[Call to Order.] With members present Bryant Slimp called the meeting to order at 6:15 p.m.
1. Workshop Committee. Dennis Mack asked the committee, what steps he needed to go through in
order to ban post tension slabs? If post tension slab are banned, the City will have to make sure
that certain procedures are followed and that the City complies with all of the current State Laws.
The City Attorney, Jim Dougherty asked if the City of Bellaire had any references as far as
materials on post tension slabs? Jim Dougherty stated that City Council would prefer to see
material for wanting to ban post tension slabs. Dennis Mack stated that he would get with Joe
Edwards, with Edwards Consulting, and see if he had any reference materials pertaining to failure
rates and analysis. He also mentioned post tension slabs have been banned in the City of Bellaire
for a long time. Jim Dougherty stated he would like for BSC to make sure that they are acting
reasonably and not rationally. There may be trade groups, for example, that would in fact,
challenge the local ordinances. John Ayres asked if the City could run a report of the list of homes
in West University Place that used post tension slabs?Dennis Mack stated there is no way to run a
report of that type. Dennis Mack added that he doesn't think that there had been a lot of post
tension slabs used in the City of West University Place. Dennis Mack stated that if the foundation
requirements change then we should make this across the board for both remodeling and new
construction. John Ayres referring to the Foundation Draft stated that under No.# 3, Section b.)
Based on a soils report from a recognized and reputable firm or agency (Exception: no soils
report is required for a single story accessory building with less than 150 sq. ft. of gross floor

John Ayres stated, reputable firm or agency,needs to be more specific.
Les Albin stated that standards should be set for soils test. The City of West University does not
have current standards for soils tests. Set a minimun pad thickness of 4 foot. Les Albin stated that a
minimum standard should be set on select fill and soil conditions to 18"to 48", depending on the PI
soils. It should be 50" or more, but you should have at least 48". Require testing and have it
certified by the soils lab.
Dennis Mack stated that the city could require an authorized or qualified delegate who would be
directly under the supervision of the engineer or design engineer be a there during the observation
of the entire pour. The city could require the P.E to be on site at all times. Dennis Mack stated the
P.E could personally do it or hire some one to do it.As long as they have first hand knowledge of it.

Dennis Mack stated that a document could be drafted up. He also stated, the city inspectors could
allow a one-hour window for inspections.
Dennis Mack will need to get more information and as much material as possible and make a
checklist in draft form BSC. So,that Dennis Mack can expand on that sentence, under prefix b.
b.) Based on a soils report from a recognized and reputable firm or agency(Exception: no soils
and inspected by an RPE who certifies proper construction, before work proceeds further. At the
completion of all the requirements of the plans and specifications, the engineer of record shall
certify by letter to the city, (which may be made be based on observation reports by a qualified
delegate)the construction of the foundation and structural framing was:
Bryant Slimp stated that a checklist should be generated and the city should require a signature
certifying the list. Bryant Slimp requested draft forms for soils reports and analysis, disclosure of
risks and a certification that the city will provide. Bryant Slimp referenced the material from the
State of Practice of Geotechnical Engineering for Design of Custom Homes in the Houston
Area Between 1990 and 2001 By David A. Eastwood, P.E., Frank Ong, P.E., Presented at
Foundation Performance Association Meeting on June 20,2001.Bryant Slimp asked for BSC to
reference the definitions and the examples of the requirements for drilled footings and soil
variability etc; Bryant also referenced material from Recommended Practice For Geo-Technical
Exploration and Reports By The Structural Committee of The Foundation Performance
Association. Bryant Slimp asked for BSC to look through the handouts and get ideas for examples
of requirements.
Dennis Mack will work with BSC on the draft requirements as soon as possible.
Jim Dougherty stated he would do some legal research on what we can require from the P.E and get
back to BSC. Bryant Slimp stated that foundations would be put back on next month's agenda.

