III COMMONLY KNOWN AS "ZONING ORDINANCEtI OF THE CITY OF WEST UNIVERSITY PLACE SHOULD BE AMENDED SO AS TO PERrflT THE CONSTRUCTION OF A REGU1.~TOR STATION BY HOUSTON NATURAL GAS CORPORATION ON THE SOUTH 20 FEEl' OF LOT 15, BLOCK 1, KENT PLACE, 2ND SECTION OF THE CITY OF lNEST ~UNIVERSITY PUCE, TEXAS; AMENDING SECTION III OF ORDINANCE III OF THE CITY OF WEST UNIVERSITY PLACE SO AS TO PROVIDE FOR THE PERMISSIVE CONSTRUCTION AND USE OF A REGULATOR STATION BY HOUSTON NATURAL GAS CORPORATION ON THE SOUTH 20 FEEl' OF LOT 15, BLOCK I, KENT PLACE, 2ND SECTION OF THE CITY OF 7,'EST UNIVERSITY PLACE, TEXAE); AND PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT A.!\1D BE nr FORCE IMMEDIATELY FROM AND AFTER ITS PASSAGE AND APPROVAL. o [J WHEREAS, Houston Natural Gas Corporation has heretofore made application to the Building Inspector of the City of West University Place, Texas for a permit to construct a regulator station on the South 20 feet of Lot 15, Block I, Kent Place, 2nd Section of the City of West University Place, Texas, such regulator station of said corporation which now exists in the esplanade of Bellaire Boulevard, and which application was referred by the Building Inspector to the Zoning and Planning Board of the City of West University Place for its consideration; and WHEREAS, at a regular meeting of the Zoning and ?lanning Board of the City of West University Place, Texas it was determined that the loca- tion of such regulator station on such property would be in violation of Section III of Ordinance No. III of the City of West University Place, Texas, but that such ordinance should be amended so as to provide for the permissive use of such property for the erecting thereon and operations thereon of a regulator station and did make such recommendation to the City Commission; and lJIlHEREA.S, at a regular meeting of the City:CoIlliniss'ion ,Qf.'the~ , Ci ty ~of ~ ;We~t JUnI vet-s:fty 'Pbi~~~ ~~ocas, held: bn:i.22nd:iciay<.6f,'cJafttiapg:'f '1951: and-upon the '1Jequest.'lof':,Houst~:h'Natul1al,G&s'00PPd:bp.tion.' anCiuf.>on 't~El. [J ] l ] 127 .recommendation of the Zoning and'Pla.nnihg Board, the Building Inspector and City Attorney of the City of West University Place, Texas, it was determined that a public hearing should be held to consider whether Ordinance No. III of the City of West University Place, Texas should be amended so as to permit the construction of a regulator station by Houston Natural Gas Corporation on Lot 15, Block I, Kent Place, 2nd Section of the City of West University Place, Texas; and WHERIDLq the City Commission of the City of West .UniversityPlace, Texas at its regular meeting held on January 22, 1951, did instruct the City Secretary to advertise in the Official Publication of the City and 'to give -; written notice to all property owners whose property lies within 200 feetof the South 20 feet of Lot 15, Block I, Kent. Place, 2nd Section of the City of West University Place, Texas of a public hearing to be held on February 12, 1951 at 7:00 p.m. in the City Hall to determine whether or not Ordinance No. Ill, commonly known as the "Zoning Ordinancel' should be amended so as to provide for the permissive use of the South 20 Feet of Lot 15, Block 1, ,Kent Place, 2nd Section of the City of West Uni versi ty Place, Texas for the ..erection thereon of a regulator station to be built by Houston Natural Gas Corporation; and WHEREAS, in pursuance of the direction given him by the City Commission and in full compliance with the Charter and Ordinances of the City of West University Place, Texas, the eity Secretary of the CityofVVe'St University Place, Texas did cause to be published in the Southwestern Times on January 25, 1951 and did mail to each of. the owners of property lying in 200 feet of ,the -South 20 Feet of Lot 15, Block I, Kent Place, 2nd Section of the City of West University Place, Texas a notice of a hearing to be held by the City Commission of the City of West University Place in the City Hall, 3800 University Boulevard at 7:00 p.m. Monday, February 12, 1951 to consider amending OrdinariceNo. III as recommended by the Zoning and Planning Boarct..of the City.of West University Place to permit the construction of andthe.opera- tionof a regulator station to be built by the Houston Natural GasCorporatJion on the South 20 feet of Lot 15, Block 1, Kent Place, 