WHEREAS, the City Commission of the Cny CF WEST UNIVERSITY PLACE,
TEXAS, has heretofore duly and regularly detemined the necessity for, and
ordered the advertising ,for purchase of a comminutor te> be installed in the
City Sanitary Sewage Disposal Plant ; and ' ,
,WHEREAS, pursuant to advertisement forbids made on: May'~ 28,. '1951,

of the CITY: OF WEST (UNIVERSITY PLACE, 'a sealed bid, 'waS duly and lega,lly

, and the time stated in said advertisement .thereforfr'and1iaving been duly
and legally received, said bid was publicly opened at a meeting of.the City
Commission on the,;l~th day of June,: 1951, and'readaloud,and.s.uch bid at
said meeting was ,dUly and legally referr.ed to the Engineer for, tabulation,

. WHEREAS, it appears from the recommendation of Irving L. Peabody,
City Engineer for the CITY CF WEST UNIVERSITY PLACE, TEXAS, that the bid of
Chicago Pwnp Company is an acceptable bid and is the lowest responsible bid
received for the sale of one comminutor to the Crry OF WEST UNIVERSITY
PLACE; ~ and' ' ,
'WHEaEAS, the ~Ci~y de~i~e~.to ~ward.:a contract of pu.rchase at this
time to Chicago Pump Company for the sale by the said Chicago Pump Company
to the CI'r.~ <:F m5T UNI~lfi PLACE~' TEXAS, of one 'comminutor for the sum.
of $4696.00, and subject to the terms of sale a,s set forth in the bid
received from Chicago Pwup Comppny;and '
WHEREAS, pursuant. to, cerf,ificate by the City Treasurer, duly and
legally made as to the availability of funds, the City Commission has
heretofore, by 0rdinance No.' 573, duly and legally passed, made appropriation

from the Fund to the credit of the Sanitary Sewer Capital Improvement Fund to
pay the City's cost of purchase of said comminutor;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF WEST UNIVERSITY PLACE, iTEXAS,:,,'"
Section 1. That ,the 0ity,Conimission of the Cl'ry' OF WEST UNIVERSITY
PLACE, TEXAS, does hereby-rirlci andUdetermine that each and all of the steps
and proceedings 'herein~pove .lIl~t.:ioll'~h~ve~ been duly and l.egally taken and
performed in full compliance with the law and the Charter and Ordinances of
the CITY OF .WEST:UNlVERSITYu PLACE", and that all provisions and requirements
of the law and of said-Charter and Ordinance:, -prerequisite to the letting of
a contract of purchase !o~~thEFPurch'ase - by the Oi ty of ,one comm1nutor to
be installed in the City's existing Sanitary ~ewer Disposal Plant, have been
met and fully complied with.
Section 2. That the report and recommendation of Irving L. Peabody,
City Engineer, on the bid, receivf3d. at the office of the City Secretary on
June -16,'~'1951,::r~- itJiej'purchastiofsald comminutor, which bid was duly and
legally openedand.,'read\aIc)Ud;"'!on\'June 18, 1951, at a regular meeting of the
City Commission, is hereby again approved. and adopted.
!.eJ;:~i.o.tt.1. That the lowest secure, bid. of the lowest responsible
bidder for the sale of one comminutor to the CITY'OF WEST 'UNIVERSITY 'PLACE
is the bid of $4696.00 submitted to the City by Chicago Pump Company; and
:-J the said Chicago Pump Company is hereby found and determined to be the

Section~. That the contract for the sale of one comminutor by

Chicago Pump Company to the CITY OF WEST UNIVERSITY PLACE" in 'accordance,
~ with the terms submitted in the bid of Chicago Pump Company, is hereby
awarded to the said Chicago Pump Comp8l'lY:..,
Section 5. The Kayor and the City Secretary are hereby authorized
and directed to execute a contract with Chicago Pump Company for and ~on
behalf of, and in the name of, the CITY OF WEST UNIVERSITY PLACE, TEXAS,
in accordance with the terms set forth in the bid of Chicago Pump .Company.
~t.ion 6. The fact that the installation of a comminutor in
the ~Sanitar.r Sewage Disposal Plant is immediately necessary to protect the
public health, and the need for said comminutor is said sewage disposal
plant creating a public emergency, this ordinance shall therefore be passed
finally on the date of its introduction, this, the 25th day of June, 1951,
and shall take effect immediately upon its passage and approval by the
Mayor.
