1W0 LOTS; FINDING THAT A, PUBLIC, HEARING FOR THE PURPOSE OF
CONSIDERJ:NGANAMENDMENT TO ORDINA.NC.ENO. III HAS BEEN DULY
AND 'LEGALLY HELD; APPROVING AND ADOPTING THE REPORT AND. RE-
COMMENDATION OF THE ZONING AND PLANNING BOARD THAT ORDINANCE
NO. III BE AMENDED SO AS TO PERMIT 'lEE SUBDIVISION OF ,LOT 4

THAT THIS ORDINANCE. SHALl. TAKE EFFECT AND' BE"IN FCRCE AND ,EFFECT
IMMEDIATELY FROM AND' AF'lER ITS PASSAGE AND APPROVAL.
WHEREAS, at a regular meeting of the Zoning and Plannirig Board of
the City of West Universi ty Place held on November 8, 1951, it was determined
that permission for such sub-division of said lot should in all things be
gra.nted by the City Commission after a public hearing was held thereon and
such recommendation was made to the, City Commission by the Zoning and Planning
Board; arid
wHEREAS, at areguiar meeting-of, the City Commission of the City-of
West University Place, Texas, held on November 12, 1951, upon the written' .
requ~stbf MRS. IRENE B. OLIVER' and upon the recommendation of theZonlngand
Planning Board, it was determined that a pu.blichearing should be held to
consider whether Ordinance No~lll of the Ci tyshouldbeamended so as to
:Permit the'subdivision of Lot 4, in Block' 42, West University Place first
Addi tion into two lots, as aforesaid; and
WHEREAs, the City Commission at its regular meeting on November'1.2,
1951, ,did -instruct the City Secretary' to advertise in the,' official publication
of the City and to 'give written notice to all property owners whose property .

of a public hearing to be held at 1:00 o'clock p.m. Friday, November 30,
1951, in the City Hall to determine whether or not ordinance No. 111 should
be amended so as to permit such subdivision of said lot; and

,WHERE:AS, in pursuance to the direction given him by the City
Commission, and in fu;Ll compliance with ,the Charter and ordinances of the
City, the City Secretary of th~, Ci:t;y of West University Place, Texas, did
cause to be published in the Southwestern ,Times on November 15, 1951, and
did mail to each of the owners of property lying wi thin 200 feet of Lot 4
in Block 42 ,West University Place First Addition a notice of a hearing to
be held in the City Hall, 3800 Univer~ity Boulevard at 7:00 p.m. Friday,'
November 30, 1951, to consider amending Ordinanc~, No. III so as, to permit
the subdivision of such'19t; and
< : WHEREAS, pursuant to such notice a public hearing was held by the
City COInmission at the City'Hall, 3800:U~iversity Boulevard, at 7:00 Q'clock p.m.
Friday, November 30,~ 195f., at ~hic}:l hearing all testimony was. heard and fully
considered byt-he ,City,Commissipn as to' th~ advisability and proprie~y of
amending Ordinance No. 111 so as to permit the subdivision of said lot; and

lfHEREAS, it appears to the City Commission from the report and
recommendation. of the Zoning and Planning. Board and ,the report and recommenda-
tion of the Building Inspector and from the evidence and testimony presented
at .such public,hearing :that:Ordinancr No. ll~ of the Pitypf West University
, 'l'~ace, Texas" shoUld' be, amended so, as :to permit the subdiyision.,of Lot 4 ,in
, Block 42 West University,' Place 'First. Addition into two lots as' per the appli-
cation of MRS. ~ B. OLIVER; and

WHEREAS, the City Commission aDd Mayor of the City of'West Uni~ersity
Place, Texas, desire to amend Ordinance No. III and believe that it will be
to the public i~terest to so amend the same;

NOW,: THEREFORE, BE ,IT ORDAINED, B~ THE C:r'l'YCOMMISSION OF THE CITY
Of WEST'.UNIVERpITY PLACE, 'lEXAS:'
Section 1., That the City Commission of the City of West
University Place, Texas, does hereby find and determine that each and
,all af the:proceedings hereinabove mentioned have been d~y and legally
taken and performed, inf~l compliance witp ,th,e laws and Charter and Orc;\i-
nances'of the City of West University Place, Texas" and that, :all pr.Qvision~
and requir~ments of the law and said Charter and ordinances prerequisite; ,:to
th~ holding of a public. hearing for the purpo~e of considering the ,amEm5ling
of the Zoning Ordinance No. 11;Lhave been m!l:de and fully complied with.. '
Section 2. That the City Commission of the' City of West University,
Place, Texas, does hereby find and de~rmine that a' public hearing for the ;'
purpose' of considering an amendment to Ordinance No. III s~.as to permi:tthe
subd.ivision of Lot 4, Block 42 West University Place Firs~ .Addition into two
lots was duly held at 7:00 o'clock:p.m. on Friday, November 30, 19.51.:,. in the
City Hall of the City of West University Place in pursuance of the notice

of such hearing duly and legally made in accordance with the Ordinances of
the City;
Section 3. That the report and recormnendation of the, Zoning and
Planning Board and the report and.recommendation of the Building Inspector of
the City o:f'West University Place, Texas, that Ordinance No. ll~be amended
so as to permit the subdivision of Lot 4 in Block 42 West University Place
First Addition into two lots, one lot to be '125 feet by 100 feet to front on
Cason Street and the, other lot to be. 75 feet by 100 feet to front on West-
chester Street, .is again hereby approved and adopted.
Section 4. That Section 24 of Ordinance No. III of the City of
West University Place, Texas is herebYdamended by the addition of a subparagraph
to. bilkl11own.cassubparagraph No. II to read as follows:
It (11) . Lot 2 in Block 421n West University ;
.PlaceFirst. Addition is hereby subdivided into two lots,
one fronting on Cason Street and being 100 x 125 feet,
and tlie other fronting on Westchester Street, and being
75 x 100 :f'eet.ll
Section 5. This ordinance shall take effect and be in forCe
immediately from and after its passage by the City Commission and approval '
by the Mayor. '
