Background Information The property located at 6419 Vanderbilt is located in a Single Family(Detached)-1 (SF-1)zoning district and consists of two separately platted lots that were combined prior to 1994 to create a single building site. The property owner would like to divide the building site along its original platted boundary lines making two separate building sites of 50' widths. This is less than the required width of 75' for newly created building sites. Staff Comments: The zoning regulations have established two separate criteria for building site size in an SF-1 zoning district. Those established prior to October 1987 must be 50' wide and 100' deep and contain 5000 square feet. Those created after October 1987 must be 75' wide and 110 `deep and contain 8250 square feet. The building sites at 6419 Vanderbilt were originally platted in the twenties,and combined with one structure located on them,creating one building site. Now that the property owner is looking to divide the properties and make two new building sites,the minimum building site dimension for width cannot be met. Article 5, Section 5-100 requires that all structures be located upon a building site meeting the following criteria: (a)Basic Criteria. Every structure must be located upon a building site meeting all of the following criteria: (1)The entire site must be contiguous and under common fee-simple ownership. (2)The site must consist of one or more whole subdivided lots, excluding only: (i) common use areas and(ii) areas lost because of public acquisition, adverse possession, discrepancies in boundaries or similar cause. (3)Common-use areas are excluded. (4)The site may not include any area within another building site. (5)The site must have the minimum dimensions prescribed by Table 5-1 and this Article. 6419 Vanderbilt July10,2017 Exception: If, after the 1987 effective date, the Z&PC approves a plan,plat or replat establishing a building site with smaller dimensions, the smaller dimensions do not violate this Ordinance. Building Sites containing lots platted with smaller dimensions shall comply with the requirements of this section. (6)The site must have a common boundary with a street area containing a constructed roadway approved and accepted by the city, or, in a QMDS, with a private street or other platted accessway. The sites will not meet the minimum dimensions prescribed in Table 5-1 for a new building site. The exception above allows the Zoning and Planning Commission to approve a plan,plat or replat establishing a building site with smaller dimensions. Since the property has already been platted and there is nothing to replat since the boundary lines are staying the same, the applicant is asking for the Zoning and Planning Commission to approve the plan to divide the property. To divide building sites, the zoning regulations state that: Section 5-102. - Division of building sites. (a)Criteria For Division. Two or more subdivided lots, which are designated as a single building site, may be divided into separate building sites if all of the following criteria are met: e. , unless the condition relates to buildings or structures which would not have been in violation of the City's ordinances in effect at the time they were constructed, assuming that the same division of the two subdivided lots occurred at that time. Staff believes the Zoning and Planning Commission is granted limited authority to approve the division with smaller dimensions as cited in Section 5-100 of the zoning regulations. There are no specific criteria listed for the approval or disapproval of this request. 6419 Vanderbilt July 10,2017 15 June 2017 City of West University Place City Planning Division To Whom It May Concern: This letter is regarding the property at 6419 Vanderbilt Street, Houston, TX 77005: Trs 9A& 10A BLK 13, West University Place Sec 1, 4592 AC. We purchased this property in 1994. As the attached survey shows, at the time of purchase, there was a small house that straddled above referenced 2 lots (Lots 9a and 10a.) We had hoped to build two separate houses, one on each lot, at that time. However, the City would not permit it stating that the deadline had passed for formally dividing and recognizing the lot as two separate lots. The recent Ordinance#2030, exhibit A (February 16, 2017) clarifies that building sites that were combined and have not changed boundary lines can divide and become two separate building sites with approval of the ZPC." Our property does meet the ordinance requirements and we would like to divide our lot. Please let us know what the next step is toward this end. (42 I • V) 0.) 0 e • 12 July 2017 City of West University Place City Planning Division To Whom It May Concern: Thank you for your email reg. our request for dividing the building site located at 6419 Vanderbilt Street. Subsequent to receiving your email, we found the following anecdotal history of the referenced site, which the City could verify from its records. • According to the Seller, his grandfather bought one (1) lot [South lot] measuring 50x200 ft. around 1927 & built a house on it. • Then around 1947,the other 50x200 ft. lot [North lot] was purchased &a living room extension was built. • Then between 1989 & 1990,two (2) separate sewer lines were put in. The City, per the Seller, initially objected to the two separate lines, but, after the Seller insisted that the lots are two different building sites,the City conceded his right to do so, thus establishing that they are indeed two separate &distinct lots. This updated history, in which the City played a role, establishes that this site was established prior to October 1987. Consequently, the criteria would be that each lot should measure 50' wide by 100' deep. Since our property satisfies that criterion, we request approval of a building site division from one 100'x 200' building site to two 50'x200' building sites. Thank you, Vasantha Balakrishnan J P.V.
