AN ORDINANCE RELATING TO BOARDS, COMMISSIONS AND
COMMITTEES; AMENDING THE CODE OF ORDINANCES OF THE
CITY OF WEST UNIVERSITY PLACE, TEXAS; AND CONTAINING
FINDINGS AND PROVISIONS RELATING TO THE SUBJECT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE:
Section 1. Sections 2.011, 2.012 and 16.201 of the Code of Ordinances of the
City of West University Place are hereby amended, and a new Section 16.202 is added
to such Code of Ordinances, all as shown in Appendix A, which is attached to this
ordinance and made part hereof for all purposes.
Section 2. All ordinances and parts of ordinances in conflict herewith are hereby
repealed to the extent of the conflict only.
Section 3. If any word, phrase, clause, sentence, paragraph, section or other
part of this ordinance or the application thereof to any person or circumstance, shall
ever be held to be invalid or unconstitutional by any court of competent jurisdiction,
neither the remainder of this ordinance, nor the application of such word, phrase,
clause, sentence, paragraph, section or other part of this ordinance to any other
persons or circumstances, shall be affected thereby.
Section 4. The City Council officially finds, determines and declares that a
sufficient written notice of the date, hour, place and subject of each meeting at which
this ordinance was discussed, considered or acted upon was given in the manner
required by the Texas Open Meetings Act, as amended, and that each such meeting
has been open to the public as required by law at all times during such discussion,
consideration and action. The City Council ratifies, approves and confirms such notices
and the contents and posting thereof. The City Council officially finds, determines and
declares that sufficient notices of the joint public hearing were given, and the City
Council ratifies, approves and confirms such notices, including the contents and the
method in which they were given.
Section 5. This ordinance shall become effective immediately upon final
approval and signature.

Amend
Sections 2.011 and 2.012
as follows:
Sec.2.011 Boards, commissions & committees.
(a)Permanent Bodies; Liaisons. Permanent boards, commissions and committees are as follows:
(1) Building& Standards Commission. See Chapter 6 of this Code and Chapter 54
of the Texas Local Government Code for the composition and duties of this

staff liaison is the Building Official, or such other person as the City Manager
may designate.
(2) Zoning&Planning Commission. See the Charter and the Zoning Ordinance for

Planner, or such other person as the City Manager may designate.
(3) Zoning Board of Adjustment. See the Charter and the Zoning Ordinance for the

(4) Parks &Recreation Board. 9 positions(numbered 1 through 9), with position 1

corporation. The staff liaison for both the Board and the Fund is the Parks &
Recreation Director, or such other person as the City Manager may designate.
(5) Senior Services Board: 15 positions (numbered 1 through 15),with all positions
and the presiding officer appointed by the City Council. The senior services
board is responsible for: (i)studying the needs of senior citizens, (ii) assisting
with service studies and plan development and (iii)making recommendations to
the City Council on senior citizen programs. The staff liaison is the Parks &
Recreation staff member who has principal responsibility for senior citizen
programs, or such other person as the City Manager may designate.
(6) Recycling and Solid Waste Reduction Board: 9 positions (numbered 1 through
9),with all positions . -: - . - . - appointed by the City Council.
The recycling and solid waste reduction board is responsible for: (i) studies and
recommendations on recycling and solid waste and (ii) community education on
matters relating to recycling and solid waste. The staff liaison is the Public
Works Director, or such other person as the City Manager may designate.

