CONSIDER AMENDING THE ZONING ORDINANCE NO. lll�O' THE CITY OF WEST UNIVERSITY PLACE, TEXAS, SO AS TO PERMIT AN EXCEPTION TO THE SIDE LOT SET -BACK LINE PROVISIONS OF SECTION 24 OF ORDINANCE NO. 111 BY THE WEST UNIVERSITY PLACE METHODIST CHURCH IN ITS CONSTRUCTION OF A SANCTUARY ON LOTS 6 AND 7, BLOCK 25 WEST UNIVERSITY PLACE FIRST ADDITION; FINDING THAT A PUBLIC HEARING FOR THE PURPOSE OF CONSIDERING SUCH AMENDMENT HAS BEEN DULY AND LEGALLY HELD; APPROVING AND ADOPTING ,OF .THE REPORT AND RECOMMENDATION OF THE ZONING AND PLANNING BOARD THAT ORDINANCE NO. 111 BE AMENDED SO AS TO PERMIT THE;, EXCEPTION TO THE SIDE LOT SET- - BACK LINE PROVISIONS OF ORDINANNCE NO. 111 IN SO FAR AS THEY APPERTAIN AND APPLY TO LOTS 6 AND 7,.BLOCK 25, WEST UNIVERSITY PLACE FIRST ADDITION; FINDING THAT ORDINANCE NO. 111 SHOULD BE AMENDED SO AS TO PERMIT THE CONSTRUCTION OF A SANCTUARY BY THE-WEST UNIVERSITY PLACE METHODIST CHURCH WITH SIDE LOT SET -BACK LINE OF 13 FEET FROM, THE EAST PROPERTY. LINE OF SUCH LOTS ABUTTING MERCER STREET AND ALLOW- ING AN EXCEPTION TO THE SIDE LOT SET -BACK LINE PROVISIONS OF ORDINANCE NO. 111; AMENDING SECTION 24 CF ORDINANCE•N @.111 OF THE CITY OF WEST UNIVERSITY PLACE BY ADDING A SUB PARA GRAPH. TO SECTION 24 TO BE KNOWN AS SUB PARAGRAPH (7); AND PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT AND.BE IN FORCE IMMEDIATELY FROM AND AFTER ITS PASSAGE AND APPROVAL. WHEREAS, West University Place Methodist Church has heretofore made written application to the Zoning and Planning Board of the City of_ , West University Place, Texas f or.an exception to Section 24 of Ordinance No. 111 so as to permit said church to construct a sanctuary on Lots 6 & T, Block -25,. West University Place First Addition with a side lot set -back of only 13 feet from the East line of said lots; and WHEREAS, at a regular meeting of the Zoning and Planning Board it was determined that such exception to the applicable provisions of Ordi- nance No. 111 should be granted and said Zoning and Planning Board did recommend to the City.Commission that an amendment to Zoning Ordinance No. 111 be adopted so as to permit the building of said sanctuary on Lots 6 & 7, Block 25, 'Nest University Place First .Addition with a side lot set- back,of 13 feet;-and WHEREAS, at-a regular meeting of.the City Commission held on -, the 26th day of February, 1951, it was determined that a public hearing should be held to consider whether Ordinance No. 111 should be amended so as to permit the construction of such sanctuaryby. the West University Methodist Church with a side lot set -back. of 13 feet from the East Property line of such lots, and WHEREAS, the City Commission at a regular meeting on February 26, ^ -. 9 -. 1951 did instruct the City Secretary to advertise in the official publication of the City and to give written notice to all property owners whose property lies within 200 feet of the Lots 6'& 7, Block 25, West University Place First Addition of a public hearing to be held on March 16, 1951 at .7,00 o'clock p.m. in the City Hall in the City of West University Place, Texas to determine whether or not Ordinance No. 111 should be amended so as to permit the con- struction of the proposed'sanctuary on such lots with side lot set back of only 13 feet; and 'WHEREAS in pursuance to the direction given him by the City Commission -and in full compliance with the Charter and Ordinances of the City the City Secretary of West University Place did cause to be published in the Southwestern Times on March 1, 1951, and did mail to each of the owners of property lying within 200 feet of Lots 6 & 7, Block 25, West University Place First Addition a notice of a hearing to be held by the City Commission in the City Hall at 7:00 o'clock p.m. on Friday, March 16, 1951 to consider amending Ordinance No. 111 as recommended by the Zoning and Planning Board so as to permit the construction of a sanctuary upon such lots and in such location thereon as .proposed by the West Universrity Methodist Church, and WHEREAS`, pursuant to such notice a public hearing was held by the City Commission of'the City of Nest University Place in the City Hall at 7:00 o'clock p.m. Friday, March 16, 1951 at which hearing all testimony and evidence was heard and fully considered by the City Commission as to the advisability and propriety of amending Ordinance No. 111 so as to. permit the construction of a sanctuary by the West University Methodist Church on Lots 6 & 7, Block 25, West University Place First Addition with'.a side lot set back from the East property line of such lots of only 13 feet; and WHEREAS it appears to the City Commission from the report and recommendation of the Zoning and Planning Board and from all evidence and testimony presented at such public hearing, that Zoning-Ordinance No. 111 should be amended so as to permit such proposed construction on such lots.with a side lot set back of only 13 feet; and WHEREAS, the City acting through its City Commission and Mayor desires to amend Ordinance No. 111 of the City of 'test University Place so as to permit such construction and believes that it will-be to the public interest to so amend the same. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. That the City Commission of the City of West University Place does hereby d and determine that each and all of the steps and pro- ceedings hereiribef ore mentioned have been duly and legally taken and performed in full compliance with the law and Char-ter and Ordinances of the City, and that all provisions and requirements�of'the law and of said.Charter.and Ordinances prerequisite to the holding of a Public Hearing'.f or the purpose.of considering the amending'of 'Ordinanee No. 111 have been met and fully. complied with; and that a Public Hearing for the purpose of considering an amendment to Section 24 of Ordinance No. 111 sous to permit the construction of a sanctuary on Lots 6 & 7, Block 25, West University Place First Addition with a side lot set -back of only 13 feet from the East property line of said lots by the West University Place Methodist Church was held at 7 :00 otciock p.m. Friday, March 16, 1951 at the City Hall of the City, pursuant to proper notice given. Section 2. That the City Commission of the City of West University Place does hereby find that Section 24 of Ordinance No. 111'should be amended so as.to permit the construction of a sanctuary on Lots 6 & 7, Block 25, West University P1ace.First Addition with a side lot set -back of only 13 feet. Section e,3. That Section 24 of Ordinance No. 111 of the City of ity West Universty�Placeis hereby amended by the addition of a sub- paragraph to be known as sub - paragraph ;(7). to read as follows "(7) Provided, however, that a sanctuary may be constructed-on Lots .6 &-.,17 of Block 25, West University Place First Addition with a side lot set -back from the East boundary line of said lots (same being the Nest right-of-way line of Mercer Street). of thirteen.(13) feet." Section 4. , This Ordinance shall take effect and be in force immediately from and after its passage.by the City Commission and approval by the Mayor. _PASSED this the:26th day:of March, A.
