November 7th, 2002

1. Call to Order. With a quorum, present James W McDaniel called the meeting to order
at 6:02 p.m. ,

6. Variance Request. Thomas Overstreet is a Builder with Overstreet Inc. Mr. Overstreet
has built several homes in West University Place for several years. He currently has built
a new home at 3224 University Blvd. Mr. Overstreet indicated that he followed all the
rules, regulations and procedures for building application and permitting. He called into
the building department three weeks prior to completing the house. He set up a fire
alarm inspection. Mr. Overstreet failed his inspection due to the house not being
hardwired to the electrical system with a battery backup and being interconnected. Per
Mr. Thomas Overstreet, the house does have a low voltage fire protection system. Mr.
Overstreet thought that this type of system was allowed in West University Place, since it
was a very expensive system. He indicated that it is allowed in Houston and other
neighboring areas. Thomas Overstreet mentioned, in this particular case, that the house
is very expensive and he would have to tear out the ceilings and it would be very costly
and the damage would be substantial. Al Collins, Fire Marshall for The City of West
University Place, spoke regarding the failed fire alarm inspection at 3224 University Blvd.
Al Collins verified that the system does not meet the smoke alarm requirements for new
construction. Per Section R317.1 of the International Residential Code and Section 317.2
Power Source. The house at 3224 University Blvd failed inspection according to the
International Residential Code, smoke alarm requirements. Al Collins mentioned that if
Thomas Overstreet can provide a punch list for the system, that is currently in the home.

Al Collins will see if it meets the NFPA 72 code requirements and will get back with Mr.
Thomas Overstreet and discuss this in more detail. Mr. Overstreet agreed to provide Al
Collins with all the adequate information. James W. McDaniel tabled this discussing until
the December 5th, 2002 meeting. Darryl Friday Motioned to table until the December 5th,
2002 meeting. Les Albins second that motion. AYES: David Kehn, James W. McDaniel,
Les Ablins, Darryl Friday, Muddy McDaniel. NOES: None. ABSTAIN: None. Motion
passed, item tabled.
7. Appeal of a decision by the Chief Building Official. Jennifer Hamlet a resident at
3111 Rice Blvd. Ms Hamlet is appealing the Building Official officials ruling of the 6 foot
fence height from the rear of the existing structure at 3107 Rice Blvd. to the front of side
structure. Jennifer Hamlet is requesting an 8 foot fence between her property at
3111 Rice Blvd and between her neighboring property at 3107 Rice Blvd. She is
requesting this 8 foot fence for privacy, continuity and security purposes. Dennis Mack
did indicate that the West University Place does issue those type of permits but, in this
case, he made a determination that the lack of air and circulation would effect the
property significantly. Stephanie Freedman a resident at 3107 Rice Blvd. for two in a half
years, stated that if her neighbor, Jennifer Hamlet,pt up an 8 foot fence, it would effect
her house tremendously. The location of the fence 1s less than two feet apart from her
house, and may cause future moisture problerias wtkt out significant ventilation and light.

8. Registration of Contractor Quasi-I dicial Hearing. James W. McDaniel swore in all
witnesses. Adam Klibert pa AlOander Klibert party. Ann Blackwood witness. Ann

Dashiell witness. Reid Woir� tnes' Adam Klibert and Alexander Klibert are currently
building a new construction Ni es a1;y 2921 Carnegie St and 3415 Sunset Blvd. Dennis
Mack gave a quick overy 'Skinglto suspend General Contractor registration for 90
days for repetitivetrdiajnc - isolations. Daniel Paripovich proceeded with a lengthy visual
picture presentation show! }g nUmerous ordinance violations. Reid Wilson a resident of 20
years at 3824 Case St. acrd an attorney for the Southampton Homes group, spoke in
behalf of Adam and:Alex der Klibert. Mr. Reid Wilson had nothing to submit in writing at
this time, but did haVev a verbal presentation. Mr. Wilson did indicate, that this is a
wakeup call and they will clean up the job sites or do what ever it takes to comply.
Alexander Klibert spoke about construction site problems and the repeated citations that
had been issued to Southampton Homes. Alexander Klibert apologized to BSC and all
associated parties. He expressed how embarrassed he was to be before the board. Adam
klibert spoke and referenced sites and explained certain pictures that had been
presented. Ann Dashiell who is a real estate agent for Southampton Homes indicated that
Adam and Alexander Klibert offer only quality work, and display a positive attitude when
it comes to building their homes. Several of her customers are pleased with
Southamptons work and their close attention to detail. When it comes to their homes.
Ann Blackwood a resident at 2623 Arbuckle St., which is a Southampton Home. She
expressed, she is extremely happy with Southampton Homes and their excellent work.
Adam Klibert reviewed photos and discussed situations that occurred during construction
and he verified that the violations did, in fact happen. Adam Klibert guaranteed that they
had hired someone to manage and keep their sites clean and then proceeded to
apologize for his behavior. Reid Wilson concluded that there will not be any more failures
to comply. The sites will be cleaned up and they will start as soon as possible. Daniel
Paripovich summarized and closed with his concern for public health and safety issues

that play a major factor in this continuing ticketing of the builders dirty job sites. Daniel
Paripovich would like to see these job sites at 2901 Carnegie and 3415 Sunset Blvd.,
cleaned up and maintained regularly. Hearing closed @ 7:55 p.m. by James W.
McDaniel. Motion by James W. McDaniel, Revoke registration of Southampton Homes for
90 days beginning on December 5th, 2002 or next BSC meeting. If at that time all
outstanding fines have been paid and all past violations have been corrected and no
further violations cited, the BSC will consider rescinding the revocation.

Albins. Motion passed.
9. Drainage/Site Plans. Dennis Mack is working on the final draft of ordinance
amendments for the site plan certification, they will be adding to the basic
documentation. This will be brought back to BSC prior to going to Public hearing.
Neslihan Tesno will do a cost analysis.
10. Foundation Design. James W. McDaniel, table until the December 5th, 2002 meeting.
Dennis Mack to bring back a draft proposal. `'
11. Staff Comments and Status Reports Dennis MacteAnd James L. Dougherty are
currently working on this and should be on city,counci'`agenda soon.
To verify use of a purple PVC primer. V ifye wording/color purple.
12. Commission Member Comments 4D; v ci KeJrn, discussion on fences 6 foot or 8 foot
fences 3 feet away from some one4rpertyline, is not a good idea. On December
agenda, discussion of fences and setae alarms.