(b) Other Bodies. Other committees, commissions or task forces may be created or appointed
from time to time, including the Charter Review Committee contemplated by the Charter.
(c)Notices of Meetings;Agendas. All boards, commissions, committees and task forces are
requested to post the date, time and place of their meetings. State law may impose additional
requirements (e.g., open meetings law postings for zoning bodies and the Building& Standards
Commission). The staff liaison is responsible for preparing the notice and agenda for each meeting and
ma •lace sub•ects on the a.enda. The staff liaison must .lace a sub•ect on the a_enda if the sub'ect is
requested by the presiding officer or by two or more regular members. Requests by members must be in
writin. and delivered to the staff liaison b 5:00 PM on the sixth da •recedin.the meetin•.
(d)Liaisons, Attorney, Engineer. Designated staff liaisons are authorized to provide support and
assistance for each board, commission or committee, including expenditures budgeted for that purpose. If
any project requires an unusual amount of staff time or money, it should be approved by the City
Manager or the City Council. Only the Mayor, the City Manager or the City Council may authorize the
City Attorney or any outside consultant to provide services for a board, committee, commission or task
force.
Sec.2.012. Organizational provisions, certain bodies.
(a)Application. This section applies to the permanent boards, commissions or committees listed
in this Chapter, except to the extent otherwise specified in state law,the City Charter or another ordinance
(e.g., specific provisions relating to zoning bodies). It also applies to other committees, commissions, and
task forces, unless otherwise prescribed by the City Council or the City Charter.
(b)Positions, Qualifications. Each appointee, at the time of appointment, must be a resident of
the City. A member who ceases to be a resident of the City shall be deemed to have resigned and may be
replaced at any time thereafter, but shall continue to serve until a successor is appointed and qualified.
Sec, also, "Term limits,"below.
(c)Numbered Positions; Terms. Each position shall have successive terms of office, with each
term beginning on September 1 of each odd-numbered calendar year and extending through August 31 of
the next following odd-numbered calendar year. Each member shall be appointed to a specific term, or
the unexpired portion thereof, of a specific numbered position. A member shall also serve after the
expiration of a term of office until a successor is selected and qualified.
(d)Appointments, Vacancies. Appointments for upcoming terms may be made no sooner than 60
days prior to the beginning of the term. In the event of death, resignation, removal from office or any
other vacancy, a successor shall be appointed to serve the remaining unexpired portion of the specific
term of office of the vacant position. Scc, also, "Term limits," below.
(e)Removal. The City Council may remove a member after providing notice and an opportunity
for a hearing to the member(but see, e.g., state law and the zoning_ordinance regarding the BSC,the
Z&PC and the ZBA).
(f) Officers. The City Council may shall, from time to time, designate officers (see, also, the

no designated. If an officer cannot serve for any reason, a board, commission or committee may select an
acting officer. Every officer, however selected,may be replaced at any time.
(g)No compensation. Members and officers shall receive no compensation for their services.
This shall not prohibit reimbursement for actual and reasonable expenses incurred by authority of the City
Manager or the City Council.
(h) Quorum. A quorum is half a majority of the members appointed and holding non-vacant
positions, but never fewer than three(but see Chapter 211 of the Local Government Code and the zoning
ordinance regarding the ZBA).

Amend Section 16.201
and add a new Section 16.202
as follows:
Subchapter B. Parks & Recreation Board
Sec. 16.201. Created; duties.
There is hereby created the parks and recreation board, or "PRB." It shall be organized and
governed as provided in Chapter 2 of this Code. In addition to its duties under Chapter 2,the PRB shall:
(1) Advise the Parks & Recreation Director or such other person as theCity Manager
may designate ("P&R Director") and the City Council and the City Manager on
matters relating to parks and public recreation.
(2) Make studies and investigations of park facilities as approved and directed by the
P&R Director or the City Council and recommend to the City Council plans for
the improvement of such facilities to the P&R Director and the City Council.
(3) Make studies and investigations of the public recreation program of the City as
approved and directed by the P&R Director or the City Council and make•- - • -• - - - -- -. • . . - recommend plans
for improvements of such programs to the P&R Director and the City Council.
(4) In the performance of its duties set forth in paragraphs(2) and (3) of this section,
the PRB, with the approval of the P&R Director, may: (i) appoint a committee of
its members and (ii)recommend that the City Council appoint a task force
including both members and non-members. A recommendation to appoint a task
force may include recommended appointees.
(5) Perform such other duties with reference to parks and a recreation program, not
inconsistent with this section, as the P&R Director or the City Council may, from
time to time, require.
Sec. 16.202.Relationship to FWUPF.
The PRB shall coordinate its activities with the fundraising activities of the Friends of West
University Parks Fund, a non-profit corporation ("FWUPF"). As provided in the articles of incorporation
and bylaws of FWUPF (copies of which are on file with the City Secretary), one member of the FWUPF
Board of Directors is a member of the PRB. As provided in Chapter 2 of this Code, one member of the
PRB is selected by the Board of Directors of the FWUPF from among its members.
