Williams Official SUBJECT: Request a variance to Section 82-5 of the City's Code of Ordinance, titled "Replacement Trees." FYHTBTTC. Application,letter from applicant,copy of tree disposition, letter from the Builder,and photos of the two properties. EXECUTIVE SUMMARY Mr. Troy Williams is requesting a variance to Section 82-5 of the City's Code of Ordinance, titled "Replacement Trees."Mr. Williams purchased his home at 3716 Georgetown with intentions of constructing a pool. The City, Builder, and Mr. Williams determined it impractical to plant trees knowing they would be removed with construction. Mr. Williams assumed responsibility from his builder for the 55 inches of replacement trees with the intention of planting after the pool was constructed. Mr.Williams is now finding it difficult to plant the required replacement inches and is requesting that credit be given for trees that have been planted on property previously owned,which is located at 4135 Amherst,along with trees planted at 3716 Georgetown in lieu of payment into the tree trust. Section 82-5 states: Number of replacement trees.Tree Disposition conditions and tree permits authorizing removal of or damage to large trees or protected trees shall normally require replacement by one or more newly-planted trees on the same subject site according to the "replacement inch" stipulations in the criteria manual. To the extent on-site replacement in not feasible, the permittee may choose to: (1) Plant and maintain off-site replacement trees within 1,000-feet of the subject site,subject to the provisions of the criteria manual; (2) Provide replacement-inch certificate from a tree trust or the UFEF,as provided in this section and the criteria manual;or (3) Provide replacement inches by some combination of the foregoing methods. Not withstanding any other provision to the contrary,the BSC Commission,when considering an application for a variance: (1) Shall take into account efforts to avoid or mitigate removal of and damage to trees,particularly trees highly-evaluated under the criteria manual;and (2) May take into account the financial cost of compliance with this chapter,particularly as it compares to the cost of other work the applicant may be proposing. LOT 16 Ij J)C Z ADDITION Sj&>Er jirrce Now comes Stephanie and Troy Williams appellant/owner of the herein described property, and affirms that on the N/A day of , 20_he/she applied for a permit to -This is a request for a variance with regard to Chapter 82-5 of the Tree Final Inspection and Required Replacement Planting. In this regard,the request for a variance is based on(1)the property not being able to support more trees,(2)the property owners next door and across the street do not want more trees and(3)the purpose of required replacement planting is to enhance the urban forest and we have planted twenty Qualified Class 1 and Class 2 trees totaling approximately 80 diameter inches at two West University Place residences over the course of the last five years at on a lot feet by feet, in the District, as shown to scale, with all existing structures on the attached staked survey and the Zoning Map of the City of West University Place, and to use the same as a N/A The permit, however was denied upon the following grounds: We have discussed this issue with Mr.Craig Koehl and he has advised that we need to file this request with the Building and Standards Commission. - There, the appellant now appeals in accordance with the provisions of Chapter 6, SECTION 6.206 to the Building and Standards Commission to grant the heretofore requested permit,variance or exception, and to permit him to use the completed premises as a N/A for the following reasons: Please see attached. • • APPLICATION TO WEST UNIVERSITY PLACE BUILDING AND STANDARDS COMMISSION Re: Request for Finding of Compliance with regard to Tree Final Inspection and Required Replacement Planting to Comply with Chapter 82 of Code of Ordinances —3716 Georgetown Our family became West University Place residents on December 21, 2001 when we purchased a home at 4135 Amherst. We subsequently sold our residence at 4135 Amherst and moved to 3716 Georgetown on April 15, 2006. When we purchased our home at 3716 Georgetown, we intended on initiating pool construction in the backyard of the residence. In this regard, the City of West University Place provided us with one year in which to be accountable for replacement planting of 55 inches. Unfortunately, shortly after purchasing our home at 3716 Georgetown, our four-year-old son refused to continue swimming lessons at the Houston Swim Club. Thus, for child-safety concerns, we chose not to go forward with pool construction until after our four-year-old boy is able to swim. With regard to the replacement tree inches, it is our understanding that the 55 replacement inches are based on diameter as opposed to circumference which is a significant difference. We retained Texas Services, Ltd., and have met with a tree professional from Texas Tree Company at our property. At such time, we had three mature trees in our front yard and two mature trees in our backyard [Exhibit 1]. As a result of the spread of the tree canopy on our property, the tree professional advised that our property can only handle three additional trees without damaging the root systems of the current trees that are on the property. Thus, the tree professional planted a four-inch diameter live oak (Qualified Class 1) tree in the front southwest easement of the property [Exhibit 2]. Further, the tree professional has planted two (2) additional holly trees (Qualified Class 1) in the backyard [Exhibits 3 and 4]. Again, the tree professional advised against planting any other trees on our property in order to avoid damaging the root system of the existing trees. At this point, according to a tree expert with Texas Services/Texas Tree Company, our property at 3716 Georgetown is "tree locked" and the yard can not handle any further trees