[Call to Order.] With members present Bryant Slimp called the meeting to order at 6:01 p.m.
Workshop Committee. Dennis Mack gave BSC a graph of the comparison of homes built prior to
1992 and for homes built from 1992 to the present. The graft showed the average number of new
homes being built verses remodeling that was taken place in the West University area. Brain
Hoogendam updated BSC on his conversations with Sunny McKinnon, who is with West
University's Historical Society. She provided him with helpful information and gave him a book
about West University's History. Brian Hoogendam asked BSC to define the goals for Old Stock
Housing and to think about what are the objectives. David Flame asked what are we trying to
accomplish? David spoke to Mike Farley briefly and said that Mike Farley indicated that his
objective is to develop a City Policy that promotes, protects, enhances and perpetuates Old Stock
Houses within the City of West University Place.
The issues:
❑ Entry Housing To provide a more diversified and demographic approach.
❑ Diversity Style in construction.
❑ Density Size of houses and the coverage of lots.
Brian Hoogendam asked BSC to refocus and to think about our goals in light of the refined
objective by considering data on the appraised value, the year the house was built or the lot size.
Dennis stated that the cheapest lots in West University Place are selling for between $125-150K.
John Ayres noted that it is very hard to find a house selling for less than $300K in West University.
He stated that he notices young doctors looking for homes in the $350K to $400K-price range. John
Ayres added if there was a way to impact the city taxes placed on Old Stock Houses?Dennis Mack
stated that homeowners who want to remodel need an incentive to keep the house the way it is. One
way would be tax abatement. Brian Hoogendam stated that he had purchased an older home that
was built in 1948. But, he could not consider it an older home because the house had been updated.
Brian Hoogendam again asked BSC to refocus and consider, what is our goal?

Brian Hoogendam asked about other potential areas of relief for owners of old stock houses.
The committee game up with other possible solutions for example,

❑ More leeway for homeowners wishing to remodel older homes.
1. Example, 20 foot set back on back property line (currently applies to primary structures,
not garages. Houses can currently go up, but not back.
2. Windows-Old houses may have old windows and might not pass the current energy
compliance requirements. Can the City give some exception to this?
Bryant Slimp stated that the committee is coming up with a lot of great ideas and the next step
is for the committee to:
❑ Agree on goals and objectives.
❑ Agree on the criteria.
❑ Decide on recommendations that the committee will be making to City Council.
David Flame will contact Michael Saegert at the Harris County Appraisal District to discuss the
concept about the possible freeze of appraisals on Old Stock Houses. David will ask that if the
intent is to preserve older homes, what might Harris County have to add to the preservation of
Old Stock Housing?

[Call to Order.] With a quorum,present Bryant Slimp called the meeting to order at 6:04 p.m.
1. Notices, Rules, Etc. Bryant Slimp stated that the BSC voting alternate would be Brian
Hoogendam.
2. Meeting Minutes. Dr. Peter Benjamin made a motion first to approve meeting minutes from the
February 5, 2004 BSC meeting. Brian Hoogendam seconds the motion. AYES: Bryant Slimp,
David Flame, John Ayres, Dr. Peter Benjamin, J. Denis Powers and Brian Hoogendam. NOES:
None. ABSTAIN: Motion passed. Minutes Approved.
3. City Council Goals. Bryant Slimp updated BSC on the status of the City Council goals and
wanted to invite everyone to attend the City Council workshop that would be on March 29, 2004 at
5:30 in the City Council chambers. City Council will be going over goals for all of the boards and
commissions goals.
a.) Retention of Old Stock Housing. Bryant Slimp stated that a workshop on Old Stock
Housing (OSH)was held on March 2, 2004 and that the workshop participants discussed
potential areas of relief for owners of OSH. The workshop with significant input from
Brian Hoogendam started developing a preliminary draft on old stock housing definitions
incorporating elements of age, size (footprint) and other demographics. The BSC will
continue to discuss OSH and Bryant Slimp stated that BSC would be holding at least one
more workshop before the BSC can address City Council. The BSC has been talking to
Mike Farley to address and clarify this goal. Bryant Slimp stated that City staff would let
everyone the date and details for the next OSH workshop meeting.
b.) Review of Building Codes and their Uniformity with the International Codes. Dennis
Mack has been reviewing all of the Building Codes and making sure that all of the codes
have been examined and are in line with the International Codes. Dennis Mack passed
out a handout on all the codes that are to adopted. He is working with councilman Mike
Woods and making some refinements to complete this City Council goal.
c.) Review of Building Materials (e.g. foundations, framing and rot resistant materials). The
BSC held a workshop on foundations on February 10, 2004. Bryant Slimp stated that the
workshop committee has been working with Dennis Mack and Jim Dougherty on a draft
of a new foundation ordinance. The BSC goal is to strengthen the codes and the
procedure requirements regarding foundations. The committee is continuing to study the
necessary elements that make a quality soils reports and to study useful foundation
construction checklists. Bryant Slimp stated that another workshop will be scheduled.
City staff will get with the commission on the next workshop date.

