AN ORDINANCE APPROPRIATING THE AGGREGA TE SUM OF SEVEN HUNDRED
FIFTY DOLLARS TflENTY-SIX CENTS ($750.26) OUT OF THE FUND TO
THE CREDIT OF STREET PAVING AND BRIDGE BONDS,' SERIES 1946,
IN THE CITY TREASURY,- TO PAY THE CITY'S AGREED PORTION OF THE
COSTS OF PAVING AND IMPROVING TWO CERTAIN SEPARATE PORTIONS OF
MARLOWE STREET, IN 'tHE 4100 BLOCK THEREOF, ~OR PAYMENT OF
LEGAL FEES AND COST OF TESTING MATERIALS USED ON THE PROJECT,
AND DECLARING AN EMERGENCY.
WHEREAS, the City Treasurer has duly and regularly, in accordance
with tbeprovisions of the Charter of the City of West University Place, Texas,
certified to the City Commission that there is in the City Treasury, to the
credit of Street Paving and Bridge Bonds, Series 1946, the aggregate sum of
Seven Hundred Fifty 1)ollars Twenty~Six Cents ($750.26) which has not been
already appropriated for any other purpose, and which is now,"available for
appropriation by:the Qity CQmmission; and which s.urn is .sufficient to pay the
City's agreed portion of the costs of paving and improving two separate
portions of Marlowe ,Street. in the 4100 block th,ereof;in said city as herein-
after set forth and paYment of legal fees and cost of testing materials used
on the projec t;
NOW, THEREFORE, BE IT ORDAlt>.1ED BY THE CITY COMMISSION OF THE CITY
OF WEST UNIVERSI'!'Y PLACE, TEXAS:
Section 1. That there is hereby appropriated out of the fund to
the credit of Street Paving and Bridge Bonds, Series 1946, in the City Treas~y
the aggregate sum of Seven Hundred Fifty Dollars Twenty-Six cents ($750.26)
to pay the City's respective agreed portion of the costs of 'paving and
improving two certain separate portions of Marlowe street in the 4100 Block
thereof, and payment of legal fees and cost of testing materials used on the
project, to-wit:
1. One-half (1/2) of the cost of paving said portion
of said street abutting LotI in Block 18 of
Colonial Terrace Addi tion to the City of West,
University Place, Texas, an appropriation in the
sum of

2. The cos t of paving and improving the partial
intersection on the North'side of Marlowe
Street' of said Marlowe Street and Richmond
Road, an appropriation in the sum of
$197.12
3. For payment of legal fees and cost of testing
materials used on the project, an appropriation
in the sum of
$ 81. 00
in accordance with the prior agreement between the City and the
property owners, at whose cost the street improvements in the 4100 Block

of Marlowe Street are constructed, with the exception of the agreed II
participation on said Lot 1, Block 18, Colonial Terrace Addition, due to i i
its very irregular shape, and said partial intersection aforesaid; and L-J
the Mayor and City Treasurer, are 'hereby authorized to draw warrant or
warrants against said fund hereby appropriated to the extent of said
aggregate sum or such respective portion or portions thereof as may be
neces'sary to pay and discharge the obligations of the City of West University
Place, Texas, respectively chargeable thereto. ,
Section 2. The fact that the owners of property in said 4100
Block of Marlowe are paying the full cost of the construction of improvements
thereon, wi tli exceptions aforesaid, and .theCity should, appropriate funds for
its agreed portions of said costs at this time, creates a public ,emergency
and therefore this Ordinance shall be passed finally oh:the date of its
introduction ,this 24th:day of September, 1951:, and shall take effect
immediately upon its passage and approval by the ~ayor. '
