HomeMy WebLinkAbout11052015 BSC Minutes The City of West University Place A Neighborhood city Building & Standards Commission Located in the Bill Watson Conference Room, 3800 University Blvd, West University Place, Texas 77005 Meeting Minutes November 5,2015 MEMBERS PRESENT: Steve Brown, Sylvette Bobb, Frank Griffin, Denny Powers, Kris Westbrook, Bruce Beneke(arrived late) and Charles Marshall MEMBERS ABSENT: Muddy McDaniel and Connie Clark STAFF PRESENT: Chief Building Official Clay Chew, Legal Counsel Shelly Eversole and Permit Technician Josie M. Hayes GUESTS PRESENT: Brian Shor, Shreekant Patolia, Mark Egan, Ryan McKenney, Alida Drewes and Adam Maurer [Call to Order] Steve Brown called the meeting to order at 6:00 p.m. 1. Notices, Rules, Etc. Steve Brown welcomed BSC members, staff and visitors to the meeting. There were introductions of BSC members and staff. 2. Meeting minutes. Frank Griffin made a motion to approve the June 4, 2015 meeting minutes as amended. Sylvette Bobb seconded. AYES: Steve Brown, Sylvette Bobb, Frank Griffin, Denny Powers and Kris Westbrook. NOES: None. ABSTAIN: None. Meeting minutes approved. Denny Powers made a motion to approve the July 20, 2015 meeting minutes as amended. Frank Griffin seconded. AYES: Steve Brown, Sylvette Bobb, Frank Griffin, Denny Powers and Kris Westbrook. NOES: None. ABSTAIN: None. Meeting minutes approved. 3. The Commission to select a Vice Chairman. Kris Westbrook made a motion to nominate Frank Griffin as Vice Chairman. Sylvette Bobb seconded the motion. Denny Powers made a motion to close the nominations for Vice Chairman. Sylvette Bobb seconded the motion. AYES: Steve Brown, Sylvette Bobb, Frank Griffin, Denny Powers and Kris Westbrook. NOES: None. ABSTAIN: None. Motion approved. As the sole nominee, Frank Griffin was named Vice Chairman. Kris Westbrook made a motion to suspend the regular meeting and go into the hearing mode. Denny Powers seconded the motion. AYES: Steve Brown, Sylvette Bobb, Frank Griffin, Denny Powers and Kris Westbrook. NOES: None. ABSTAIN: None. Motion passed. Everyone testifying or speaking on any issue was sworn in by Steve Brown. Docket Number 2015-03, Property located at 3304 Sunset Blvd, West University Place, TX 77005 regarding a variance to Chapter 18, Section 200. Requesting approval to allow the placement of a sculpture 4' over the allowed 8' fence height. Steve Brown asked staff if the request had been filed properly and if the proper notices had been given. Josie M. Hayes stated the request had been filed properly and that notices were sent. Clay Chew was asked to detail the code issues of denying a permit to place a sculpture over the front fence gate which would increase the height over the eight foot maximum. Clay Chew stated there were alternate methods that could be used that would be allowed; as long as the sculpture was not attached to the existing fence. Mr. Shreekant Patolia; the property owner of 3304 Sunset; was asked to present his case by Steve Brown. Mr. Patolia stated the sculpture would enhance the overall beauty of his property and would not have a negative impact on the community. There were five residents who spoke in favor of having the variance approved and stated it would enhance the overall beauty of the neighborhood. There was general discussion regarding the arch on top of the existing fence not being in compliance. Clay Chew stated that portion was constructed without a permit. BSC could not find in the affirmative that the requirement in the ordinance imposed an exceptional hardship upon the applicant(financial cost, alone does not ordinarily constitute an exceptional hardship). Sylvette Bobb made a motion to approve the variance request to allow a variance permitting the placement of a sculpture 4' over the allowed 8' fence height. Denny Powers seconded the motion. AYES: None. NOES: Steve Brown, Sylvette Bobb, Frank Griffin, Denny Powers and Kris Westbrook. ABSTAIN: None. Variance denied Frank Griffin made a motion to close the hearing and resume the regular meeting. Kris Westbrook seconded the motion. AYES: Steve Brown, Sylvette Bobb, Frank Griffin, Denny Powers and Kris Westbrook. NOES: None. ABSTAIN: None. Motion passed. [Adjournment] Frank Griffin made a motion to adjourn. Sylvette Bobb seconded. AYES: Steve Brown, Sylvette Bobb,Frank Griffin, Denny Powers and Kris Westbrook.NOES: None. ABSTAIN:None.
