'BLOCK NO. 19" OF THE WEST UNIVERSITY PLACE. FIRST ADDITION, CONSISTING OF . LESS THAN . 51% BRICK ON THE EXTERIOR SURFACE; FINDING THAT A PUBLIC HEARING FOR THE PURPOSE OF CONSIDERING SUCH AMENDMENT HAS BEEN DDLY::AND LEGALLY, HELD; APPROVING AND ADOPrING THE REPORT AND RECOMMENDATIONS <F ,THE ZONING 'AND PLANNING BOARD THAT ORDINANCE NO. III BEUENDED SO AS TO PERMIT SUCH CONSTRUCTION; FINDING THAT, ORDINANCE NO~ III SHOULD BE SO AMENDED; AND ffiOVIDING THAT THIS ORDINANCE SHALL . TAKE EFFECT AND BE 'IN FORCE AND 'EFFECT IMMEDIATELY UPON ITS PASSAGE AND APPROVAL. ~. .: WHEREA.8, Mrs~ Winnie Kiibler,' the owner of the West l, of Lot 3, in Block 19 of theWest'Universit;y Place F,irst Addition, an addition to the City of West University Place, Texas, has heretofore filed her written application with the Zoning and Planning Board of said City, for permission to construct a dwelling house upon said lot with the exterior surface of such ,house .to. consist of less than 51% brick, but to be built according to certain plans and specificationsas'submi~ted to said Board; and < , 'WHEREAS; at a regular meeting 'ofthe Zoning, and Planning Board of ' the'City held on June 21, 1951, it was determined that permission for such construct.ion on said lot according to the plans and specifications submitted should be granted as an exception to the provisions of Ordinance No. Ill, and that an amendatory ordinance should be passed by the City Commission allowing such construction; and said Zoning and Planning Board,d:i:d further recommend to the City Commission that a,public hearing be 'called to consider the amending of Ordinance No. Ill. so as .to permit the construction applied ,for; and WHEREAS, at a regular meeting of the City Co~ssion held on June 25, 1951, upon the written request of Mrs., Winnie K1ibler.and,.uponthe recommenda- tion of the Zoning and Planning Board; it was 'determined that a publiC,h.,aring should be held to consider whether Ordinance No. ill should be amended so as to permit such construction; , and . WHEREAS, the 'City' Co~ssi~~, at its regular meeting on June 25, '1951, did instruct the City ,Secretary to advertise 'in the off:icialpublication of the City and to give written notice to{ail property owners whose. property lies within 200 feet: of the West ~ of Lot 3, Block 19 of the West University Place First ,Addition, of a public hearing to be held at 7:30 P.M., July 13, 1951, ili the City Hall to determine..: whether, or not.' ' ' WHERFAS, in pursuance to the,:direction givenh~'by the City Commission and in full compliance with the charter and the Ordinances of ztZ I . , ') III III . :) [".:1. r,: :__:I.l~ /0 the City, the City Secreta~.did ca~~ to be published in the Southwestern 0 Times on July 5, 1951, and did mail to each of the owners of property lying within 200 feet of 'the West! of Lot 3, Block No. 19 of West University Place First Addition, notice of a hearing to be held in the City Hall, 3800 University Boulevard at 7:30 P.M. on July 13, 1951, to consider amending Ordinance No. 111 so as to permit the' constrUction applied for; and WHEREAS ,pursuant: to such notice a public hearing was held by the City Commission at the City Hall and,at the time specified in such notice, at which hearing all testimony was heard arid fUlly considered by'the City Commission as to the advisability and proprietY. of amending Ordinanoe No. III so as to permit the constrUction of a' dwelling house on the West! of Lot 3, Block No. 19, in the West University Place. First Addition to consist of less than 51% brick on the exterior surface of such house; . and WHEREI\S, the City CoDmiission, after having heard all facts and after having considered the plans and specifications submitted by Mrs. Winnie Kiibler, and further hav;i.ng considered the report and recommenda- tion of the Zoning and Planning Board,t is of the opinion that Ordinance No. III should be amended so,as..to permit the construction on the West! of Lot 3, Block 19, West UniversityPlace.FirstAddition, but only in accordance with the plans and specifications as presented to the Zoning and Planning Board and as presented to the City Commission by Mrs. Winnie Kiibler; and WHEREAS, the City Commission;andMayor, of the City of West University Place, Texas, desire to amend Ordinance No. 111 to allow such construction, and believe that it will be to the public interest to so amend the same: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 'THE CITY OF, WEST. UNIVERSITY" PLACE; 'TEXAS;' , 1: o ,Section 1. That the City Commission of the City of West University Place, Texas, does hereby find and determine that each and all of the proceedings 'hereinabove mentioned have beeri duly and legally taken and performed in full compliance with the law and the Charter and Ordinances of the City of West University Place, Texas, and that all provisions and requirements of the ,law and thesaid'Charter andOrdinances.prerequi'site to the holding of a . public hearing for the' purpose of conSidering the amending of Zoning Ordinance No. 111, have-been had and fully complied with. . Section 2. That the City Commission of the' City of West University Place, Texas, does hereby find and determine that a public hearing for the 'purpose of considering- an amendIilentto Ordinance No~ 111 so as to permit the construction by Mrs.' Winnie Kiibler on the West ! of Lot' 3 in Block 19, West University Place First Addition, aocording to plans and specifications 'submitted by the said Mrs. Winnie Kiibler,' was duly held at 7:30 P.M. on JUly 13, 1951, in'the City Hall of West.University Place, Texas, in pursuance to the notiee of such hearing duly and legally made in accordance with. the ordinances of the City. Section 1.