Matters Relating to the Building Standard Commission Recommendations and Status
4. Report.
a.) Update on the Fence Ordinance returned from City Council. City Council returned the
fence ordinance to the BSC but Mike Farley indicated that maybe Council should look at
masonry fences, and that the ZPC will also get involved especially in the area of set back
issues. Bryant Slimp indicated that a workshop would be set up in the future to discuss
the fence ordinance.
b.) Administrative guideline on the use of double 2x4's as framing studs. Dennis Mack
generated a formal interpretation dated March 4, 2004, effective January 14, 2004.
Interpretation, Decision or Action Requested: Two 2x4's can be nailed together as an
alternate to using a 3x4 or a 2x6 as required by Table RR602.3 (5) Minimum Stud
Spacing.
c.) Status and distribution of copies of the complaint on structural engineering at 3840
Ruskin (Rosa Kym's home) with the state licensing board. Dennis Mack filed a formal
complaint with the state board on February 9, 2004 and stated that he has not heard from
the State regarding this case. He stated that this complaint investigation will take a while.
d.) Update on the status of repairs at 4029 Case. Dennis Mack stated that Daniel Paripovich
did finally here from the owner on of this house February 5, 2004. The owner indicated
that he would be complete demolition of this house by March 31, 2004.
5. Foundations. Bryant Slimp updated BSC on the work of the foundation workshop that was on
February 10, 2004. He indicated that Jim Dougherty, the City Attorney, along with the workshop
committee made a change to the Appendix A, Standard Code Schedule. He asked BSC to refer to
the handouts:

Bryant Slimp stated that West University Place needs a better quality soils reports, foundation
inspection reports, and. He stated that another workshop would need to be scheduled in March in
order to read and look over all of the materials and data. No motion made.
6. Old Stock Housing. Mike Farley talked with BSC and stated that his objective for Old Stock
Housing (OSH) is to develop a City Policy that promotes, protects, enhances and perpetuates Old
Stock Houses within the City of West University Place. Over the years, West University Place has
established an image within the area that is depicted by tree-lined streets, bungalow style houses on
small to medium lots and a high quality of life. He stated that he would like to propose regulations
that consider: 1) the continuance of Old Stock Housing that represents historical elements of this
image, 2) Fosters civic pride in the look of the past, 3) protects and enhances West University
Place's attractiveness as a place to live, and 4) maintains and improves property values. Mike
Farley stated that we should continue to encourage the old pier and beam, cottage appearance,
bungalow style of homes. We should also consider the demographics as well as the architectural
stability of the style of houses. Mike Farley continued to add that West University Place is loosing
the charm of what made West University, West University. Bryant Slimp said that BSC would
continue to study and define Old Stock Housing. He thanked Mike Farley for his insight and stated
that with Mike's comments that the OSH issue is coming into focus. Bryant discussed the three
criteria that the OSH workshop had generated.

Old Stock Housing Defined: The committee came up with several criteria regarding how a house
is defined as "old stock". The following table outlines these and the rationale behind why these
figures were chosen.

