APPROVING .AND ~PT~NG THE REPORT AND RECOMMENDATION OF THE ENGINEER ON BIDS RECEIVED FOR THE PAVING A1'JD IMPROVING OF SAID PORTIONS OF SAID STREETS; ACCEPTING THE BID OF BROGAN & WILLIAMS AS THE LOWEST SECURE BID' OF THE LOWEST RESPONSIBLE BIDDER, AND AWARDING TO IT THE CONTRACT FOR THE PAVING AND IMPROVING OF SAID PORTIONS OF SAID STREETS;) APPROVING AND, ACCEPTmNG AND AUTHORIZING THE APPROVAL AND ACCEPTANCE OF THE PERFORMANCE HOND AND ,MAINTENANCE :BOND IN CONNECTION WITH SAID IMPROVEMENT; FINDING THAT SAID CON- TR.I\.CTOR HAS PROPERLY EXECUTED A COI'JTRACT FOR THE IWRGVEMENTS ORDER- ED, APPROVING SAID CONTRACT AND AUTHORIZING AND DIRECTIN.G THE EXECUTION THEREOF BY THE MAYOR AND CITY SECRETARY ON BEHAIFOF' THE CITY OF WEST UNIVERSITY ,PLACE, T~S, AND DECLARING AN ENi:ERGENCY. WHEREAS, the City Conunission of. the City of West University Place, Texas, has heretofore determined the necessity for and ordered the permanent improvement of portions of certain streets in the City of West University Place, Texas, in accordance with plans and specifications prepared by the Engineer for said City and approved by the City Conunission; and _I ! WHEREAS, pursuant to advertisement for bids made ,in full compliance wi th all requirements of law and the Charter and Ordinance of the City of West University Place, Texas, sealed bids were duly and legally received upon the date and at the time stated ih said advertisement Jtherefor, and having been duly and legally received, publicly opened and read aloud in a public meeting of the City Commission of the Cit,y of ,West University Place, Texas, were referred to the Engineer for said City for tabulat1on,' report and recom- mendation; and WHEREAS, it appears from the tabulation, "'report ,andrecommendation ,L' L. _ .... .... ., _..._.. .;:;r _. ::~.:;... ;--x r26' " ~~ , , " / of Henry J. Johnson, Engineer for the City of West University Place, Texas, which report and recommendation is hereby approved and adopted, that Brogan , & Williams' is the lowes~.responsible bidder and that its bid, in the sum of $9,496.43 is the lowest secure bid received for such improvements; and o WHERE.L\.S, said Brogan'& Williams has executep. and filed good and sufficient performance and maintenance bonds wi~h proper surety, as required by the City Charter, and has duly and regularly executed a contract for the performance of the work of paving and improving said portions of said s~reets, providing, among other things, for concrete with bar reinforcement, as hereto- fore determined upon by the City Commission, and is entitled to a contract from ,the City of West University Place, Texas, therefor; and WHEREAS, pursuant to certificate 'by the City Treasurer duly and legally made a~.to the availability of funds, the City Commission ha~ heretofore by Ordinance, d,uly and legally passed, made, appropriation from the fund to the' credit of Str.eet Improvement Bnnds, Series 1948 in. the City Treasury to pay the cost of paving and improving said portions of said streets; NOW, 'fHEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF. rHE CITY OF WEST mUVERSITY PLACE, TEXAS: Section 1. That the City Commisf?ion of .the. City of West University Place, Texas, does hereby find and,eetermine that each of the steps and pro- ceedings hereinabove mentioned have been duly and legally taken and performed in full compliance with the law and Charter and Ordinances of the City of West University Place,. Texas, and that all provisions and requirements of the J' " law and of said Charter arid Or~rtances prerequisite' to the letting and execu- tion of a valid co~tract for the street improvements h~ein mentioned have been, met and fully complied with. Section 2. That the report and recommendation of Henry J. Johnson, Engineer for the City of 'West University Place" Texas, on the bids received January 18, 1949, for the paving and improving of the hereinafter stated portions of the streets named is hereby' approved and adopted. Section 3. That the lowest secure bid received for the. paving and improving of the portions of the streets hereinafter named and within the limits stated is the sum of $9,496.43, submitted by Brogan & Williams, which is hereby 'found and determined to be the lowest responsible bidder on said improvements, and said bid is hereby accepted. Section 4. That the contract for the paving and improving of: ,Section,No.l. South one-half of Judson Street, abutting College Court Park in the 4200 block on said street; Section No.2. East one-half of Simmons Street abutting College Court Park in the 5700 block on said street; Section No.3. North one-half of South ~udson Street, abutting College Court Park in the 4200 block on said street; Seetion No.4. Intersection of Judson and South Judson Streets; c ,/ 1"27 I Section No. 5~ South one-half of intersection of Judson and Simmons Streets; Section No.6. Intersection of South Judson and Simmons Streets, is hereby awarded to the said Brogan & Williams. Section 5. That the performance and maintenance bonds presented by the said Brogan & Williams, with U. S. Fidelity and 'Guaranty Co. as surety, having been examined, are hereby approved and accepted; and the Mayor of the City of West University Place is hereby authorized to approve and accept said bonds on behalf of the City. Section 6. That said Brogan & Williams, having heretofore executed a contract for making the improvements referred to, and said contract having been examined, same is hereby in all things .approved; and the Mayor and City Secretary are hereby authorized and directed to execute said contract for and oh behalf of and in the name of the City of West University Place, Texas. Section 7. The fac~ that the portions of the streets hereinbefore stated are in need of improvement as promptly as possible creates a public emergency, and, therefore, this Ordinance shall be passed finally on the date of its introduction this 24th day of January, 1949, and shall take effect immediately upon its passage and approval by the Mayor.
