ORDINANCE NO. 60.4 ,I LJ AN ORDINANCE REGULATING THE SPEED OF VEHICLES ON STREETS IN THE CITY OF WEST UNIVERSITY PLACE; DEFINING .ttBUSINESS DISTRICT", "RESIDENCE DISTRICT" AND "SCHoOL AND 'PARK DISTRICT!'; SETTINQ,.PRIMA FACIE LIMI.'IS IN SUCH DISTRICTS; PROVIDING FOR MINIMUM SP..EED~,RgGULA- TION, THE CHARGING OF VIOLATIONS HEREUNDER AND PROVIDING FOR~ PUNISHMENT" FOR VIOLATIONS HEREOF . --- BE IT ORDAINED BY THE CI-TY C0.M,MISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS, THAT: Secti~n 1. Speed Restrictions. (a) No person shall drive a vehicle on a public street in the City of West University Place, Texas, at a ~peed greater than is reasonable and prudent under .the conditions then existing, having regard to the actual and potential, hazards when approaching and crossing an intersection or a railway grade crossing, whenapproaching"and going around a curve, when traveling upon any narrow or winding roadway, or when such hazard exists with respect to pedestrians or other traffic or by reason of weather or street conditions; and in every event speed shall be so controlled as may be necessary to avoid colliding with any person, vehicle or other conveyance on or entering the streets incompliance with legal requirements and the duty iSf all persons to use due care~ (b) Where no special hazard exists that requires lower speed for compliance with Sub-section (a) of this Section, the speed of any vehicle not in excess of the limits specified in this Sub- section or established as hereinafter authorized, shall be lawful, but any ~peed in excess of the'limits specified in this Sub-section or est~blished,as hereinafter authorized 'shall b~ prima facie evidence that the speed is not reasonable or prudent and that it is unlawful: (1) Thirty (30) miles per hour in any business district. (2) Thirty (30) milew per hour in any residence district. ~3) Fifteen ,(15) ,miles per hour in any school or park. district. ~ I I, I LJ Section 2: "Business Districtt1,means the territory contiguous.to and including a roadway when within any 600 feet along such roadway ther~ are buildings fn use for business or industrial purposes which occupy 300 feet frontage on one side or 300 feet collecrively on both sides of the roadway. Section 3. "Residence District" means the territory contiguous to and including a roadway ~ot comprising a business district when the property on such roadway for a distance of 300 feet or more is in. the main improved with residences or residences and buildings in use for business. i I 53 Section 4. Itpark Area" and, "School Area" means the territory contiguous to and including a roadway not comprisingia business or residence district when the property on one side or the other of such roadway for a distance of'lOO feet or more is. in use for public park or public school purposes. Section 5. The prima facie speed limits set forth in Sections 2, 3 and 4 may be altered as authorized in Section 6. . 0 Section 6. Authority of C~ty Commission to alter Prima Facie Speed Limits. - - Vihenever the City Commission shall determine upon the basis of engineering and traffic investigations made by the Chief of Police of the City of West University Place that any prima facie speed hereinbefore set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of any street in the City, taking into consideration thevvidth and condition of the pavement and other cir.cumstances on such portion of said street, as well as the usual traffic thereon, said Co~nission may determine and declare a reasonable and safe prima facie speed limit thereat or theronby proper resolution entered on the Minutes of said Commission, which shall be effective at all times or during hours of daylight or darkness or at such other times as may be deter- mined when appropriate signs giving notice:thereof are erected at such inter- section or other place or part of the street, except that said Commission shall not alter or modify the basic rules set forth in Section I (a) of this Ordinanc e. Section 7. Minimum Speed Regulation. It shall be unlawful for any person to so operate or drive any motor or other vehicle upon any public street in the City of West University Place, Texas, so as to wilfully obstruct or impede the normal reasonable and safe movement of traffic. The police officers of the City of West University Place are hereby authorized to enforce the' foregoing provision by directions to drovers, and a wilful disoDedience to this provision shall be in violation of l?w, punishable as provided in this Ordinance. Section 8. Charging Violations. -- Each charge of a violation of any speed regulation provided for in this Ordinance, also the summons of notice to appear in answer to such charge, shall specify the rate of speed at which the person so charged is alleged to ~ave driven, also the prima facie speed limit applicable within the districtor...at the location shall be set 9ut. Section 9. Penalty.-- Any person viqlatimgany of the provlslons of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine not exceeding $50.00 for the first offense and by a fine not exceeding $200.00 for the second offense or subsequent offences or not.exceeding $200.00 or imprisonment in the County Jail not to exceed 30 days or by both such fine and imprisonment, in the discretion of the Courh.~or each subsequent offense thereafter. Section 10. If any 5ectidm or portion of this Ordinance be held invalid or unconstitutional, such invalidity shall not affect the remaining I ; III It.,. i portions of this Ordinance, it being declared to be the intention of this Commission to enact such portions separately. The regulation of the speed and flow of vehicular traffic in the' City of West University Place, Texas, being a matter of concern to the safety and well-being of the citizens of the City of West University Place, Texas, and the need for such regulation being imperative, this Ord~nance shall take effect an'd be in full force and effect immediately upon its . .
