Meeting Minutes
May 16,2019
MEMBERS PRESENT: Richard Wilson, John Cutrer, Pete Johnston and Mimi Tsai
MEMBERS ABSENT: Mac Jensen, Michael McEnany and Brian Brantley
STAFF PRESENT: Gerardo Barrera, Interim Public Works Director,
Debbie Scarcella, City Planner, and Josie M. Hayes,

1. Notices, Rules, Etc. Richard Wilson; Presiding Officer, called the meeting to order at
6:23 pm. Richard Wilson asked staff to confirm that appropriate notices were given. Josie
Hayes stated notices were posted per state and local laws.
2. Public Comments. John Cutrer made a motion to reopen the public hearing regarding
balconies on second floors that project into the front yard. Seconded by Pete Johnston.
AYES: Richard Wilson, John Cutrer, Pete Johnston and Mimi Tsai. NOES: None.
Motion carried. Les Albin showed ZPC pictures that he took of balconies that he thought
were compliant and with some modifications, they would not be. Les Albin also stated he
did not think City staff is interpreting or enforcing the ordinance as it was intended to be
and suggested a definition be added to the existing ordinance, but he did not have
something drafted. John Cutrer made a motion to close the public hearing regarding
balconies on second floors that project into the front yard. Seconded by Richard Wilson.
AYES: Richard Wilson, John Cutrer, Pete Johnston and Mimi Tsai. NOES: None.
Motion carried.
3. Fence-Like Hedges in Front Yards. The ZPC discussed and reviewed the final draft
report. Richard Wilson made a motion to forward the formal fmal report to City Council
for their consideration. Seconded by Pete Johnston. AYES: Richard Wilson, John Cutrer,
Pete Johnston and Mimi Tsai. NOES: None. Motion carried.
4. Structural Heights. The ZPC discussed the proposed final report and ordinance that ZPC
had instructed staff to complete for their review. There was a minor change to clarify that
a residential structure in the rear twenty feet (rear setback) that is required to be elevated
can have the roof structure at a minimum 27 feet roof height. Pete Johnston made a
motion to forward the formal final report to City Council for their consideration.

Tsai. NOES:None. Motion carried.
5. Balconies on Second Floors that Project into the Front Yard. The ZPC had instructed
staff to bring back a final report and ordinance for review and consideration. At the last
meeting some questions as to what could be allowed on the second floor were brought up.
Staff looked up addresses and pulled site plans/floor plans for different balconies to check
their compliance status and provided those documents in the packet.. Those pictures and
plans were discussed by the ZPC. The consensus was that the porch/balcony
configurations were actually behind the front building line and were compliant. A
discussion followed regarding the wording for those structures above a ground floor
porch. ZPC deferred the discussion until the next meeting when more members would
potentially be available for discussion.
6. Property Maintenance Regulations. There was continued discussion regarding the
property maintenance regulations. The ZPC asked staff to bring back some changes to the
time frames in which conditions can exist before they are deemed noncompliant. The
ZPC instructed staff to bring the proposed ordinance to the next meeting.
7. Noise Regulations. There was general discussion regarding the noise regulations. The
ZPC is content with the structure of the ordinance, but would like to see enumeration of
noises with realistic decibel limits. Item was tabled until the next meeting.
8. Minutes. The commission reviewed the minutes of the meetings held on April 11 and
April 22, 2019. Richard Wilson made a motion to approve the minutes. Second by John
Cutrer. AYES: Richard Wilson, John Cutrer, Pete Johnston and Mimi Tsai. NOES:
None. Motion carried.

John Cutrer made a motion to adjourn. Second by Richard Wilson. Motion carried. Meeting
adjourned at 7:47 p.m.
