The resulting driveway will not end at a garage as required by ordinance. The applicant requests a special exception for an alternative design for the maneuvering area as well. Background Information The site is a through lot with street frontages on both Southwestern and Riley,with a third side street frontage on WestPoint. The combined building site is 50'wide by 250'deep. The platted lot fronting Riley Street contains a house and garage that will be demolished. The existing driveway will be removed and the curb restored. The applicant is requesting to add a curb cut from the WestPoint right of way to terminate in a driveway/maneuvering area that does not connect to a garage as required by code. Staff Response Special Exception Requests Table 7-5a limits the maximum number of curb cuts to"one per designated building site abutting the street." Note 5 of Table 7-5a authorizes additional curb cuts and specifically authorizes staff to approve the curb cuts for semi-circular driveways as prescribed in Chapter 70 of the Code of Ordinances. This proposed driveway would not be connected and so is not authorized without a special exception from the ZBA. Table 7-5(a)Note 6 requires that driveways connect to a garage in a direct route. Note 7 authorizes the ZBA to grant a special exception for an alternative location where warranted. Table 7-5a,Note 5 and Note 7 of the Zoning Ordinance gives the ZBA the authority to grant these special exceptions. The ZBA must find that the request is in harmony with the general purpose and intent of the Zoning Ordinance and that the request will not cause any significant increase in on-street parking or traffic,traffic congestion,or an unreasonable burden upon public utilities or services. If the Board grants the special exception,the Board can attach conditions. 1i General Rule: Every building site,vehicular area and related structure must conform Table 7-5a: to the applicable regulations shown, by District, in this table. The ZBA may issue a special exception for additional curb cuts. Exception: The Administrative Official may authorize additional curb cuts for a corner site when in compliance with the requirements for two curb cuts for circular driveways specifically allowed by Chapter 70 of the Code of Ordinances. These additional curb cuts are not prohibited and do not require a special exception. Note 6. Route;Alternating Driveways . Each driveway must connect garage space to the street by the most direct route. Exceptions: (i)this paragraph does not prohibit circular driveways specifically permitted under another ordinance of the City, and (ii)a driveway may be curved or moved away from the most direct route to the extent reasonably necessary to avoid destroying or seriously injuring a tree. Note 7. Special Exceptions . The ZBA may issue a special exception for a parking area, garage or driveway(or other maneuvering area) in another location or with a different design than prescribed by this ordinance, if it finds that: (i)the other location or design will not unreasonably interfere with available light and air and will not significantly alter access for fire-fighting and similar needs; (ii)the other location or design will prevent the destruction of a qualified tree; (iii) in the case of the remodeling of a principal building, the location requested is the same location as an existing parking area, garage or driveway; or(iv)the location or design requested is necessary for safety considerations. HOUSTON,TEXAS 77005 itts1229@atn (713)664-3136 October 29, 2019 City of West University Place Zoning Board of Adjustment West University Place, Texas 77005 Re: Application for Special Exceptions for 4147 Southwestern St. Dear Members of the Zoning Board, My husband and I are requesting a special exception to allow an additional curb cut and also a driveway that does not connect a garage to the street on our property. We own the corner lots at 4147 Southwestern Street and 4148 Riley Street. We have joined these lots together with the City and with HCAD. Originally, there was a house and detached garage at 4148 Riley. We have demolished those buildings and plan to build an accessory building. We are requesting a curb cut so we can access the driveway of the new structure. We have 3 vehicles and we drive only 2 at a time. Although the new building will not be a garage, we want to keep the third vehicle on the driveway of the new building so as to not have to park on the street. Southwestern is a narrow street that already has a lot of cars that are parked in the street on a regular basis. Often times, there are vehicles on both sides of the street which make driving down the street difficult. We do not want to add to the congestion. Also, we do not want to chance blocking the sidewalk. We will be building a fence around the property so the new building and driveway will not be visible from the street. Reasons for denial: 1. West Point is a major N/S artery for both citizens of West U and non-citizens cutting through West U to Bellaire Street. Having a curb cut approx. 38 feet from the Stop Sign on West Point at Riley St is an accident waiting to happen. 2. Many pedestrians, maids with children use this side walk on West Point for walking dogs, walking ,or going to the Rec Center, and a curb cut so close to the intersection is asking for an accident involving a pedestrian/child since most curb cuts are approx 98-100 feet from an intersection. 3. The approx. 25 foot distance between the side walk and the foundation currently under construction allows for very little room to park a car or truck. The design of this drive path appears to be very poorly thought out. 1 4. The existing curb cut for the driveway of the house that was torn down would be a much better ingress and egress on West Point. Please express my concerns at Thursday's Meeting on allowing this exception. This has not been thought out and should NOT be approved.
