EXECUTIVE SUMMARY Section 18-3(f)(1) of the Code of Ordinances allows for the suspension of a contractor registration if the registrant is responsible for three or more building violations within any 12-month period. Building violations include all violations of the Code of Ordinances arising out of, or relating to, building or development activities. Section 18-58 of the Code of Ordinances legislates work site conditions and clean up responsibilities to a permittee from the effective date of a permit and as long as a work area is affected by construction activity. If any of the legislated site clean-up conditions (and other ordinance requirements) are not complied with, the city's Code Enforcement Officer is charged with issuing violation notices and assessing re-inspection fees to the permittee. These notices are posted at the job site, faxed to the permittee, and kept in a notebook until such time as the fees are paid. The policy requires''the fees to be paid prior to scheduling any inspections. The Code Enforcement Officer generally gives a reinspection date, and if the items have not been corrected, issues a second violation, and in extreme conditions a municipal citation to appear in court. Section 18-3 also states that the registrant (contractor) is responsible for all building violations committed by the registrant's officers, agents, employees or subcontractors and is responsible for all building violations occurring in connection with activities under a permit for which the registrant is a permittee. Attached are copies of six separate violation notices and the accompanying photographic documentation of the listed violations. These were issued to YAGO Custom Homes (YAGO) as the permit holder of the site located at 6411 Vanderbilt. These notices were issued within a six- month time period. The notice issued on 8/22/06 culminated in municipal court citations being issued. Section 18-3 gives the BSC the authority to suspend a registration based on the severity of the violations involved, but not more than 90 days for an initial suspension. If the BSC suspends the • I registration, the registrant is not eligible for any new permits during the length of suspension, and current permits may be revoked or suspended by separate proceedings. Additionally, an "alter ego entity" is subject to the same conditions as the registrant. Staff believes that these violations were properly noticed and adequate time was given to correct them. Staff also believes that Allan Feiner, is and was acting as an agent for YAGO at the time the notices were issued. Attached are copies attained through public records listing the corporate and business registrations for both YAGO and purported "alter ego entity" Artisan Homes. Staff would like to point out that many of the listed addresses are the same for both companies, and the companies share the same company listed in the real property records as property owner. Since the last notice was issued on 8/22/06 and a meeting was held with Maurice Kass and Allan Feiner on September 12, there have been no further notices issued for any properties owned or controlled by YAGO. Staff recommends that the BSC consider a minimum of sixty days suspension, with consideration given for the good site conditions observed within the last forty- five days. .
