HomeMy WebLinkAboutORD 384 - ORD Releasing and Discharging Unexpended Funds approriated by ORD 340 I, II ,) L" 1,___" ,I 176 ORDINANCE NO. 384 AN ORDINANCE RELEASING AND DISCHARGING CERTAIN UNEXPENDED FUNDS HERETOFORE APPROPRIATED BY ORDINANCE NO. 340'FOR PATING THE CITY'S PART OF THE COST OF CERTAIN PORTIONS OF UNIVERSITY BOULEVARD, WESLAYAN STREET, RICE BOULEVARD, AND AUDEN STREET, AND DECLARING SAME AVAILABLE FOR APPROPRIATION OUT OF THE FUND TO THE CREDIT OF THE STREET PAVING AND BRIDGE BONDS, 1946, FOR OTHER AUTHORIZED WORK, AND DECLARING AN EMERGENCY. ~ WHEREAS, by ordinance., No. 340, duly and regularly passed and approved April 3, '1947, .the sum of $125,000 was. appropriated out of the funds in the City Treasury to the credit of the Street Paving and Bridge Bonds, 1946, for the purpose of paying the City's portion of the cost of paving and improving certain portions of. University Boulevard, Weslayan Street, Rice Botllevard, and Auden Street, as therein set out; and contract was made and entered into of said date between the Ci-ty' atld Holland Page, as Contractor, for such street improve- ment; and I WHEREAS, by subsequent ordinances various portions of the streets theretofore ordered, improved, and to cover the City's portion of the cost of which said funds were appropriated, were deleted from the paving program, arid all those portions cf s~id streets actually improved under said paving program and said April 3, 1947, contract with Holland Page, CO!ltractor, have been completed and final settlement made with the contractor thereon, and said portions of said streets improved have been accepted by the City by its Ordinance No. 364, duly and regularly passed and approved March 8th, 1948; and WHEREAS, said funds so earlier appropriated and unused in connection with said April 3, 1948, contract have heretofore been actually released and transferred as available funds to the credit of the Street Paving and Bridge Bonds, 1946, but no ordinance formally so releasing and discharging said unexpended funds from the earlier appropriation ordinance No. 340 appears of record; NOW, THEREFOR~, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS:, Section 1. All that portion of the $125,000.00 appropriated by Ordinance No. 340, passed and approved April 3, 1947, out of the funds to the credit of the Street Paving and Bridge Bonds, 1946, in the City Treasury unexpended in connection with said April 3, 1947, contract between the City and Holland Page, Contractor, final settlement on Which has heretofore been made pursuant to Ordinance No. 364, duly and regularly passed and approved March 8th, 1948, be, and same are hereby, released and discharged from said earlier appropriation and are hereby found and declared to be available in the City Treasury to the credit of the Street Paving and Bridge Bonds, 1946, for appropriation for use on another authorized projects. Section 2. The foregoing release and discharge of said unexpended portion of the funds earlier appropriated shall be effective from and alter the final settlement between the City ancf'said Holland Page, Contractor, under the April 3, 1947, contract as amended. o :] " ;] [J 11 L-' ~ 177 Section 3. The fact that the unexpended portion of said $l25,ooo.oO earlier appropriated, as hereinabove ,stated, is required for other street improvements heretofore ordered, and which may hereafter be ordered, creates a public emergency, and therefore this ordinance shall be passed finally on the date of its introduction, this 21st day of June, 1948, and shall take effect i.1nJnediately upon its pass~ge and approval by the Mayor., PASSED this 21st day of June, 1948.
