Your company is building a house at 2623 Arbuckle, West University Place, on the lot next to my home at 2625 Arbuckle. On June 12 I noted that the fence placed around an area on your lot to protect the nearby live oak tree in my front yard (at the request of Ms. Nes Tesno, Urban Forester for W.U.P.) had been moved in such a manner as to make me fear damage to my tree. (When inspector Tesno looked at the fence next morning, she told me that she thought that the fence had been moved approximately five feet and that she would call you about it.) Neither you nor any member of your company was anywhere around, but large, mechanized equipment was being employed. I called the W.U.P. inspector's office and inspector Larry Boles came out to see about the situation. In the meantime, you arrived. He, you, and I talked about my concern. Sometime later, at approximately 6:00 p.m., you rang my doorbell and I came out to see what you wanted. I was met by a verbal assault from you. You said that I had cost you fifty dollars, that I was the cause of a citation about your not properly caring for the swimming pool on your property. I did not know what you were talking about. You would not allow any discussion. When I pointed out that you were being very rude, you shouted, "I don't give a shit!" You yelled some other things as well, including , "you keep off my property!" I am a senior citizen and I have lived in West University Place for thirty- six years (thirty-five in the same house). I have never had anyone talk to me as you did. It was not only what you said; it was also your manner of saying it: bellicose, aggressive, and threatening. If a fifty- dollar fine could provoke that much anger and malevolence in you, I can only infer that a really large citation might have motivated actual violence toward me. I am, therefore, reporting your conduct to the W.U.P. police. The next morning I called Inspector Boles and he confirmed that you had been fined, but he said that I had nothin�a to do with it. Someone else complained about the pool a day or two before I have subsequently learned that it was one of the other neighbors, whose name I shall not supply for fear of what you might say or do. You would be advised however to get your facts straight before you make belligerent accusations. I have not discussed anything with Inspector Boles or Inspector Tesno except my concern for my trees and for possible drainage problems resulting from the work you are engaged in. On the corner of this block there was once a splendid oak tree that died because of the building of a new house. My neighbor to my right has had enormous drainage problems as a result of the way a new house was put up next to her property. I have never had any drainage problems, and long-time residents on either side of me will testify that they never had any drainage problems caused by me or my property. You have every right to build on your land, but you do not have the right to damage or destroy my property. This is all that I have been concerned about. I also think you did not have the right to verbally assault me as you did, even if I had reported you.
