ORDINANCE NO. 514
AN ORDINANCE FINDING AND DETERMINING THAT THE IMPROVEMENT
OF THE INTERSECTIONS OF wEsT POINT STREET WITH CASE AND
BYRON STREETS CONSTITUTING SECTIONS NOS. 7 and 8 IN THE
OCTOBER 25, 1948 CONTRACT WITH BROGAN & WILLIAMS HAVE
BEEN COMPLETED IN ACCORDANCE WITH SAID CONTRACT; ACOEPTING
THE WORK AND IMPROVEMENTS ON SAID SECTIONS; APPROVING THE
ENGINEER'S ESTIMATE AND AUTHORIZING AND DIRECTING SETTLE-
MENT IN ACCORDANCE THEREWITH; and DECLARING AN EMERGENCY.
WHEREAS, under date of October 25, 1948, the City of West
University Place, Texas, awarded a contract to Brogan & Williams, Con-
tractor, for the construction of certain permanent improvements on 34
numbered sections constituting street intersections in said city, and
incl~ding as Sections Nos. 7 and 8 the intersections of West Point Street
with Case Street and B,yron Street; and thereafter approved assignment
of said contract to J. L. Williams Construction Co., Inc.; and there-
after authorized the performance of said work as to said Sections Nos.
7 and 8 by Russ Mitchell, Inc. in connection with other work adjacent
to said sections; and

WHEREAS, all of the improvemen~s provided by said contract
with reference to said Sections 7 and 8 have been completed in accordance
with the plans and specifications therefor, and the EDgineer for the City
has made his report and certification with reference to the completion of
said work, and has now presented his final estimate in connection there-
wi th;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF WEST UNIVERSITY PLACE, TEXAS:
Section 1. The City Commission hereby finds and determines
that the Engineer for the City has examined, measured and satisfactorily
tested the work done and improvements accomplished on the hereinabove
and hereinafter mentioned sections, and has found and determined and has
so certified that such work and improvements have been done, constructed
and fully completed in full compliance with the terms and provisions of
said contract of October 25, 1948, and has recommended that such work
and improvements be accepted; and the City Commission of the City of
West University Place, Texas does hereby find and determine that the
work and improvement of the following street intersections, to-wit:
Section No.7: West Point and Case Streets
Section No.8: West Point and Byron Streets
have been performed, constructed and completed in full compliance with
the terms and provisions of said October 25, 1948 contract; and said
City Commission does here and now accept such work and improvements on
behalf of, and as the act of, the City of West University Place, Texas.
Section 2. The City Commission having examined the final esti-

mate prepared and presented by the Engineer for the City with reference to
the completion of said improvements and the sums due Contractor under said
contract (together with certain extra work heretofore authorized) here and
now approves and adopts said final estimate as so prepared and presented
by the Engineer for the City; and hereby authorized and directs the Mayor
and City Treasurer to make final settlement with said Contractor, J. L.
Williams Construction Co., Inc. in accordance with said final estimate,
and to pay for the extra work heretofore authorized and covered by separate
invoice to the City approved by said Engineer.
Section 3. Theone year maintenance guarantee period provided
in Contractor's bond shall date: from the date hereof as to said Sections
7 and 8.
Section 4. The fact that the improvements have been completed
on said Sections 7 and. 8 as described in said October 25, 1948.contract
in full accordance with the terms thereof, and Contractor is entitled to
final settlement of said contract as to said Sections 7 and 8, creates a
public emergency, and therefore this ordinance shall be passed finally on
the date of its introduction this 24th day of April, A. D. 1950, and shall
take effect immediately upon its passage,and approval by the Mayor.
