Applicant's Request
The applicant of Docket 2018-002,5608 and 5610 Community requests a variance to Table 5-lof
Section 5-100 of the zoning regulations for minimum building site dimensions.
Background
The property located at 5608 and 5610 Community Dr.is located in an SF-3 zoning district and consists
of Lots 21,22 and 23 of Block 1,College Court Place subdivision. In 1947 building permits were obtained and
structures built on Lot 21 and'A of Lot 22 and 1/2 of Lot 22 and Lot 23. The structures remain on the property
today. The original platted lots were 50'x 116'. When the structures were built,two building sites were created
from the three platted lots with a width of 75'. The applicant would like to divide and combine the two building
sites to make three new building sites and build three new single-family dwellings on the building sites.
Staff Response
The city recompiled the zoning regulations and adopted new minimum building site dimensions for the
SF-3 zoning district in 1987. In an effort to help control density issues,the new minimum building site
dimensions were prescribed as 75'x 110'with each site containing at least 8,250 square feet. The current
building sites meet this regulation. The applicant is asking to divide the two building sites and create three new
building sites of 50'x 116',containing 5800 square feet. When the initial developer built the house on one and
one-half lots,new building sites were created that differ from the subdivision plat. To divide them now would
again create"new"building sites and these new building sites must meet the minimum dimensions for width
and square footage.
Table 5-1 of Section 5-100 of the zoning regulations establishes the minimum dimensions for a building
site. For new building sites,in addition to the minimum dimensions,there is a note to the table,Note 3,which is
applicable. The division of these properties to create new building sites does not fall into one of the three criteria
listed.
Staff believes that the ZBA has the authority to grant this variance,but according to Section 11- 102 of
the zoning regulations,the ZBA may not issue a variance unless all of the following circumstances are present:
(1)The ZBA has made all findings and determinations required by state law for the granting
of a variance. A"special condition" or"hardship" that is self-created,personal or based only
on financial reasons is not sufficient to support the issuance of a variance.
(2)The ZBA has made any additional findings and determinations required by a specific
provision of this section which relates to the variance.

(3)The variance has been reduced to writing and includes any conditions prescribed by the
ZBA or required by this section for the variance in question.
The findings to grant a favorable result for this application are as follows:
1. The ZBA must find that a literal enforcement of the ordinance would result in an
unnecessary hardship.
2. By granting the variance would the spirit of the ordinance be observed and substantial
justice done?
3. Would the variance be contrary to the public interest?

ARTICLE 5. - BUILDING SITES
Section 5-100. - Requirement for building site.
(a) Basic Criteria . Every structure must be located upon a building site meeting all of the following
criteria:
(1) The entire site must be contiguous and under common fee-simple ownership.
(2) The site must consist of one or more whole subdivided lots, excluding only: (i) common use
areas and (ii) areas lost because of public acquisition, adverse possession, discrepancies in
boundaries or similar cause.
(3) Common-use areas are excluded.
(4) The site may not include any area within another building site.
(5) The site must have the minimum dimensions prescribed by Table 5-1 and this Article.
Exception: If, after the 1987 effective date, the Z&PC approves a plan, plat or replat establishing
a building site with smaller dimensions, the smaller dimensions do not violate this Ordinance.
Building Sites containing existing lots platted with smaller dimensions shall comply with the
requirements of this section.
(6) The site must have a common boundary with a street area containing a constructed roadway
approved and accepted by the city, or, in a QMDS, with a private street or other platted
accessway.
(b) Certain Exceptions . This section does not apply to: (i) fences, playground equipment or
landscaping structures, or (ii) non-building structures lawfully occupying street areas, easements or
similar areas.
General Rule:This table prescribes the minimum dimensions for building
sites, by District. ("DU" means "dwelling unit.") Exceptions/Special Rules: (1)

Note 1. 4,500 Square Foot Exception . A structure may be located on an old building site with at
least 40 feet of width and at least 4,500 square feet of total area, if the building site: (i)was
improved with a principal building in existence on the 1987 effective date or for any period of
twenty consecutive years prior to the 1987 effective date, under circumstances where there was
no additional land used for the building site, and (ii)was created by subdivision plat and not
made smaller thereafter except to provide public right of way or to accommodate physical
encroachments, or as specifically allowed by Article 5.
Note 2. 4,300 Square Foot Exception. A structure may be located on an old building site with at
least 40 feet of width and at least 4,300 square feet of total area, if the building site: (i)was
created by subdivision plat approved by the city council or the Z&PC, (ii) has not been made
smaller thereafter for any reason.
Note 3. Certain Re-Subdivisions After October 24, 1987. A subdivided lot in a SF-1, SF-3 or GR-
1 District may be further subdivided to produce a building site with less than seventy-five (75)
feet of width or less than one hundred ten (110)feet of depth if all applicable procedures under
state law and the City's ordinances, rules and regulations are followed and one of the following
three sets of circumstances is present: (A)All portions of the subdivided lots are added to
adjoining subdivided lots. (B)The number of lots is not increased, and all resulting lots have: (i)
a depth greater than or equal to the depth of the shallowest lot before the re-subdivision, and (ii)
a width greater than or equal to the width of the narrowest lot before the re-subdivision;

