AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND CITY TREASURER,
UNDER SPECIFIED CONDITIONS, TO PAY TO BROGAN AND WILLIAMS" CONTRACTORS,
CERTAIN SUMS AS A CONTRIBUTION BY THE CITY TO COST OF PAVING PORTIONS
OF ACADEMY STREET BETWEEN THE NORTH LINE, OF UNIVERSITY BOULEVARD, AND
THE SOUTH LINE OF RICHMOND ROAD, WITH, REFERENCE TO WHICH OWNERS OF
PROPERTY HAVE AND WILt MAKE CONTRACTS DIRECT WiTH SAID CONTRACTORS;
AND DECLARING .AN EMERGENCY.
'WHEREAS, certain owners of property abutting on Academy Street
and lying between the North line of University Boulevard and the South
line of Richmond Road in the City of West University Place, Texas, have
evidenced their willingness and desire to make arrangements for the
paving of said street and to make payment of the full cost thereof
(except intersections, as to which'contract has heretofore been let by
the City) without cost to the City; which action by the property owners
will result in a considerable saving to the City; but
WHEREAS, the said properties on said portion of Academy street
are so platted that the longer side of each of said respective lots abuts
on Academy Street and the houses on each of said lots side instead of
fronting said street, so that the paving cost to each such property and.
the owner thereof on a strict full per front foot basis would be
disproportionate to the benefits to the respective properties; and
request has been made that the City make contribution to the cost of the
street paving abutting such respective lots; and

WHEREAS, pursuant to certification by the City Treasurer,
appropriation has been made of a sum sufficient in t~e aggregate to cover
the proposed contribution by the City to each of said respective lots
separately; NOW, THEREFORE: '

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST
UNIVERSITY PLACE, TEXAS:
Section 1. The Mayor and City Treasurer are hereby authorized
and directed to pay to Brogan & Williams, Contractor, for and on behalf
of the respective property owners separately, who and whose property meet
the conditions herein specified, a sum equivalent to twenty-five percent
(25%) of the total cost of the street pavement abutting the respective
individual lots on said Academy Street and within the limits above set
forth.
Section 2. Such contribution by the City and payment thereof,
as above authorized, shall be made in only the instances and under only
the conditiops as follows:
A. To qualify for such contribution, the
particular property must be so platted that
the longer side of the particular lot abuts
said street;

B. If improvements have been heretofore erected
on such siding lot, as in subsection A above,
such improvements must face the East-West cross
street and not face on Academy Street;

C. In the event a, parti'cular lot has not yet been
improved and improvements can be erected thereon
fronting either Academy Street or the cross street,
then contribution by the city shall be made only
upon the recommendation of the engineer for the
City;
D~While the contribution by the City is not conditioned
on the pavement of said Academy Street opposite each
and every property thereon, all, or substantially all
of the property owners in the same block on said
r Academy Street must pay, or make satisfactory
arrangements with said contra.ctor to pay , their full
cost of the street improvements, so that 'in the
judgement of the engineer for the City c:bllestreet
will be paved sufficiently solidly in the particular
block'to justify the expense;
E. The contribution by the City as to each particular
property separately, will be paid to the Contractor,
Brogan & Williams ,upon the completion of the work in
each respective block, and certification thereof by
the engineer for the City as having been completed in
accordance with the plans and specifiCations earlier
approved for the work by the City Commission.

SectfuQn3. ,The fact that said Academy Street, within the limits,
defined'and each portion ~ereof abutting each respective lot
referred to, is in need of improvement as promptly as possible; and
, the fact that, contract has heretofore been let for the paving of
intersections on Academy Street~ ,within the limits stated, create a
public emergency, and, therefore,thisOrclinance shall be' passed '
finally on the date' of its introduction, this lOth dw of May, 1948,
and ~hall take effect immediately upon its passage and approval of
the Mayor.
