(This property was previously platted as all of Lot 13, Block 2 of Sunset Terrace Section 5 and all of Lot 13, Block 1 of Sunset Terrace Section 6. The two properties were joined through an amending plat to create a single"through"building site.) Applicant: Robert and Kristin Gauntt Decision or Action Requested: The applicant 1) requests a Special Exception to Section 12-105 of the Zoning Ordinance (codified as Appendix A of the Code of Ordinances, City of West University Place), to authorize the reinstatement and indefinite extension of Prior Non-Conforming status for a fence like hedge located in the front yard (setback). 2) If necessary, request a variance to Table 7-6, Note 8.2 of Appendix A of the Code of Ordinances to locate a fence like hedge in the front yard(setback). Notice,Hearing, Findings, Vote: (X) Notice of hearing was given by: regular and certified mail (to nearby property owners) and by posting on-site in accordance with Article 11 of the Zoning Ordinance, by Debbie Scarcella, City of West University Place,Texas. (X) Hearing was held on: October 22, 2015. (X) Motion to deny special exception request, the vote was 5 for; 0 opposed. Motion to deny variance request, the vote was 5 for; 0 opposed. Both motions were denied. Any appeals of this decision are subject to and governed by applicable ordinances and laws, including: the Zoning Ordinance and Chapter 211,Tex.Local Government Code. Under Chapter 211,petitions for judicial review must be presented within 10 days after the date this decision is filed in the Board's office. The rules of the Board allow re-hearings in certain circumstances. As additional administrative remedies: (1)the permittee/applicant may be able to apply for a different interpretation,variance,or special exception,and(2)any person may request that the City consider an amendment to the Zoning Ordinance;see Article 11,which indicates that such requests should be submitted to the Zoning&Planning Commission.
