AN ORDINANCE FINDING AND DETERMINING THAT ALL PROCEEDINGS
HAVE HERETOFORE BEEN HAD AND ALL THINGS DONE PREREQUISITE
TO THE. EXECUTION OF A CONTRACT FOR THE CONSTRUCTION OF A
WET WELL AT THE EXISTING SANITARY SEWER LIFT PLANT AT THE
CORNER OF. RUTGERS STREEl' AND UNIVERSITY BOULEVARD;
APPROVING AND ADOPI'ING THE REPORT AND RECOMMENDATION OF
THE CITY ENGINEER ON THE BID RECEIVED FOR THE CONSTRUCTION
~ - OF SAID WET WELL; ACCEPTING THE BID OF RUSS MITCHELL, INC.,
AS THE LOWEST SECURE BID OF THE LOWEST RESPONSIBLE BIDDER,
AND AWARDING TO RUSS MITCHELL, INC., THE CONTRACT FOR THE
CONSTRUCTION OF SAID WET Vv'ELL; APPROVING AND ACCEPI'ING AND
AUTHORIZING THE APPROVAL -AND ACCEPI'ANCE OF THE PERFORMANCE
BOND IN CONNECTION WITH SAID CONSTRUCTION; FINDING THAT
. , . SAJD CONTRACTOR HAS PROPERLY EXECUTED A CONTRACT FOR THE
CONSTRUCTION ORDERED; APPROVING SAID CONTRACT, AND AurHOR-
IZING A..1IJD DIRECTING THE EXECUTION THEREOF BY THE lVlAYOR AND
CITY SECRETARY ON BEHAIF OF THE CITY OF WEST UNIVERSITY
PLACE, TEXAS, AND DECLARING AN EMERGENCY.

- WHEREAS, the City Commission of the City of West University
Place, Texas has heretofo~e duly and regularly determined the necessity for
and ordered .Ghe construction of a wet well at the existing Sanitary Sewer Lift
Plant at the corner of Rutgers Street and University Boulevard, in accordance
with the plans and specifications prepared by the City Engineer and approved
by the City Commission; and
WHEREAS, pursuant to advertisement for bids made on January 25,
1951, in the Southwestern Times, a weekly publication with general circula-
tion in the City of West University Place, such advertisement being made in
full compliance with all requirements of law, and Charter and Ordinances of
the City of West University Place, Texas, a sealed bicl was du~ and legally
received on the 12th day of February, A. D. 1951, the same being within the
date and the time stated in said advertisement therefor; and having been duly
and legally received, said bid was publicly opened at a meeting of the City
Commission on the 12th day of February, A. D. 1951, and read aloud, and such
bid at said meeting was duly and legally referred to the City Engineer for
tabulation, report and recommendation; and

vVHEREAS, it appears from the tabulation, report and recommenda-
tion of Irving L. Peabody, City Engineer for the City of West University Place,
which report and recommendation are hereby approved and adopted, that the bid
of Russ Mitchell, Inc., is an acceptable bid and is the lowest responsible bid
received for such construction; and
WHEREAS, the City desires to award a contract at this time for
the construction of a wet well at the existing Sanitary Sewer Lift Plant at
the corner of Rutgers Street and University Boulevard, in accordance with the
plans and specifications prepared by the City Engineer and approved by the
City Commission; and that the bid of Russ Mitchell, Inc., is in the sum of
$4,900.00; and
WHEREAS, the said Russ ~atchell, Inc., has executed and filed

good and sufficient performance bond with proper surety,. as required by the
City Charter, and has duly and regularly executed a contract for the perform-
ance of the work of constructing said wet well; and is entitled to a contract
from and ~tp the City of West University Plac~, Texas therefor; and

WHEREAS, pursuant to certificate by the City Treasurer, duly
and legally made ?os to t.he, availability of funds, the City Commission has
heretofore, by Ordinance No. 548, duly and legally passed, made appropriation
from the Fund to the credit of the Sanitary Sewer Capital Improvement Fund,
and from the~Fund to the credit of the Water":'Sewer Operating Fund in the City
Treasury to pay the City's cost of construction of said wet well;
NOW, THEREFO~E, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF WF.BT UNIVERSITY PLACE, TEXAS:
S!,>ction.1., That the City Commission of the City of West
University Place does hereby find and determine that each and all of the steps
and proceedings hereinabove mentioned have been duly and legally taken and
performed in full compliance with the law and Charter and Ordinances of the
City'of West University Place, and that all provisions and requirements of the
law, and-of said ~harter and Ordinances prerequisite to the letting and execu-
tion of a valid contract for the construction of the wet well, as herein
mentioned, have been met and fully complied with.
Section 2. That the report and recommendation of Irving L.
Peabody, City Engineer of the City of West University Place, on the bid
received at the office of City Secretary of the City of West University Place,
on February 12, 1951, for the construction of said wet well, is hereby again
approved and adopted.
Section 3. That the lowest secure bid received for the con-
struction of a wet well at the existing Sanitary Sewer Lift Plant at the
corner of Rutgers Street and University Boulevard, according to the plans and
specifications prepared by the City Engineer and approved by the City Commission;
the same being the only bid submitted for such construction, is the sum of
$4,900.00 submitted by Russ Mitchell, Inc., who is hereby found and determined
to be the lowest responsible bidder on said construction, and the bid of Russ~
Mitchell, Inc., is hereby accepted.
Section 4. That the contract for the construction of said wet
well is hereby awarded to the said Russ Mitchell, Inc.
Section ~. That the performance bond presented by Russ
Mitchell, Inc., with the Standard Accident Insurance Company as surety,
having been examined, is hereby approved and accepted; and the Mayor of the
City of West University Place, is hereby authorized to approve and accept
said bond for and on behalf of the City.
Section 6. That the said Russ Mitchell, Inc., having heretofore
executed a contract for the construction of said wet well, and said contract
having been examined by the City Attorney and approved by him, the same is
hereby in all things approved; and the Mayor and City Secretary are hereby
authorized and directed to execute said contract for and on behalf of, and in
the name of the City of West University Place, Texas.

Section 7.~ The fact that the construction of said wet well is,
immediately necessary to. protect the public health, and the need for which II
creates a public emergency, this Ordinance shall therefore be passed'finally . II i
'on the date of 'its introduction, this the 26th day'of Fe~ruary, A. D. 1951, --..J
and shall take effect immediately upon its passage and approval by the Mayor.
