Hayes GUESTS PRESENT: Dan Jordan, Richard Spencer, Beverly Brownfield, Molly Chilakapati, Ken Kern, David Marks, Hugh Fitzpatrick, Alida Drewes [Call to Order] Steve Brown called the meeting to order at 6:00 p.m. 1. Notices, Rules, Etc. Steve Brown welcomed BSC members, staff and visitors to the meeting. There were introductions of BSC members and staff. Steve Brown stated the alternate voting member would be Charles Marshall. 2. Meeting minutes. Sylvette Bobb made a motion to approve the February 5, 2015 meeting minutes. Vernon Tyger seconded. AYES: Steve Brown, Sylvette Bobb, Denny Powers, Vernon Tyger and Frank Griffin. NOES: None. ABSTAIN: None. Meeting minutes approved. Denny Powers made a motion to suspend the regular meeting and go into the hearing mode. Vernon Tyger seconded the motion. AYES: Steve Brown, Sylvette Bobb, Denny Powers, Vernon Tyger and Frank Griffin. NOES: None. ABSTAIN: None. Motion passed. Everyone testifying or speaking on any issue was sworn in by Steve Brown. 3. Docket Number 2015-02, Property located at 5308 Buffalo Speedway, West University Place, TX 77005 regarding a variance to Chapter 6, Article II, Section 6- 35(a). Requesting approval to install two single faced LED electronic message boards to replace existing internally illuminated sign cabinet. Clay Chew was asked to present the need for a variance to install a LED sign at this location. Clay Chew stated that the property is a Residential Impact Area where more than 51% of the affected street line is zoned for single family residential use. Mrs. Beverly Brownfield, St. Andrews 3800 University Boulevard ( West University Place, TX 77005 I www.westutx.gov • The City of West University Place A Neighborhood City- representative, gave a brief presentation expressing the need for the sign to help get their messages out about upcoming activities and events. After some lengthy discussion, Denny Powers made a motion to approve a partial variance request allowing only a North facing electronic LED sign. Vernon Tyger seconded the motion. AYES: Steve Brown, Denny Powers and Frank Griffin. None. NOES: Sylvette Bob and Vernon Tyger. ABSTAIN: None. Variance approved. Denny Powers made a motion to close the hearing and resume the regular meeting. Frank Griffin seconded the motion. AYES: Steve Brown, Sylvette Bobb, Denny Powers, Vernon Tyger and Frank Griffin. NOES: None. ABSTAIN: None. Motion passed. 4. Veterinary Facility; Property located at 5406 Kirby Dr.,West University Place, TX 77005.Matters relating to amending Chapter 14,Article III, Section 14-72 and 14-76 and adding Section 14-89 to define a veterinary facility. Steve Brown read the proposed amendment and asked for comments. Mr. Rick Spencer, Avian Animal Hospital representative, expressed the need for the veterinary facility to board more than three dogs or three cats or a combination of each while receiving treatment. Mr. Spencer stated the facility would not be boarding or kenneling animals overnight that were not being treated. Mr. Spencer also stated the clinic was a state-of-the-art facility that would have additional sound-proofing so no barking could not be heard by neighbors. No adverse odors would be detectible and there would be additional landscaping in the green space buffer between the facility and residences. One resident spoke in favor of the veterinary clinic and two residents were opposed. Their concerns were the increased noise, smell and traffic the veterinary clinic would bring to the neighborhood. After some discussion, Frank Griffin made a motion to approve the amendment request with some editorial changes. Denny Powers seconded the motion. AYES: Steve Brown, Sylvette Bobb, Denny Powers and Frank Griffin. NOES: Vernon Tyger. ABSTAIN: None. Motion approved. Steve Brown stated the next meeting, if needed would be changed from July 2,2015 to July 16, 2015. [Adjournment] Denny Powers made a motion to adjourn. Vernon Tyger seconded. Hayes and Councilwoman Mardi Turner GUESTS PRESENT: John Yow, Rick Spence, Molly Chilakapati, Chandu Chilakapati, Steve Stelzer, Brian Shor, Kara Richardson, Randall Richardson, Charles McFarland, Cory Decoire, Dan Jordan, Chelsey Shor [Call to Order] Steve Brown called the meeting to order at 6:00 p.m. 1. Notices, Rules, Etc. Steve Brown welcomed BSC members, staff, council and visitors to the meeting. There were introductions of BSC members, staff and visitors. Steve Brown stated Vernon Tyger moved out of the City of West University Place and is no longer on the board. The alternate voting member would be Kris Westbrook and Muddy McDaniel. 2. Veterinary Facility; Property located at 5406 Kirby Dr.,West University Place, TX 77005. Matters relating to amending Chapter 14,Article III, Section 14-72 and 14-76 and adding Section 14-89 to define a veterinary facility. Steve Brown gave a brief background from the previous BSC and City Council meetings. City Council asked that BSC revisit the item and change some of the suggested language. Clay Chew stated additional language was added to protect the neighbors of any future veterinary clinics. There was general discussion regarding the location of the dog runs and the area where the dogs would be allowed to be outside. Residents were concerned about the noise level of the barking dogs since there would be multiple dogs at one given time. Clay Chew stated the walls are soundproof and you would not able to hear the dogs outside the facility. There was general concern from the residents about letting the dogs out in the unfenced area that is across the street from a residential neighborhood. Steve Brown stated that any dog that would be outside the facility would be required to be on a leash. There was also concern regarding the number of dogs that would be walked at one time. Residents asked if the area where the dogs are allowed to be walked be could be changed to the Kirby side which is the front of the building that faces a commercial district instead of the side that faces a residential area. There was discussion asking if maybe one of the parking spaces could be eliminated so that the outside area where the dogs are to be let out could be moved to the front of the building instead of on the side that faces the residential area. Clay Chew stated they would have to speak to Debbie Scarcella, City Planner, and determine if obtaining a variance would be possible to reduce the number of required parking spaces by more than one. Dr. Jordan stated he would have the dogs walked on the green space on the South side of the building. Residents asked staff if there was a possibility that a fence like hedge could be built taller than three feet that faces the residential area. Clay Chew stated a variance would be required. Residents stated they would be more supportive of a variance that reduced the parking spaces rather than install a fence like hedge that is taller than three feet. There was general discussion amongst BSC members regarding the suggested wording changes to the ordinance. Frank Griffin made a motion to adopt Appendix A as modified and forward it to City Council. Denny Powers seconded. AYES: Steve Brown, Denny Powers, Frank Griffin, Kris Westbrook and Muddy McDaniel. NOES: None. ABSTAIN: None. Motion approved. Bruce Beneke made a motion to support the construction of fewer parking spaces than required by ordinance to allow for more dog walk area on the east side of the facility. Kris Westbrook seconded.
