III HAS BEEN DULY AND LIDALLY HELD; APPROVING AND ADOPTING THE' REPORT AND REcOMMENDATION OF. THE . ZONING AND PLANNING BOARD THAT ORDINANCE NO. III BE AMENDED SO AS TO PERMIT THE SUB- DIVISION' OF toT NO.9, BLOCK 33, WEST UNIVERSITY -PLACE FIRST ADDITION; FINDING 'IRAT ORDINANCE NO. III OF THE CITY OF WEST UNIVERSITY. PLAC'E, TEXAS SHOULD BE AMENDED SO AS TO PERMIT SUCH SUB- DIVISION; AMENDING ORDINANCE NO. 111 SO AS TO PERMIT THE SUB- DIVISION OF LOT NO.9, BLOCK 33, WEST UNIVERSITY PLACE, FIRST ADDI- TION; AND PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT AND BE . IN FORCE IMMEDIATELY FROM AND AFTER I'lS PASSAGE AND APPROVAL. WHEREAS, F. R. Hewell, has heretofore filed his written application with the Zoning and Planning Beard of the City of West University Place, Texas for permission to sub-divide Lot 9 in Block 33, of the West University Place First Addition into two 50 foot lots; and, WHEREAS, at a regular meeting of the Zoning and Planning Board of the City ofliest University Place, Texas, it was determined that permission for such sub-division of said lot should in all things be granted by the City Commission after a public hearing was had thereon, and such recommendation was made to the City Commission; and, WHEREAS, at a regular meeting of the City Commission of the City of West University Place, Texas held on the 17th day of March, 1952 upon the request of F. R. Howell and upon the recommendation of the Zoning and Planning Board, it was determined that a Public Hearing should be held to consider . whether Ordinance No. 111 of the City of West University Place; Texas should' be amended so as to permit the sub-division of Lot 9, Block 33, West University Place First Additien into two 50 foo~ lots; and, WHEREAS, the City Commission at its regular meeting on March 17, 1952 did instruct the City Secretary to. advertise in the official publication'of the city and to. give written notice to all preperty owners whose property lies within 200 feet of Lot 9, Block 33, ,West UIiiversity Place First Mdition of a publuc" hearing to be held at 7:00 o'clock p.m. Friday, April 4, 1952 in the , City Hall to determine whether or not Ordinance No. III should be amended so as to permit sub-division of Lot 9, West University Place First Addition into two 50 foot lots as requested by Mr. F. R. Howell; and, WHEREAS, in pursuance of the directien given hil'il"'by the City Commission "'- ] i , I ,-u n , i U 47 and in full compliance wi t}l the Charter and Ordinances of th~ City, theCi ty Secretary of the City of West University Place, Textils did cap.se to be published in the Southwestern Times on March 20, 19$2, ~nd did mail to each of the owners of property lying wi thin 200 feet of Lot 9, Block 33, West University Place First Addition a notice of a hetilring to be held in the City Hall, 3800 University Boulevard at 7:00 o'clock p.m. Monday, April 4, i952,<toconsider amending Ordinance No. ill so as :to permit the, sub-diy'~si9n of such lot; and, WHEREAS, pursuant to such notice a public hearing was held by the City Commission at, the' Ci ty Hail, 3800 University Boulevard, at 7:00 O'clock p.m. Friday, April 4, 1952~at~which heating all testimony was heard and fully con- sidered by the City Gommission as to the advisability arid propriety of amending Ordinance No. III s9 as to per~it the sub-division of said lot; and, WHEREAS, it appears to the City Commission from the r~port and recommenda- tion of the Zoning and Planning Board, and the report and recommendation of the Building Inspector and from all evidence and testimony presented at such public hearing that Ordinance No~ III of the City of West University Place, Texas should be ameri<;led so. as, to permit the suh:-division of Lot 9, Block 33, West University Place First Addition into two 50 foot lots; and, WH1!REAS, the City actingthrollgh its City Commission and Mayor desires to amend Ordinance No. III of the City of West Un1versi ty and believes that it will be to the public interes t to so amend the same; NON, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Secti9n.l..'~,'> Th~t the City Commissj.on of the City 9+ West University Place, Texas does hereby find and determine that each and all of the proceedings herein above mentioned have been duly and legally taken and performed in full com- pliance with the laws and Charter and Ordinances of the City of West University Place, Texas, and that all provisions and requirements of the law and said Charter and Ordinances prerequisite to the holding of a public hearing for the purpose of considering the amending of the Zoning Ordinance No. III have been made and fully complied with. Texas First Addition is" hereby sub-divid'ed into two 50 foot lots,' each-lot being 147 Sfeet in depth, and a residential structure may be built on each 50 foot'lot o~:said sub~divided lot, providing, how- ever, that such residential building shall in all things'complywith'the eXisting Ordinances 'and the BUilding Code of the City of 'West: University- Place as the same affects such 50 x 147.5 foot lot."
