Notices,Rules, Etc.Bryant Slimp stated that Dave Miller and Michael Talianchich would be the alternate voting members. 2. Variance Request. Bryant Slimp stated that this variance request item was tabled at the last Building and Standards Commission meeting held on April 6, 2006 meeting due to lack of clarification of what the issues were. The Commission requested written reply to questions in Section 6.206, Variance, (f) Required Finding, Items 1 —9. The Commission may not issue a variance unless the Board affirmatively finds that all of the items are met. Mr. Foster stated they are requesting less of a 5' side setback for the swimming pool because they built a bigger home. Mr. Foster also stated they have consulted with the neighbors; which did not have an issue with having less then a 5' setback, but are unable to attend the meeting. Debbie Scarcella stated that it was staff recommendations not to allow anything less then 3-1/2' setback because of the 36"walkway that is required by ordinance with an additional 6" for drainage. Mr. Foster stated the coping that is designed to be used for the swimming pool is an open coping so that there is drainage in the cooping area that would go directly into the pool. Debbie also stated that because of the proximity from the pool to the home, the City would require the detail of the pool wall to be engineered. Item#1 —The imposition of the requirement imposes an exceptional hardship upon the applicant. Dave Miller made a motion that an exceptional hardship does not exist. Dr. Peter Benjamin seconded the motion. AYES: Bryant Slimp,Dr. Peter Benjamin, Dave Miller, Michael Talianchich and Muddy McDaniel. NOES: None. ABSTAIN: None. Motion Passed. Variance not granted. 3. Updates. Bryant Slimp stated that BSC has two ordinances before Council that have gone through the first readings. The first which is the Technical Codes which regards foundation. Bryant Slimp stated that Councilman Mike Woods has raised some questions regarding enforceability of how the 3800 University Boulevard • West University Place, Texas 77005-2899 • 713•668•4441 • www.westu.org 4 • • Building and Standards Commission Meeting Minutes May 4, 2006 Page 2 of 2 insurance is done for professional engineers and architects. Bryant Slimp stated the Commission had a workshop in which David Arntsen was invited to attend. Mr. Arntsen is the Senior Vice President of USI; an insurance company that does a significant percentage of underwriting for engineers and architects. Mr. Arntsen proposed language that would make the ordinance work with respect to the insurance requirements. The Building and Standards Commission has incorporated this language into the ordinance and has presented it back to Council. There was also a clarification on the foundation types that needed to be made. The clarification has been made and has passed on the first reading. The second reading is scheduled for May 8, 2006. Second item was the structural draft. The accepted date needed to be changed on this draft also. It has been amended and City Council has passed it on first reading also. Bryant Slimp stated that Council is requesting a quarterly update from the Commission. The first update will be due May 22, 2006. Debbie did some research regarding A2AL labs—there are 23 in the area. The list will be available for residents and contractors. 4. Flood Protection and Prevention Ordinance. Councilman Mike Woods stated he would like to have some kind of traffic ordinance that would not allow traffic to exceed a certain speed limit when it is flooded. Bryant Slimp stated it would take a series of different things to fix the ordinance. Bryant Slimp stated that he, Steve Brown and Debbie are going to meet before a workshop meeting is scheduled. 5. Meeting Minutes. Dr. Peter Benjamin made a motion to accept the meeting minutes as amended from the February 2, 2006 Building and Standards Commission meeting. Dave Miller seconded the motion. AYES: Bryant Slimp,Dr. Peter Benjamin, Dave Miller, Michael Talianchich and Muddy McDaniel. NOES: None. ABSTAIN: None. Meeting minutes approved. Dr. Peter Benjamin made a motion to approve the meeting minutes from the April 6, 2006 Building and Standards Commission meeting. Dave Miller seconded the motion. AYES: Bryant Slimp,Dr. Peter Benjamin, Dave Miller, Michael Talianchich and Muddy McDaniel. NOES: None. ABSTAIN: None. Meeting minutes approved. 6. Summer Schedule. Bryant Slimp is requesting that the Commission not have regular monthly meetings for the summer unless there are some variance requests that come before the board since Debbie Scarcella has taken on some new job responsibilities. The Commission will still have some workshop meetings. James Dougherty stated that if there are any variance requests, that they may be placed on the agenda for a workshop as long as the meetings are noticed properly. Dr. Peter Benjamin made a motion to suspend the regular scheduled meetings until September 7, 2006; subject to call special meetings as needed. Dave Miller seconded the motion.