Brian Hoogendam stated that we should give more leeway in granting variances, for example on
the set back issues, and to offer some types of tax incentives.Dennis Mack stated that he would
get with the City Attorney to discuss if there was any leeway on any state mandated codes. David
Flame will contact Michael Seagert with the Harris County Appraisal District(HCAD)about
freezing the appraisals on improvements if the intent is the preservation of older homes. He will
also ask HCAD about information on the Homestead Exemptions.Ron Wicker,the Public Works
Director, stated that he obtained all of his information from the Internet and the information packet
on Local Incentives for Historical Preservation Volume 17,No. 7 Supplement by Constance E.
Beaumont. The material presented had a lot of historical significance. It also had a lot of
information on the economical development of historical preservation along with tax incentives
and what other communities and local government agencies are doing. Bryant S limp asked the
BSC to review the definitions in the Local Incentives for Historical Preservation,under the Davis
Municipal Code, Chapter 40 Zoning, 40.23.030 Definitions. Bryant Slimp stated that there would
be another Old Stock Housing workshop and staff would check the conference room schedules, set
a date and inform the BSC of a workshop. No motion made.
7. Roofing Materials. Dennis Mack stated that the wood shingles should be listed as a Class A at a
minimum due to the fire and safety issues. Dennis Mack stated that the Standard Code Schedule
should be amended. Dennis Mack will read over the roof classifications and provide BSC with a
report. Bryant Slimp stated that BSC will look over the handout from the International Code
Schedule on roofing materials and that this would be placed back on next month's agenda. No
motion made.
8. Sign Ordinances. Dennis Mack stated that Jim Dougherty drafted the information on the proposed
amendments to address the new state laws affecting signs. The first one incorporates the state law
on removal of signs and sets 13-month and 25-month deadlines for removal.
❑ Sec.3.211.Removal of certain signs.
The second one sets up a broad administrative procedure to handle claims that a state or federal law
preempts the Code of Ordinances. It is similar to the existing Section 8-112 of the Zoning
Ordinance. It could also be used by someone claiming that the new state law on political signs
preempts Chapter 3. Someone claiming that ADA requires the City to make an accommodation
also uses it.
❑ Sec.1.301.Purposes.
Dennis Mack stated that basically if a state law or federal law said, yes that a person or persons can
place signs in certain areas and our current ordinances states, no that they can not place signs in

certain areas then these people can go to the Chief Building Official or the City Manager and these
officials can allow the placement of signs. He also stated that state law has unlimited numbers of
signs placed on a property, where as West University City Ordinances limit the number to only
three signs. State law has unregulated content and West University has content regulated. Darryl
Friday felt that there needed to be more discussion on this and asked if Jim Dougherty could speak
to BSC on this issue so that the BSC could understand more on the State law and its requirements.
Bryant Slimp stated that this item would be put on next month's agenda, and that the BSC would
invite Jim Dougherty to address the BSC.No motion made.
9. First Floor Elevations verses Survey Benchmarks. Dennis Mack stated that the benchmarks had
been set in several locations in West University Place. They are vertical and horizontal markers.
The surveyors would be able to mark off of the markers and it will help in the surveying. J. Denis
Powers showed BSC a colored coded flood map indicating the elevations of areas in West
University, and thus flood related areas. He stated that if a person had reported a flood problem to
FEMA then it showed up on the map. He continued to state that the official FEMA maps would be
distributed on Monday,March 8,2004.

