WILLIAMS, SUBSEQUENTLY ASSIGNED TO J. L. WILLIAMS CONSTRUCTION CO., INC~, To-wrr, BY SUBSTITUTING THEREFOR' THE WEST ONE-HALF. OF THE INTERSECTION OF ACADEMY STREET AND CASON STREET;;. RATIFytNG AND APPROVING SAID SUBSTITUTION AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COMMI9SION OF THE CITY OF WEST UNI- VERSITY PLACE, TEXAS: ""l ;~ , Section 1. The City Commission gfthe City of West University Place, Texas, does hereby find and.determine that, in the October 25, 1948, contract awarded Brogan & Williams by Ordinance No. 417" assignment whereof. to J. L.. Williams Construction Co., II'!c. was 'approved by Ordinance No. 472 of June 27, 1949, the permanent improvement of certain street intersections in the city was provided for, including: , Section No. 26 - WESIAYAN and West-Half of Ruskin; and that it has been heretofore determined that it was not practical to proceed with the improvement of said Section No. 26, and with .the consent of the Con~ractor there has been substituted, in said contract, for, said Section No. 26, the following: West One-Half of the,interseci!io~ of Ac~demy Street and Cason Street, being that por.~ion of thC?inter$ection lying West of the center line of Acaaemy-Street; . :] but no formal ordinance of substitution has been heretofore passed. Section No.2. That the action of the City Commission with the consent of the Contractor in making the above mentioned substit.ution should be, and the same is he'reby, in all things fatifie9- and approved, to t~e same effect and extent as though said substituted intersection had constituted the above described Section No. 26 in said October 25, 1948, contract as originally executed; and sa~d originally set forth Section No. 26 is in all things deleted from said contract. Section No.3. The fact that the above mentioned substitution has heretofore been agreed to and made, and a formal ordinanqe rec~rd, thereof should be entered, creates a public emergency and therefore this ordinance shall be passed finally on the date of its introduction, this the lOth day of July, 1950, and shall take effect immediately upon its passage and approval by the Mayor.