2nd Section of the City of West University Place, Texas; and WHEREAS, pursuant to such notice a public hearing was held by the City Commission of the City of West University Place" Texas at the City Hall, 3800 University Boulevard, at 7:00 p.m., Monday, February 12, 1951 at which hearing all testimony and evidence was heard and fully considered._' by the City Commission of the City of West University Place," Texas as to the advisability of amending Ordinan'ce No. I,ll so as to permit the construction of and the operation of a regulator station by the Houston Natural Gas Corpora- tion on such property; and V'THEREAS, it appears to the City Commission from 'the -report arip. recommendation of the Zoning and Planning Board, and the report and recommenda- tion of the Building Inspector and from all evidence and testimony presented I at such Public Hearing that Section III of Ordinance III of the City of West University Place should be amended so as to permit the construction and opera- tionof a regulator station by the Houston Natural Gas Corporation on the South 20 feet of Lot 15, Block 1, Kent Place, 2nd Section of theCity'of West Univer- sity Place, Texas; and WHEREAS, the city, acting through its City Commission and Mayor III 1:.: 11_ J~: ,,~ 128 desires to amend Section III of Ordinance No. III of the City of West University Place and believes that it would be tbthe public interest to so amensi the same; NOW, THEREFORE, o BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST , UNIVERSITY PlACE, TEXAS: Section 1. That the City Commission of the City of West University Place, Texas, does hereby find and determine that each and all of the steps and proceedings .hereinabove mentioned have been duly and legally taken and performed in full compliance with the law and Charter and Ordinances of the, City of West University Place, Texas, and that all provisions and requirements of the law and of said Charter and Ordinances prerequisite to the holding of a . P;ublic Hearing for the purpose of considering the amending of ~oning Ordinance No. III have been met and fully complied with. Section 2. That the City Commission of the City of ~Nest University Place, Texas does hereby find and determine that a Public Hearing for the c purpose of considering an amendment of Section 3 of Ordinance No. III to permit the construction of and the operation of a regulator station to be built by the Houston Natural Gas Corporation on the South 20 fee"t of Lot 15, Block ,l, Kent Place, 2nd Section of. the City of West University Place, Texas was duly held at 7:00 p.m. on Monday.the 12th day of February, 1951 a:t the City Hall of the City "of West University Place, Texas in pursuance of the notices 9f such hearing, duly and legally made in accordance with the law and Charter and Ordinances of the City of West University Place, Texas; Section 3. That the report and ,recommendation of the Zoning and Planning Board,of the City of vtest University Place and. the report and__ recommendation of the Building Inspector of the City of West University Place, Texas, that Section 3 of Ordinance No. III be amended so as to permit the construction of and the operation of a regulator station on the South 20 feet, Lot 15, Block I, Kent Place, 2nd Section of the City of West University Place, Texas, is again hereby approved and,'" adppd:.ed. That the City Commission of the City of West University Place, Texas does hereby find that the construction of and the operation of a regulator station on the South 20 feet, Lot 15, Block I, Kent Place, 2nd Section of the City of West University Place, Texas, is to the pUl:>,~ic interest and that Section 3 of Ordinance No. Ill, should be amended so as to" provide for such construction and operation. Section 5. That Section 3 of Ordinance No. 111 of the City of West University Place, Texas is hereby amended by the addition of a sub-paragraph No. (5) to read as follows: ItA regulator station for the regulation of the flow of natural gas shall be permitted and such regulator station may be ~ operated on the South 20 feet of Lot 15, Block I, Kent Place, 2nd Section of the City of West Univer~ity Place, Texas, said regulator station shall be of masonry and/or steel construction and shall be built in accordance with plans and specifications approved by the City Engineer.1t o n i ,-" ~I I J 129 Sedtion 6.