[Call to Order.] With members present Bryant Slimp called the meeting to order at 6:05 p.m.
1.) Foundations. Bryant Slimp recommended that the committee look at the handouts that had
been given previously. He mentioned that the handouts are articles that contain a wealth
of information and include several studies that had been done on soils testing, etc. These
handouts included:
❑ City of West University Place Residential Engineering Requirements,
❑ Recommended Practice For Geotechnical Explorations and Reports,
❑ Quality Control Checklists For Foundation Inspection Of Residential And Other
Low-Rise Buildings,
❑ Development Of Design And Remedial Measures For Lightly-Loaded Structures
Founded On Expansive Soils With Trees In Mind, and
❑ State Of Practice Of Geotechnical Engineering For Design Of Custom Homes In
The Houston Area Between 1990 And 2001 (Foundation Performance Association
Meeting On June 20th, 2001).
Bryant Slimp asked for the workshop committee to review the draft of Appendix A of the
Standard Code Schedule. He wanted Jim Dougherty to review this with the committee so
that Jim can help in the draft of the foundation requirements. The latest draft of the
changes are as followed:
International Building Code, 200 Ed., International Code Council, Inc.,
3. All foundation and structural framing for new buildings and foundation ropairs
with a gross floor area of 4-54 400sq. ft. or more must meet the following criteria:
shall be designed by a registered professional engineer("RPE") and work shall be:
a. They must be constructed in accordance with illustrated in complete plans and
specifications prepared, signed and sealed by the RPE a licensed professional
engineer ("LPE"). The plans and specifications must be prepared specifically
for the site of the work, and they must meet criteria as to scope, content and
form specified by the building official.
b. The plans and specifications for each foundation must be based on a written
soils report from a recognized and reputable firm or agency meeting criteria
as to authorship, scope, content and form specified by the building official.
The building official may adopt criteria published by the Structural

Committee of the Foundation Performance Association, Houston, Texas.

c. Foundations must be one of the following types: (i) pier and beam, (ii) voided
slab, or (iii) slab on grade with at least 48 inches of compacted select fill
beneath it(Exception: If the soils report indicates a plasticity index less than .O
20, and if the report specifically recommends a smaller thickness of select fill,
the smaller thickness is allowed, but there may never be less than 24 48 inches
of compacted select fill beneath a slab on grade). The BSC may issue a special
exception for another type of foundation, but only upon a showing of
engineering data and opinion to demonstrate that the other type will be as
stable, strong and enduring as the specified types.
d. Each foundation and all structural framing must be must be professionally
observed inspected and must be certified by an RPE LPE,
construction, before work proceeds further. Observations must: (i) be
performed either by the certifying LPE or by a person under the direct LPE's
supervision and control whose professional qualifications are approved by the
LPE, (ii) include actual measurements of piers, fill, compaction,
reinforcement, forms, materials, dimensions, structural elements, stressing,
tendons attachments, etc. before the work is covered or concrete is placed, and
(iii) be documented in a form and manner approved by the building official.
Certifications must: (1) refer to and be based upon the professional
observations required by this section, (2) state that the work complies with the
approved plans and specifications (with any field modifications approved by
both the LPE and the building official) and complies with the sound
engineering practices, (3) comply with guidelines as to form and content as
may be specified by the building official, and (4) be signed and sealed by an
LPE.
4. All concrete piers, footings and foundations must be cured for at least 72
hours before any significant load is placed on them.
5. All walls and ceiling within a R-1, R-2, R-3 and R-4 type occupancy shall be
sheathed with Type X gypsum board at least 5/8-inch (15.9 mm) thick.
Exception: Where this code(IBC) requires otherwise for moisture protection.
❑ Jim Dougherty and Dennis Mack will provide more documentation on the
field modifications.
❑ Add two more categories
1. Certifications
2. Observations
❑ Jim Dougherty and Dennis Mack will refer to the sample QC checklists and
come up with an appropriate document.
Bryant Slimp asked the committee if someone would like to volunteer to make up a

stated that he would come up with a checklist.
2.) Old Stock Housing. Brian Hoogendam asked the committee again if the intent was to
preserve the value. Does the City wants to generate more revenue? Does it mean that the
big houses mean more money? Where do we want to take this? Is there anything else
that we as a committee that we have over looked?
1. Windows-Not that much flexibility.
2. Additions for remodeling-Will have to meet the current codes
3. Old homes can't be moved from one location to another.

Dennis Mack added that he is trying to generate a map defining the age of the homes in
West University Place by section. On the map he will add the dates of each subdivision.
The map would start from the year 1960 with homes from less than 2 thousand square
feet. Brian Hoogendam stated that he would like to talk to City Council on a one-on-one
basis to find out there view on Old Stock Housing and what direction they would like to
go in. Do they want to tear down older homes or to remodel and improve?
