HomeMy WebLinkAboutORD 413- ORD Authorizing and Directing the mayor and City Treasurer to Pay Contractor Brogan and Williams underSpecified Condition 23: ORDINANCE NO. 413 I I I I ~ AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND CITY TREASURER, ffiiillER SPECIFIED CONDITIONS, TO PAY TO BROGAN & VVILLIAMS, CONTRACTORS, CERTAIN SUMS AS A CONTRIBUTION BY THE CITY TO COST OF PAVING PORTIONS OF ACADEMY STREET BE- TWEEN THE NQRTH LINE OF SOUTHWESTERN STREET AND THE SOUTH LINE OF UNIVERSITY BOULEVARD, WITH REFERENCE TO WHICH OWNERS OF PROpERTY HAVE AND WILL MAKE CONTRACTS DIRECT WITH I~A.ID, CON~RACTORS;, AND DECLARING AN EMERGENCY. r.' .,.., ",.,~ .,f"" ~ ~ '.. ' WHEREAS, certain owners of property abutting in Academy Street and lying between the North line of Southwestern Street and the South line of University Boulevard in the City of West University Place, Texas, have ~videnced their willingness and desire to make arrangements for the paving of said street and to make payment of the full cost thereof (except intersections, as to which contract has heretofore been let,by the City) without cost to the City; which action hi the property owners will result in -a considerable saving to the City;. but 'll!. l WHEREAS, the said properties on said portionofhAcademy Street ,are so platted that the longer side of each of said respective lots abuts on Academy Street and the houses on each of said lots side instead of fronting said street, so ~hat the paving cost to each such property and the owner thereof on a strict full per front foot basis would be disproportionate to the benefits to the respective properties; and request hasbeen made that the City make contribution to the cost of the street paving abutting such respective lots; and ---, i I WHEREAS, pursuant to certification by the City Treasurer, appropriation ~ has been made of' a sum sufficient in the aggregate to cover the proposed contri- bution by the City to each of said respective lots separately; NOW, THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. The Mayor and City Treasurer.arehereby authorized and directed'to'payto Broga:n"&Williams,Contractor, for .and on behalf of the' respectivej5roperty owners separately, who and whose property meet the ,con- ditionsherein specified, 'a sum equivalent to twenty-five'per cent (25%) of.the total cost of the streetpave:rnentabuttingthe respective individual lots on said Academy Street and within the limits above set forth. Section 2. Such contribution by the City and payment thereof, as a- bove authorized, shall be made in only the instances and under only the con- ditions as follows: A. To quail..ify for such contribution, the particular property must be so platted that the longer side of the particular lot abuts said street; B. If improvements have been heretofore erected on such siding lot, as in subsection Aabove,'s-uch improvements must face the East-West cross street and not face on Academy Street; n ~. . ..,. . :31. _______--....1. In the event a particulariot has not yet been im- prated and improvements can be erected thereon front- ing,either Academy Street or the cross street, then contribution by the .City shall be made only'upon the recommendation of the Engineer for. the City; ':1 I LJ D. While the contribution by the City is not conditioned on the pavement of said Academy Street opposite each and every' property ,thereon,- all, or substantially all of the property owners in the same block on said Academy Street must pay, or make satisfactory arrangements with said Contractor to pay, their full cost of the street improve- ments, so that in the judgment of the Engineer for th~ City the street will be paved sufficiently solidly in the particular block to justify the expense; ;,1" E. The contribution'by the City as to each'particular pro- perty separately, will. be paid to the Contractor, Brogan & Williams, upon the completion of the wor,k in each respective '" blOCk, and certj,fication thereof by the Engineer for the City as hav{ng been completed in accordance with the plans ,. , , and spec~fications earlier approved for the work by the City Commission. , I Section 3. The fact that said Academy Street, within the limits d~fined~and each portion thereof abutting each respective lot referred to, is in need of improvement as promptly as possible;, and the ,fact that contract has ' heretofore been :I.et for the paving of intersections on Academy Street, within ',J, . the limits stated, creates a public emergency, and, therefore, this Ordinance shal~ be passed finally on the date of its introduction,.this 8th,day of October, 1948, and shall take effect immediately upon its passage and approval of the Mayor.
