AND ORDER.ING TFf-AT CERTAIN PORTIONS OF THE JUDSON, SIMMONS AND SOUTH JUDSON STREETS, ABUTTING THE CITY PARK IN THE 4200 BLOCK OF JUDSON STREET TOGETHER WITH CERTAIN INTERSECTIONS IN THE CITY OF liVEST UNIVERSITY PLACE, TEXAS, SHALL BE IMPROVED; APPROVING AND ADOPTING P1.ANS AND SPECI- FICATIONS FOR SUCH IMPROVEMENTS; DIRECTING THE CITY SECRETARY TO ADVERTISE FOR BIDS TO BE RECEIVED AND FILED WITHIN THE TIME PRO- VIDED, AND DECLARING' AN EMERGENCY. . WHEREAS, the City Commission of the City of West University Place, Texas, has heretofore considered the advisability and necessity of the perma- nent improvement of the hereinabove and hereinafter stated portions of certain streets in the City of 'West University Place, Texas, and plans and specifi- cations for such improvements have been prepared by the Engineers for said City, and submitted to the City Commission; and having examined and considered said plans and specifications, the City Commission has decided to initiate the improvement of said portions of said streets; NoW; Therefore, BE IT ORDAINED BY THE CITY COMMISS ION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. The City Commission of the City of West University Place, Texas, hereby determines the necessity for and orders the permanent improvement of the herein~fter designated portions of the streets naned, each of which are hereby segregated and divided into s'eparate and segregated sections, to-wi t : Section No. 1. South one-half of Judson Street, abutting the City's Park in the 4200 Block on said street; Section No.2. East one-half of Simmons Street abutting t&~'City's Park in the 5700 Block on said street; Section No.3. North one-half of South Judson Street, abutting the City's Park in the 4200 Block on said street; Section No.4. Intersection of Judson and South Judson Streets; Section No.5. South one-half of intersection of Judson and Simmons Streets; Section No.6. Intersection of South Judson and Simmons Streets. ' Section 2. Each of the above designated sections and the contract with reference thereto shall be separate and distinct the same as though sepa- rate instruments and contracts had been executed for each such section sepa- rately, each constituting a separate and distinct unit unto itself, wholly unrelated to and independent of each other such section; and the sequence in which said respective segregated sections shall be constructed, and the respec- tive begin'1:ri.rig'dates,thereon, shall be determined by the engineers for the City. Section 3. Section 4. The fact that the portions of the streets herein ordered improved within the limits herein defined and stated are in need of improve- ment as promptly as possible, creates a public emergency, and therefore this Ordinance shall be passed finally on the date of its introduction, this 4th day of January, 1949, and shall take effect immediat~ly upon its passaseand , approval by the Mayo~.
