It AN ORDINANCE DETERMINING THE NECESSITY FOR AND. ORDERING THAT UNIVERSITY OOULEV ARD FROM THE WEST LINE OF KIRBY DRIVE TO THE EAST LINE OF. COMMUNITY DRIVE; AND WESLAYAN STREET FROM THE SOOTH LINE OF RILEY STREET (East of Wes1ayan Street) TO THE SOUTH LINE OF RICHMOND ROAD; AND RICE BOULEVARD FROM THE WEST LINE OF KIRBY DRIVE TO THE "WEST LINE OF BELMONT STREET; AND -AUDEN STREET FROM THE NOiRTH LINE OF UNIVERSITY BOULEVARD TO THE NORTH LINE OF RICE BOULEVARD, IN THE CITY OF WEST. UNIVERSITY PLACE, TEXAS, SHALL BE IMPROVED: AroPTING AND APPROVING PLANS AND SPECIFICATIONS FOR SUCH IMPROVE- MENTS; PROVIDING FOR SEGREGATION OF rom'IONS OF SAID STREETS INTO SEPARATE SECTIONS. EACH OF WHICH SECTIONS SHALL BE TREATED AS A SEPARATE AND COMPLETE UNIT; DIRECTING AND REQUIRING THE GARRETT. ENGIEEERING COMPANY, ENGINEERS FOR THE CITY, TO PREPARE AN ESTIMATE OF THE COST OF SUCH IMPROVEMENTS AND A WRITTEN STATEMENT OF THE NAMES OF THE OWNERS OF THE PROPERTIES ABUl'TING ON EACH PORTION OF EACH STREET TO BE IMPROVED, TOGETHER WITH A DESCRIPTION OF THE RES- PECTIVE PROPERTIES; PROVIDING THAT A PART OF THE COST. OF SAID IM- PROVEMENTS SHALL B~ PAID BY THE CITY AND A PART OF THE COOT ,OF THE SAID IMPROVEMENl'S SHALL BE PAID BY AND ASSESSED AGAINST THE ABUTTING PROPERTY AND THE OWNERS THEREOF, AND FOR INCIDENTAL MATTERS; DECLAR- ING THAT THIS ORDINANCE AND ALL FURTHER PROCEEDINGS RELATING TO SUCH IMPRONEMENTS ARE AND SHALL BE UNDER AND BY VmTUE OF ARTIClE 1105 (b) OF THE REVISED STATUTES OF TEXAS: DIRECTING THE CITY SECRETARY TO FILE A NOTICE OF THIS ORDINANCE WITH THE COUNTY ClERK OF HARRIS COUNTY, TEXAS, AS PROVIDED BY LAW AND TO ADVERTISE FOJR BIDS TO BE RECEIVED AND FILED WITHIN THE TIME PROVIDED; AND DECLARING AN EMERGENCY" AND REPEALING AND RESCINDIID ALL ACTS AND THINGS HERETOFORE DONE PUR- SUANT TO SAID ORDINANCE NO. 321, AND IN CONNECTION WITH THE IMRROJVE- MENTS THEREIN ORDERED, . AND DECLARING AN EMERGENCY. u WHEREAS, the City Commission of the City of West University Place, Texas', has heretofore passed Qrdinance No. 321, the caption of which is hereinabove copied in the caption hereof, and which was subsequently duly approved; and whereas, additional and further aGtions and proceedings were subsequently taken and hadimn connection with the improvements so ordered, including advertisement for and receipt and tabulation of bids for said improvements, but the low bidder has failed ~nd refused to execute a contract "With the City for the construction ii,~-_j of said improvements; and whereas, certain changes in the contemplated improve- ments may be ordered; Now, Therefore, Q [J [1 229 BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Sec1iion 1. Tha1i Ordinance No. 321 here1iofore du1y and regu1arly passed by the Ci1iy of West University P1ace, Texas, on the 1st day of July, 1946, the caption of which is hereinabove quoted, be, and the same is hereby, repealed and declared nu11 and void and of no further force and effect. Section 2. That each and every additional and subsequent act and proceed- ing by the City Commission of the' City of West University Place, Texas, and by each official of said City, pursuant to said Ordinance No. 321, and in connection with the street improvements therein ordered, be, and the same are each repealed and rescinded and declared null and void and of no further force and effect.
