AN, ORDINANCE AUTHORIZING THE DELIVERY OF TIME WARRANTS
WHEREAS, The Layne-Texas Company, Ltd., has presented its Estimate
No. lin the total sum of $27,800 under its contract with the City of West
University Place approved by the City Commission on May 9, 1949, for drilling,
developing and producing one gravel water well and furnishing and installing
a deep well pump with electric motor and installing a booster pump With an
electric motor; and '
WHEREAS~ said Estimate No.1 and the claim based thereon have been
approved by the City Engineer, and the City of West University Place has re-
cei ved the full benefit of the work performed under said contract to the full'
extent of said claim; and no person, 'firm, corporation or trust estate has
given notice in writing, or otherwise, to said city, ,or to any official
thereof, of any liens for any material, apparatus, fixtures, machinery or
labor furnished to said contractors, as provided by Chapter 17, Acts of 1925
(Article 5472-a, Vernon's 1925 Statutes), or any other, law; and further; that
the city does not hold a claim of any kind or character against said contractor
which might be properly charged or interposed as an offset or counterclaim
to the payment of the aforesaid estimate and claim; and
WHEREAS, said contract provides for the withholding of 10% of the
/contract price until the contract work has been fully p~rformed and accepted
by the city and it is now just and proper to deliver $25,000 in the princi-
pal amount of the City of West UniversJty Place Watervvorks Improvement Time
Warrants, Series 1949, to evidence the inUebtedness of the city for the
benefits received under said contract; Therefore
BE IT ORDAINED by the City Commission of the City of West Uni-
versity Place, Texas:

Section, 1: That Estimate No.1 of The Layne-Texas Company, Ltd., in the
principal sum of $27,800 be, and the same is" hereby, approved and allowed, ,
and the City of West University Place hereby acknowledge$ receipt of the
benefits represented by said estimate and the claim based thereon, to the full
extent of $27,800.
Section 2: That for the purpose of evidencing the city's indebtedness for
work done under said contract as shown, by Estimate '~Jo. 1, there shal:J- be exe-
_ cuted and delivered to The Layne-Texas Company, Ltd., Warrants Nos. 1 to 25,
both inclusive, of the City of West University Place Waterworks Improvement
Time Warrants, S~ries 1949, aggregating $25,000, and that the sum of $2,800
shall be carried forward to be included in the final delivery of warrants.
