Applicant's Request
The applicant in Docket 19-0008,6321 Buffalo Speedway,is requesting a variance from Table 7-2,entitled"Yards
(setbacks)". Table 7-2 establishes the minimum yard(setback)requirement for the front,side and rear of a building site.
Generally,most structures are not allowed in a yard(setback).
Background Information
The site is located on the west side of the 6300 block of Buffalo Speedway,approximately 300'south of University Blvd.
The site is 50'wide and 200'deep. A residential structure was built on the site in 1931 with a small garage. In 1994,the
small garage was demolished and a 12'by 50'garage was constructed. The rear of the garage is 20' from the rear property
line and the side is 3.3' and 3.2'at the respective corners. The space at the rear of the structure is open and unfinished
except for a pool bath and a garden potting area. The applicant is proposing to finish out the rear portion and convert it to
accessory quarters. Accessory quarters are allowed in a single-family district,but must not exceed 600 square feet. This
space is approximately 12'by 22'.
Staff Response
The minimum setback for any structure is 10%of the building site width or 5',whichever is greater. There is an exception
for certain garage space provided certain criteria are met. One of the criteria is that the space is used as garage space(and
the space above if two story). Since the applicant proposes to convert the space from garage(storage)to living(habitable)
space,the exception will not apply to the converted space.
Staff believes that the ZBA has the authority to grant this variance,but according to Section 11- 102 of the zoning
regulations,the ZBA may not issue a variance unless all of the following circumstances are present:
(1) The ZBA has made all findings and determinations required by state law for the granting of a variance.A"special
condition"or"hardship"that is self-created,personal or based only on financial reasons is not sufficient to support the
issuance of a variance.The findings to grant a favorable result for this application are as follows:
1. The ZBA must find that a literal enforcement of the ordinance would result in an unnecessary hardship.
2. By granting the variance would the spirit of the ordinance be observed and substantial justice done?
3. Would the variance be contrary to the public interest?
(2)The ZBA has made any additional findings and determinations required by a specific provision of this section which
relates to the variance.
(3)The variance has been reduced to writing and includes any conditions prescribed by the ZBA or required by this section
for the variance in question.
The ZBA may prescribe any conditions it determines necessary to support the granting of the variance.
General Rule: No part of any structure may be located within a part of a
building site included within a yard defined, by District, in this table.

But it is expressly agreed and stipulated that the Vendor's Lien and Superior Title are
retained against the above described property, premises, and improvements, until the
above described note and all accrued interest thereon are fully paid according to the
face, tenor,effect,and reading thereof,when this deed shall become absolute.
The contract between GRANTOR, as seller, and GRANTEE, as buyer, may
contain limitations as to warranties; to the extent said contract provides for such

Variance Request Narrative
We are the third owners of this 1934 home. The first owner family owned 6321 Buffalo Speedway until 1991. The
original home was modified to our knowledge in the interior by opening up the living and dining. The second owner
then purchased in 1991 and completed an addition in 1995 to include a new kitchen and family room and upstairs
master suite with office. At that time a one car garage was added with connecting full bath, 1 room with built-in upper
and lower cabinets and 1 small kitchen with sink, refrigerator, counter space and lower cabinets. The rooms behind the
garage have electricity,ceiling fans,water heater,full bath (sink,toilet and shower) and refrigerator. The second
owners built a pool and the spaces were designed for use with doors to bath, room and kitchen. Windows are present
to provide views of the pool and backyard. Note this total space including the garage is less than 600 square feet per
West U code.
We purchased the home in 2003. This variance request starts the beginning of our third major renovation of the home.
In 2008, we removed all the EIFS stucco from the addition and replace with masonry stucco. In addition, all the windows
were replaced with double pane windows many of them casement. Finally,facia,soffit and gutters were replaced.
In 2014,we gutted the kitchen and family room.
This third renovation involves shoring up the original part of the home. The original part of the home has knob and tube
wiring, likely near original water supply lines and very poor insulation. Some cosmetic work will be done as well
including painting, refinishing original hardwood floor, etc. As well,the master bath will be updated. With the total
home less than 2800 square feet, we felt best to update the current spaces behind the garage to live in while the work
was being done. This would allow us to monitor the progress of the work, and continue to maintain the yard and pool.
Too, I have an elderly mother who might need to live with us in the future. The updates to the spaces behind the garage
would allow her to stay with us with no steps as a hinderance. Currently there are two steps to get from kitchen/family
room to the bedrooms and bathrooms.
The variance we are requesting is to approve instead of the 5-foot side yard, approve the existing 3.5-foot side yard that
currently exists (per survey). The structure is there. Just the finishes and fixtures would change. This is a one-story
structure and does not hinder or impede any neighboring dwelling or property. The contractor will use more fire-
retardant sheetrock for added safety.This variance request also appeals to Appendix A Table 7.6 note 13 of Old Stock
Housing as a hardship.
Note 13. Old Stock Housing. The ZBA may issue a special exception to authorize projection of buildings and
attached structures into a side yard, rear yard or an SF Bufferyard, if the ZBA determines: (i) the projection is
reasonably necessary to preserve or protect old stock housing as it then exists or as it may be proposed to be
remodeled or expanded (up to a total gross floor area, for all buildings on the site, that does not exceed the
greater of 3,400 square feet or 200% of the gross floor area of all the buildings on the site when the principal
building was built, before 1980); and (ii) there will be no substantial adverse impact upon nearby properties.

The ZBA may consider protection or preservation of old stock housing as a factor in determining whether the
"hardship" test for a variance is met, either for such housing as it then exists or as it may be proposed to be
remodeled or expanded.

Additional Details: The side yard setback for a single family lot is 10%of the lot width or 5',
whichever is greater. An exception to this requirement allows a garage space to be 3' from the side
property line. The applicant has a pre-existing garage with a storage area behind it that is 3.5' from the
property line. The applicant wants to convert the storage space into living space by constructing an
accessory quarters which requires a setback of at least 5'.
