law.