Application to City of West University for Zoning Adjustment
We ( Brookstone Homes, Inc. and RL Legend Equity Company, Inc.) hereby request the board to
authorize in this specific case a variance, from the terms of the zoning ordinance. We feel our
variance request is to the benefit of the public interest. We feel that the variance will relieve
hardship on the other members of the nearby community and the hardship of the owners of
the lots in question. We propose that the variance observes the spirit of the ordinance.
As stated in 211.009, Authority of the board, paragraph b, the board may reverse,the
administrative officials order and we request that.
As stated in 211.009, Authority of the board, paragraph c, we ask the board to grant a variance
from the zoning ordinance.
Below as Section 11-102 Findings;
The conditions required for the variance are met as follows;
1. The ZBA will find that hardship, grants them the authority to grant the variance as far as
specific provision is concerned.
2. The ZBA will find that hardship, grants them the authority to grant the variance as far as state
law is concerned.
3. In this text written conditions are prescribed as required by the ordinance.
The principle reason/ motivation for the board to grant the variance to allow, one home to be
built on each of the 3 lots in the attached surveys ( declare the 3 lots 3 building sites) is to
relieve the hardship suffered by the owner of the 3 lots in the legal description. The hardship
suffered is,that the properties cannot be improved or replaced, due to the fact that the lots
are the largest in the neighborhood, making replacement unfeasible from a monetary
standpoint. Its our feeling that the adjacent properties suffer hardship also, that would be
cured by allowance of the variance.The variance would cause the improvement of the
demeanor and aesthetic of the neighborhood with new homes.
The wording we request follows;

Narration
Here as follows, details of the request for the zoning, we are requesting as submitted by
John Wawrose;
The 3 lots,that are currently 2 building sites under present ordinance, are adjacent to
the railroad tracks that border West University. They are close to, if not, the least desirable lots
in West University. In the portion of College Court Place, that is north of Bissonnet, most, if not
almost all, of the building sites are 50 x 100.
I have built several homes in West University. The first home I built in West University
was in about 1981. There were 3 houses built in all of West University that year. Along the way,
I learned a lot about the quality of life and the quality of the real estate in West University.
At one time, it was thought that homes would not be built on the lots that surround the
perimeter of the city. It is hard to believe this now, but the city was concerned that homes on
Kirby and homes on Bellaire would be abandoned, and that no one would live there. The
response to this, was to zone the perimeter lots for town houses. Town home developments
can now be seen on the edge of the city, acting as a buffer between the single family homes
and the commercial properties and other negative influences outside the city.
It's my view, that the lots bordering the railroad tracks fit this description as less
desirable. There have been at least 2 train wrecks that I have noticed, probably more, where
the railroad cars wound up in the yards of the homes on community. One nearby resident was
murdered by a hobo that was riding the train. We ( Mr. Lai and I ) are not requesting the zoning
be changed to townhouse. We would like to only build 3 homes on the 3 original lots. This
density of homes is consistent with that part of the neighborhood. It is also the lot size
envisioned by the original developer.This density is presently at odds with the "building site"
ordinance. We humbly request relief.
Summary of the situation follows; I am not a resident of the city. I am a mere builder.
don't make the rules. I only try to abide by them. Whether or not 3 homes are built or 2 old
homes remain, is out of my hands. The board will decide what happens over there on
Community Drive. I have been to board meetings in the past, and someone will generally give a
speech and call the builders "greedy". This is going to sound a little arrogant, but my goals here
are a philanthropic. I have built somewhere between 230 and 250 homes in West University,
none were on Community. I don't have to build the 2 homes, or even the 3 homes. If the
approval from the board is denied, it looks like the old houses will stay rented for several more
years. If the approval is granted, 3 new homes would be built in the very near future. It
probably benefits the neighbors to have the new homes. I think it would benefit many residents
of the city if the 3 homes are built. The rest of the facts required for the decision can be left to
the wisdom of the Board.

NOTICE OF ZONING BOARD OF ADJUSTMENT HEARING
The Zoning Board of Adjustment("ZBA")of the City of West University Place,Texas("City")will hold
a public hearing in the Municipal Building, 3800 University Boulevard, City of West University Place,
Texas 77005, during a meeting set to begin at 6:30 p.m. on May 24,2018.The hearing may be recessed
and continued to a ZBA meeting set to begin at 6:30 p.m. on June 28,2018.The purpose of the hearing
is to provide an opportunity for all persons to be heard in relation to the following matter:

Applicant: RL Legend Equity Co, Inc.
Action Requested: Request a Variance to Chapter 5, Table 5-100 for minimum
building site dimensions and square footage for a new
building site.
Additional Details:
The applicant owns two building sites located on Community Drive. Each building site consists of one
and one-half platted lots. The platted lots were developed as two building sites originally and are
recognized as"old"building sites by the zoning regulations. Any new configuration would require that
the platted lots meet the"new"building site minimum dimensions required by Chapter 5. The applicant
would like to redevelop the property and create three new building sites that do not meet the minimum
site dimensions or square footage.
Applicable regulations include the City's Zoning Ordinance,Code of Ordinances, Chapter 211 of the
Texas Local Government Code and the rules of the ZBA. Additional details on such matters, as well as
the applicable regulations are available for public inspection in the Public Works Center,3826
Amherst,West University Place, 77005.Any person interested in such matters should attend the hearing.
