AN ORDINANCE WITHR'EFERENCE TO THE OFFER OF BROGAN & WilLIAMS,
CONTRACTOR, TO PAVE, AS ADDITIONAL OR EXTRA WORK UNDER CONTRACT
HERETOFORE AWARDED, THAT PORTION OF THE 3800 BLOCK ON AMHERST
STREET ON WHICH CIT,Y-OWNED PROPERTY ABUTS CONTEMPORANEOUSLY WITH
, THE REMAINDER HF SAID BLOCK UNDER ,DIRECT PROPERTY-OWNER .CONTRACTS;
FINDING AND DETERMINING THAT THE ACCEPTANCE OF SUCH OFFER WOULD BE MOST AD- '
VANTAGEOUS AND WOULD RESULT IN A SAVING TO THE CITY; FINDING AND DETERMINING
THAT THE APPROPRIATIONS HERETOFORE MADE BY ORDINANCES NO. 405 AND NO. 416
. ARE SUFFICIENT TO COVER THE CITY'S COST OF' SAID AMHERST STREET PAVING; APPROVING
AND ADOPTING THE RECOMMENDATION OF THE ENGINEER THAT SAID OFFER BE ACC~TED '
AND ACCEPTING SAID OFFER, OF BROGAN & WILLIAMS; AUTHORIZING AND DIRECTING THE
ENGINEER FOR: THE CITY TO ISSUE A WORK ORDER ON SAID ADDITIONAL OR EXTRA WORK
UNDER SAID CONTRACT; PROVIDING FOR PAYMENT THEREFOR, AND DECLARING AN EMERGENCY.
WHEaEAS, various property owners have heretofore executed contracts
with W. E. Brogan; Jr., and J. L. Williams ,composing the partnersbJ.p of .
Brogan & Williams, Cont.i'actor, for the paving andimproving.of Amherst Street
in the 3800 block 'thereof, in accordance with plans and specifications ~here-
tofore approved by the City, save and except 1.55 feet on the South side of
said street whereon property owned by the City of West University Place, .
Texas, abuts; and ' ,
, WHEREAS, the City of West Uni versi tyPlace, Texas, has heretofore
under date of August 9, 1948, received competitive bids for the pavement
and improvement of the thirty-four enumerated street intersections in the City,
I and pursuant to appropriations made by Ordinances No. 405,and No", 416 has
heretofore executed contracts with said Brogan & Williams for the pavement
~ and improvement of said intersections, and which contracts provide for the
performance of'extra or additional work at,the same unit prices as set forth
in said contracts; and
WHEREAS, in connection' with the pavement of the intersection' of
College Street and Amherst Street (Section No. 29 in said contract), and in
connection with the pavement under direct property owner contracts for the
remainder of said 3800 block'on Amherst Street Brogan & Williams have offered
to contemporaneously pave and improve that portion of said block on Amherst
Street whereon' the..:..Gij:.~.p.l;"~pe,~ty abuts 155 feet; and have offered to perform
such work as extra or additional work under said intersection contracts, but
to give the City the benefit of the same per front foot unit price as ap- '
plicable in the private-owner contracts, as distinguished from the necessar~ly
higher prices for the segregated intersections under the City contract; and
the Engineer for the City has recommended that such offer'he accepted, NOW,
THEREFORE,
BE IT ORDAINED BY THE, CITY COMMISSION OF THE CITY OF WEST UNIVERSITY
PLACE, TEXAS:

Section 1: That the City Commission of the City of West Uni versi ty
Place, Texas, does hereby find and determine that the September 20 and
October 25, 1948, contracts' duly and regularly made and en tered into between
the City and Brogan & Williams,' Contractor, ,for the pavement of thirty-four
segregated intersections as therein enumerated, contemplate and provide for
the performance of additional or extra work thereunder as may be directed;

that the specifications approved by the City for the improvements to be
constructed by Brogan & Williams under direct contracts with propert,y owners
in the 3800 block on Amherst Street provide for the same type of construction
as required by ,the specifications in said intersection contracts and as
would be required in any contract executed by the City for the pavement of
its frontage on said Amherst Street; that the $6.09 per front foot unit
price offered by Brogan & Williams to the-City for paving its 155 foot front-
age is the same as the cash unit price for which such work i~ being done for
the property owners, is somewhat less than the cost if calculated on the
basis of ,unit prices ~ubmitted for the isolated, segregated intersections,
a.,.l1d is less than bids heretofore received for the pavement of "skipped"
properties; that the acceptance of Brogan ~ Williams' offer would permit the
simultaneous paving ,of ,the entire 3800 block on Amherst Street llIlder the
direction, supervision and inspection of the Engineer for tl1e City, would
save the City additional cost of advertising for separate bids which would
necessarily be higher due to increasing costs and the small quantity of work
which would be involved; that the appropriations heretofore made by Ordinances
No. 405 andN~t~4l6 for said streetintersectibn contracts are sufficient to
cover the 'cost of paving the City's 155 feet under the Br0gan & ,Williams'
offer. ' ,.
Section 2: That the City Commission of the City of-West University
,Place does hereby find and determine that the acceptance of the offer of
Brogan & Williams to pave the City's 155 foot frontage on Amherst Street would
be most advantageous to the City and would effect a saving to said City. '
Section '3 : That the recommendation of Henry J. Johnson, Engineer
for the City, should be and is hereby approved and adopted. '
Section u: That" the offer of Brogan & Williams to pave andim-
prove that portion of Amherst Street on which the 'City-owned property ahuts
155 feet at the rate of $6.00 per front foot for street pavement and'mono-
lithic curbs, to be constructed as extra or additional work under said,street
intersection contracts, should be and is hereby accepted.
, Section ~: The Engineer for the City is hereby authorized and
directed to issue a Work Order to said Contractor to pave and improve said
portion of Amherst Street in accordance with the plans and specifications
heretofore approved by the City for the pavement'ofthe remainder of said
block; arid payment shall be made to the Contractor for said work upon com-
pletion and acceptance,thereof.
Section 6: The.fact that.said contractor is commencing the work
on other portions of said street and the fact that the portion of said street
on which the said property abuts is also in need of improvement as promptly
as possible creates a public emergency and therefore thisrordinance shall be
passed finally on the date of its introductio, this the 19th day of N()yember,
1948, and shall take effect immediately upon its passage and approval by;the
Mayor. ' -
