AN ORDINAN9E PROVIDING FOR, UTHORI ZING AND DIRECTING CERTAIN ',J
AMENDMENTS IN AND ADDENDA T THE JULY 11, 1949 CONTRACT BETWEEN
THE CITY AND RUSS MITCHELL, NC., CONTRACTOR, WITH REFERENCE
TO THE PAVING OF CERTAIN PO TIONS OF BYRON, CASE AND WEST POINT
STREETS; (AUTHORIZING' AND DI, CTING -tHE EXECUTION OF SUCH AMEND-
MENTS AND ADDENDA BY THE MA~OR AND CITY SECRETARY AND INCORPORA-
TION THEREOF AS A PART OF SAiID CONTRACT WITH RUSS M;[TCHELL, INC.,
AND DECLARING AN EMERGENCY. I
BE IT ORDAINED BY THE CITY dOMMISSION OF THE CITY OF WEST 'UNIVERSITY
PLACE, TEXAS:
Section 1. That, the City Co ission of the City of West University
discussed same with Russ Mitchell, Inc., Contractor, hereby finds and de-
termines that it is advisable and nece sary to make certain amendments and
addenda to the July ll, 1949 contract Eth Russ Mitchell, Inc., and it is
not practical to proceed with the improvement of those portions of Byron,
Case and West Point Streets on'which'ccntract has been awarded under the
presently worded contract and contract documents; said sections on'which
contract has been so awarded being:

West Point from S.P.L~ bf Case Street to N.P.L. of
Byron Street;

Sect.ion ?- The City Commiss.on having examined the proposed
amendment and addenda to said July 11, 1949 contract covering and with
reference to the above portions of the streets named, and which amendment
and addenda has been heretofore approvrd by Contrac'tor and the surety on
its bonds, here now provides for, authorizes and directs the amendments and
addenda to said contract as heretOforelapproved by Contractor and its
surety, and covering matters generally and briefly stated as folloWs:

(1) Deletion of intersectio s of West Point 'Street with Byron
and Case Streets, respebtively, and accordingly amending
the three segregated sebtions into which the work has been
di videO.;
(2)
Allocating and dividing among said segregated sections the
period of construction fhereof;
Providing for cooperation and coordination of Contractor's
work with the work heretofore awarded covering said inter-
sections;
(3)
(4) Stipulating the maximum portion of the cost under said con-
tract to be borne bythf City, '!lith the remainder to be paid
by ,property owners on negotiated contracts;

(5) Providing for work orders on the segregated sections only
upon arrangements for paving not less than 90% thereof re-
spectively, and providing for an option of cancellation by
the City as to the respective sections.
Section 3. The Mayor and City Secretary are hereby empowered,
authorized and directed to execute said contract amendment and addenda on
behalf of the City, and to attach same to said original contract of July 11,
1949, and to incorporate same therein as a part thereof.
Section h. The fact that the portions of the streets hereinbefore
stated, and constituting the segregated sections covered by said contract,
are in need of improvement as promptly as possible creates a public emergency;
and therefore this ordinance shall be passed finally on the date of its in-
troduction, this the 11th day of July, 1949, and shall take effect immediately
upon its passage and approval by the Mayor.
