HomeMy WebLinkAboutORD 369 - ORD Authorizing and Directing the Conveyanceof Certain Lots 131 o ORDINA.NCE NO. 369 AN ORDINANCE A UfHOlRIZING AND DIRECTING THE CONVEYANCE OF A CERTAIN lOT HERETOFORE ACQUIRED BY THE CITY IN CONNECTION WITH THE OPENING OF COLERIDGE STREET, ']0 THE ABUTTING PROPERTY OWNERS UPON CONDITIONS AS HEREINAFTER STATED. iHHHHHHHHHH~*)HHh..,,*** WHEREAS, the City of West University Place, Texas, hereto- foreby deed dated September 29, 1941, purchased Lot No. Six (6) in Block No. Three (3), Sunset Terrace, Third Section in said City, and has opened Coleridge Street from the west to Auden Street on the east over and across said lot, which has therefore been dedicated as a public street; and WHEREAS, the owners of Lot No. Seven (7) and Lot No. Five' (5), respectively, in said block abutting said portion of Coleridge Street so.'opened across said Lot No.6, have requested the conveyance to them, respectively, of the underlying fee title in and to said Lot No.6, subject to the public use and interest as hereinafter provided, Now, Therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OJF 1JIIEST UNIVERSITY PLACE, TEXAS: :1 U Section 1. The City Commission of the City of West University Place, Texas, hereby finds and determines that the City purchased Lot No.6 in Block No.3, Sunset Terrace, Third Section in said City, as evidenced by deed in favor of the City, dated September 29, 1941, filed under County Clerk's File Number 61907, for the purpose of 'opening, Coleridge Street from the West to Auden street on the east; that Coleridge Stree-t- hasi'been S9 opened and dedicated as a public street over and across said lot; and that the City has not use for said property other than the public use, easement and right-of-way for street arid other purposes as applicable to the remainder of Coleridge Street; and that neither the City nor any mempe:r of the general public, nor any individual would be prejudiced nor adversely affected by the conveyance from the Gityto,the owners of the respective properties abutting upon said lot, but, that': such conveyance would vest in said respective owners the underlying fee title to the center line of Coleridge Street, same being the center line of said Lot No.6, thereby placing said abutting lots in the same situation as other prope rties abutting upon other portions of said Coleridge Street. o Section 2. That the Mayor and City Secretary of said City be, and they are hereby in all things, authorized to execute in the name and as the act of the City, a conveyance to Robert Hines and wife, Mabel, L. Hines, owners of Lot No. 7 in said Block No.3, and to E. S. Jacobson and wife, Marguerite Jacobson, owners of Lot No.5 in said Block No.3, the south one-half CSi) and the North one-half (Ni), respeetively, of said Lot No.6 in said Block No.3; provided, however, that such conveyance shall be subject to the public use, and to the continued easement and right- of-way for street and other public purposes over and across said Lot No.6; and provided further that said grantees affirmatively accept such convey- ance and agree to pay for street improvements' in and on that portion of ,.., v ) Jr I L: , I 132 , _..' Coleridge Street on which their respective presently-owned properties abut, the same as though their respect1,ve technical property lines had at all times extended to the center line of said Coleridge Street, being the center line of said Lot No.6; and provided further that said property owners promptly file said conveyance for record, paying the filing fee therefor. ;---\ I I I 1 i I '---' Section 3.
