AN ORDINANCE RELEASING THE UNEXPENDED PORTION OF THE $12,000, HERETOFORE APPROPRIATED BY ORDINANCE NO. 406 IN CONNECTION WITH THE PAVING AND IMFROVING OF PORTIONS' OF UNIVERSITY BOULEVARD, FROM SAID APPROPRIATION; TRANSF~RING SAID UNEXPENDED FUNDS TO TH~ GENERAL CREDIT OF STREET IMPROVK~ENT BONDS, SERIES 1948, AND DEb~ING SAME AVAILABLE FOR 01'HER APPROPRIATION; AND DECLARING AN EMERGENCY. - , ,..--, WHEREAS, -by its Ordinance No. 406, passed and approved September 27,1948, the City Commission appropriated the sum 0l-'$12,000 out of the fund to the credit of Street Improvement Bonds Series 19h8 to pay the City's additio- nal part of the cost of pavin~ and improving portions of University Boulevard comprising Sections 1, 2 and 4 as in said ordinance described; and . WHEREAS, the work and improvenients under the June 21, 1948 contract with Russ Mitchell, Inc., with reference to said sections of said University Boulevard, has been completed and final settlement made with said Contractor under said contract, leaving unexpended and unnecessary for expenditure the sum of $6,317.89; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. The City Commission does here and now find and determine that _of the sum of $~2,000 appt,'opriated by Ordinance No. 406, the sum_ of $6,317~'89 rem?iils~urie.xperidedand unnecessary after the final completion of the contracts dnSections 1, 2 and 4; that all bills payable by the City under _said contracts have been paid or deduction from said appropriated sum made therefor,- and that after such deduction the above, stated sum is unexpended and unnecessary, and that said sum should be and is hereby released and dis- charged from said earlier appropriation~ !l ,~~ Section 2. That said unexpended fund should be and'the same hereby is hereby transferred to the general credit of Street Improvement Bonds Series 1948 in the City Treasury; and is henceforth available-for appr~priation for and other proper purpose. Section i. The fact that said unexpended fund out of the said earlier appropriation should be made available for other appropriations creates a public emergency and therefore this ordinance shall be passed finally on the date of its introduction and shall take effect immediately upon its passage and approval by the Mayor.