without damaging the root systems of the mature trees. Chapter 82 is a wonderful ordinance in that it prevents lots from being cleared and left without any trees. However, the ordinance needs to be reasonably applied. In our case, we have taken reasonable efforts in order to comply with the spirit of Chapter 82. Indeed, we have re-forested our property as much as possible without damaging the root systems of the five mature trees on the property. For this reason alone, we respectfully request that the Building and Standards Commission find that we have fully complied with the replacement planting. n77an QR/1 n2aR'I n I • • Page 2 In the alternative, if the Commission is not of the opinion that we have complied with a reasonable application of Chapter 82, we have taken additional steps in order to comply with the replacement planting. Since our property at 3716 Georgetown can not handle any additional trees, consistent with Chapter 82, section 5(a)(1) which allows for the planting of replacement trees within 1,000 feet of the residence, I visited with our neighbor across the street at 3715 Georgetown in an effort to obtain permission to plant live oak trees on our neighbor's easement. Additionally, I visited with my next-door neighbor at 3710 Georgetown and, again, offered to plant trees in the easement in front of my neighbor's home. In the first instance, the neighbor advised that trees would not grow in the easement and, in the second instance, I was advised by my neighbor that he did not want any trees in the easement. Given the fact that our property is "tree locked" and my neighbors do not want additional trees, for this additional reason, we respectfully request that the Building and Standards Commission find that we have complied with Chapter 82. In the further alternative, we request that consideration be given to the stated purpose of Chapter 82 — Preserving and Enhancing the Urban Forest of the City. Particularly, as stated above, in December 2001, we purchased a home at 4135 Amherst. When we purchased the home, the contractor indicated that he was required to plant a small tree in the yard and in response, my wife and I paid extra in order to have a larger live oak (Qualified Class 1) tree placed in the northeast easement [Exhibit 4]. In 2002, although it was not required by City Ordinance, we planted four (4) river birch (Qualified Class 2) trees in the front yard [Exhibit 5]. Further, we planted one (1) magnolia (Qualified Class 1) tree [Exhibit 6]. In 2003, we planted six (6) mature holly (Qualified Class 1) trees (approximately four inches in diameter and 20 feet tall) along the south back boundary of the property [Exhibits 7 & 8]. Then, in 2006, we planted an additional five (5) holly (Qualified Class 1) trees along the west property line [Exhibit 9]. We also planted a 4 inch diameter live oak tree in the northwest easement [Exhibit 10]. In the case of 4135 Amherst, although not required by a city ordinance, it certainly made sense to plant a large number of trees because the property was absent of any meaningful trees. Chapter 82 concerning the urban forest conservation and enhancement has the express purpose of preserving and enhancing the urban forest of the City. Thus, for this additional reason, we respectfully request that consideration in terms of a credit be given with regard to our preservation and enhancement of the urban forest at 4135 Amherst in conjunction with what we have done to preserve and enhance the urban forest at 3716 Georgetown. Indeed, between the two residences at 4135 Amherst and 3716 Georgetown, we have planted trees with an equivalent of approximately eighty (80) diameter inches. For these reasons, we respectfully request that the Building and Standards Commission find that we have fully complied with the replacement planting of 55 inches. Diameter qualified trees, inches must add up to the required replacement. Replacement must include at must include at least a 4"diameter,or 100 gallon tree for every least 6 100 gallon 10"diameter required. Other trees must be a minimum of 2" or 4"diameter diameter trees. X Tree(s)will be pruned and/or fed by a qualified tree professional when deemed most beneficial to the health of tree(s). X Installation of underground utilities shall be done using hand labor and not cutting roots larger than 1"diameter. X Wash concrete,paint,chemicals&other materials away from the critical root zones. X Comments: Protect trees as shown on approved plans with six foot high fencing. Do not alter or remove fencing without prior approval from the urban forester. Fence must have approved sign stating that the fence is for tree protection. Do not operate heavy equipment in the protected tree critical root zone(CRZ)or use for storage. Remove all excess soil from site promptly. Do not spread or pile in tree CRZ. Remove 3 trees, replace with 55"Diameter of qualified trees, must include at least 6 100 gallon or 4"diameter trees. See qualified tree list. All grading in tree critical root zones must be done manually,limiting cut or fill to 3" max.Do not use heavy equipment in tree critical root zones for grading or excavation for installing forms(i.e.sidewalk or driveway). Place plastic barrier under forms before pouring concrete. Hand-dig all utilities around Trees 1-4. Keep drive at same grade as existing,do not cut exposed roots. Zero inches to date have been replaced. The new owners of the property, Mr. and Mrs. Troy Williams, wish to install a pool using their own pool builder soon after taking procession of the property. They also wish to use all or part of the replacement inches as part of their pool landscaping. Therefore Classic American Homes will credit at the closing of the home to Mr. and Mrs. Williams the full amount of fifty five inches at the rate of$125 per inch. The Williams hereby agree to be accountable for all those inches at the completion of the pool or no later than April 15, 2007 whichever may come first.
