AN ORm NANCE RELEASING THE UNEXPENDED PORTION OF CERTAIN MONEYS,
HERETOFORE APPROPRIATED BY ORDINAt~CES NO. 377 AND 379 IN CONNEC-
TION WITH THE IMPROVEMENT OF PORTIONS OF ,ACADEMY STREET, FROM
SAID APPROPRIATIONS, TRANSFERRING SAID UNEXPE11DED FUNDS TO THE
GENERAL CREDIT OF STREET PAVING AND BRIDGE BONDS, 1946, AND DE-
CLARING SAME AVAILABLE FOR OTHER APPROPRIATION: AND DECLARING
AN EMERGENCY.
WHEREAS, pursuant to. Treasurer's Certificate No. 7 and by Ordinance
No. 377, passed and approved May 10, 1948, the City Commission appropriated
the sum of $10,000.~but'6f the fl.lI\dsto the credit of Street Paving and Bridge
Bonds, 1~46 to pay the cost ,of. paving and improving street intersections on
A~Ciq~my Street from theNorth~line of University Boulevard to the South line
of Richmond Road; and
WHEREAS, pursuant to Treasurer's Certificate No.8, and by Ordinance
No. 379, passed and approved May 10, 1948, the City Commission appropriated
the sum of $4,500 out of the funds ,to the credit of Street Paving and Bridge
Bonds, 1946 to pay the City's agreed contribution toward the cost of street
improvements on Academy Street between the North line of,Un~versity Boulevard
and the South line of Richmond Road; and, "
WHEREAS, the work and the improvements under-the respective .con-
tracts with reference to said portions of said street has been completed, and
final settlement made thereunder, leaving unexpended out of said appropriations
~ the aggregate'sum of $41.02, with all bills paid except for legal services,-
_ to cover which other funds are available and allocated; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY
PLACE, TEXAS:
Section 1. The City Commission does here and now find and determine
that of the sum of $14,500 appropriated by Ordinances Nos. 377 and 379 the
sum of $41.02 remains unexpended after the final completion of the contracts
on Academy Street between University Boulevard and Ri.chmondRoad; that all
bills payable by the City on the above me~tioned projects have been paid save
and except that for legal services, to cover which other funds are available
and allocated; and that said unexpended sum should be and is hereby released
and discharged from said' earlier appropriations.
Section, 2. That ,said unexpended funds should be and same are hereby
transferred to the general credit of the fund to the credit of Street Paving
and Bridge Bonds, 1946 in the City Treasury; and is henceforth available for
appropriation for any other proper purpose.
Section 3. The fact that said unexpended funds out of the said
earlier appropr~ations'f!PQ~d be made available for other appropriations
creates a public emergency and therefore this ordinance shall be passed
finally on the date of i~s introduction and shall take effect immediately
upon its passage and approval by the Mayor.
