AN ORDINANCE APPROPRIATING THE SUM OF $3,950.47 OUT OF THE FUND
TO THE CREDIT OF STREET IMPROVEMENT BONDS SERIES 1948 IN THE
CITY TREASURY TO PAY THE CITY'S AGREED CONTRIBUTIONS TOWARD THE
CasTS OF CERTAIN RESPECTIVE 'PORTIONS OF THE IMPROVEMENT OF MERCER
STREET BETWEEN THE SOUTH LTIiE OF UNIVERSI TY BOULEVARD AND THE
NORTH LINE OF BELLAIRE BOULEVARD UNDER DIRECT CONTRACTS BETWEEN
PROPERTY OWNmS AND SOUTHWEST PAVING COMPANY, CONTRACTOR; AND DE-
CLARING AN EMERGEN CY.

WHEREAS, it has been brought to the attention of the City commission
that numerous owners of property abutting on Mercer street be'tween the South
line of University Boulevard and the North line of Bellaire Boulevard, have
evidenced their willingness and desire to make arrangements, and are negotiat-
ing, with Southwest Paving Company, as Contra,ctor, for the reconstruction
of said portion of said street in accordance with plans and specifications
approved by the City and providing in general for a reconstructed asphalt
stabilized base with a 1-1/2 inch Duraco topping and with reconstruction of
certain portions of the curb in; but desire that, in addition to the use of
certain funds payable by Houston Natural Gas Corporation toward the recon-
struction of that portion of Mercer Street wherein said company replaced its
line; that the City make contributions toward the costs of construction of
various portions of the work and for certain contributions to and for the
benefit of each respective owner whose property sides rather than fronts on
said street; and the City Engineer having estimated that the approximate
maximum aggregate of such requested contributions by the City is $3,950.47,
assuming that each of the respective requested contributions is made; and
the City Treasurer has duly and regularly certified that there is in the
treasury in the fund to the credit of street improvement bonds, Series 1948,
not appropriated for any other purpose, and now available for appropriation
for the purpose stated, said sum as so estimated by the City Engineer;

'NOW, THEREFORE, BE IT ORDAINED BY THE CITY COIvlMISSION OF THE CITY
OF WEST UNIVERSITY PLACE, TEXAS:
Section 1. That there is hereby appropriated out of the fund to
the credit of Street Improvement Bonds Series 1948 in the City Treasury, the
various respective sums, being the requested contributions heretofore agreed
upon and which shall be set forth in detail together with the conditions
upon which sarile shall be made in the Ordinance specifically authorizing such
contributions; the maximum aggregate of said respect.~V"e separate sums being
$3,950.47, and which sum is hereby appropriated to pay the maximum aggregate
of the Ci~'s contributions toward the cost of reconstruction of Mercer
Street from the South line of Universi~ Boulevard to the North line of
BellaireBpu.levard.
Section 2. The Mayor and City Treasurer are hereby authorized to
draw warrants against said aggregate fund so appropriated as may be necessary
to separately pay and discharge the obligations and contributions of the City
to and for the respective portions of the costs on said street as shall be
directed by separate ordinance.

fined as in the natUre of improvements as promptly as possible creates a
public emergency, and ,therefore this ordinance shall be passed finally on
the date of its introduction and shall take effect immediately upon its
passage and approval by the Mayor.'
