ORDINANCE NO. 441
AN ORDINANCE RELEASING THE UNEXPENDED PORTION OF, THE $56,000,
HERETOFORE APPROPRIATED BY ORDINANCE NO. 385 IN CONNECTION WITH
THE PAVING AND IMPROVING OF PORTIONS OF UNIVERSITY BOULEVARD
FROM SAID AfPROPRIATION; TRANSFERRING SAID UNEXPENDED FmmS TO
THE GENERAL CREDIT OF STREET PAVING AND BRIDGE BONDS, -1946,
AND DECLARING SAME AVAILABLE FOR OTHER APPROPRIATION; AND DE-
Ch~RING AN EMERGENCY.
WHEREAS, by its Ordinance No. 385, passed and approved June 21,
1948, the City CommisSion appropriated the sum of $56,000 out of the fund to
the credit of Street Paving and Bridge Bonds, 1946 to pay the City's part of
the cost of paving and improving portions of University Boulevard comprising
Sections No.1; 2"a.nd4, as in said ordinance described; and
WHEREAS, the work and improvements under the June 21, 1948, contract
with RUss Mitchell, Inc., with reference to said sections of said University
, Boulevard, has been completed and final settlement made with said Contractor
under said~contract, leaving unexpended out of said sum so appropriated the
sum of $65.09; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF V{EST UNIVERSITY
PLACE, TEXAS:
Section 1. The City Commission does here and now find and determine
that of the sum of $56,000 appropriated by Ordinance No. 385, the sum 9f
~ $65.09 remains unexpended after the final completion of the contract on those
portions of University B~ulevardcomprising Sections No.1, 2, and 4, as de-
scribed in said contract; that all bills payable by the City in connection
with said contract have been paid save and except certain items covered by
and to be paid out of the $12,000 additional appropriation subsequently made
with reference to said contract; and that said unexpended sum should be and
the same is hereby released and discharged from said earl~er appropriation.
Section 2. That said unexpended fund S1 ould be and the same here-
by is hereby transferred to the general credit of Street Paving and Bridge-
Bonds, 1946 in the City Treasury; and is henceforth available for appropri-
ation for any other proper purpose.
Section J. The fact that said unexpended fund out of the said earlier
appropriation should be made availab~e for other appropriations creates a
public emergency and therefore this ordinance shall, be passed finally on the
date of its introduction and shall take effect immediately upon its passage and
approval by the Mayor.
