PREPARE AND FILE cOMPLETE SPECIFICATIONS FOR THE PROPOSED

OF THE OWNERS OF THE PROPERTY ABUTTING ON SAID STREET WITHIN
THE LIMITS NAMED; DIRECTING THE GARRETT ENGI:NEERING CO:MPANY,
ENGINEERS FOR THE CITY, TO PREPARE AN ESTThIATE OF THE COST OF
SUCH ThIPROVEMENTS, AND DECLARING AN E1JIERGENCY.
vVEEREAS, the City Commission of the City of West University
Place, Texas has decided to initiate the improvement of the follow-
ing streets; namely,
University Boulevard from Kirby Drive to Cowaunity Drive
Weslayan Street from Bellaire Boulevard to Richmond Road
Rice Boulevard from Kirby Drive to Belmont Street
Auden Street from University Boulevard to Rice Boulevard

BE IT ORDAI1'ED BY TEE CITY CONIMISSION OF THE CITY OF WEST UNIVER-
SITY PLACE, TEXAS:
. Section l. That the City Commission of the City of West
University Place, Texas, does hereby determine that it is necessary'
to improve the following streets:
University Boulevard from Kirby Drive to Community Drive
Weslayah street from Bellaire Boulevard to Richmond Road
Rice Boulevard from Kirby Drive to Belmont Street
Auden street from University Boulevard to Rice Boulevard
and does hereby order that said streets within said limits shall be
improved in the manner and with such kinds of pavement and material
or 'materials as may be adopted by the City Commission to be used in
~he construction of said improvement; that the width of the roadway
to be improved between curb lines is hereby fixed as follows:

that monolithic concrete curbs shall be constructed on each side
of said roadway where adequate and sufficient curbs are not now []
installed along curb lines so fixed; that said roadway shall be
improved from curb to curb by providing thereon concrete pavement
having a nominal thickness of 7 inches with such increased thick-
ness at construction joints as may be deemed adequate by the En-
gineer, either by construction, reconstruction or repair, as may be
found necessary and proper; that the maximUm cost at which the work
of constructing said improvement shall be let shall not exceed $4.,50
per square yard, including excavation, grading and concrete pavement
of those portions of said streets to be paved, and not exceeding
$1.00 per lineal foot of property improved for concrete curbs, all
in th~ manner as provided by Acts 1927, 40th Legislature of the State
of Texas, First Called Session, page 489, Chapter 106, said Act being
commonly known Article 110,5-b, Revised Civil Statutes of the state
of Texas, 1925, and relating to street improvements and assessments
therefor, and as provided by Article, XXII of the Charter of the City
of West University Place. '
Section 2, That the cost of said improvements shall be paid
as follows:
(A) Since there are no rails, tracks, double tracks, turnouts
and switches of any railway, street railway or interurban using, oc-
cupying or crossing any of said streets within the limits hereby
ordered improved, therefore no part of the cost of said improvements
can be assessed against any railway, street railway or interurban :i,' I

(B) The' owners of the property abutting on said Streets
within the limrts above set out, shall pay all of the cost of con-
struction, reconstruction, repairing and realigning curbs and gut-
ters, and shall pay the cost of paving l..5 square yards (13'..5 square
feet) for ea~h lineal foot of abutting property, but not to exceed
nine-tenths (9-l0ths) of the cost of the remaining improvements on
said Streets within the limits prescribed, exclusive of that portion
of said cost referred to in sub-section (c) of this section, and
said abutting property owners shall have assessed against them and
their property said costs for such ~provements in the manner pro-
vided by Acts of the 40th Legislature of the State of Texas, 1927,'
First called session, relating to street improvements and assessments
therefor, and being Chapter 106 of the General and Special Laws of
said session, said Act being commonly known as Article 1105-b, Re-,
vised Civil Statutes of the State of Texas, 192.5, and as provided

That said amounts payable by the property owners shall be paid
in five (.5) equal installments, one instalLment thirty days after the
completion of said improvements and the acceptance thereof by the City
of West University Place, one installment in one year from the date
of such acceptance; one installment in two years from said date of ac-
ceptance; one installment in three years from said date of acceptance"
and one installment in four years from said date of acceptance; with '
interest thereof from said date of acceptance at the rate of 1010 per
annum, payable annually; but said property owners shall have the privi-
lege of paying any of said installments before their maturity by pay~

ment of principal and interest thereon; providing, however, that no
amount shall be assessed against any property owner or his property,
'in excess of the benefits to said property in the enhanced value
thereof by reason of said improvement.
(C) The City of 't'Yest University Pla'ce shall pay the whole cost
of improving the intersections of said Streets with other streets and
, alleys (exclusive of the cost of curbs), and shall pay all of the re-
maining cost of said improvements, and in no event less than one-tenth
(l/lOth) of the remaining cost o~ said improvements.
Section 3. The Garrett Engineering Company is hereby directed
to prepare forthWith and file with the City Commission complete speci-
fications for the proposed improvement, upon each of the various kinds
of paving materials hereinabove set forth, so as to enable bids to be
secured separately upon each of said kinds of pavements; and said
specifications to be so arranged as that the City shall be enabled to
obtain bids for doing any portions of said work separately from the
other portions, if desired by the City Commission, together with a
written statement Which shall contain the names of persons, firms,
corporations and estates owning property abutting upon said streets
within the limits named, with the number .of front feet owned by each,
describing such property either by lot or block numb~r, or any other
nammer sufficient to identify it; and the Garrett Engineering Company
is further directed to prepare an estimate of the cost of such im-
prov eme nt s .
Section 4. The fact that the above streets between the inter-
sections mentioned are in bad condition and the same should be im-
proved immediately, creates a public emergency requiring that this
ordinance be passed finally on the date of its introduction, and the
Mayor haVing declared the existence of' SQch emergency and requested
such passage, this ordinance shall be passed finally on the date of
its introduction, this 27 day of May,A. D. 1946, and shall take effect
immediately upon its passage and approval by the Mayor.
