Meeting Minutes
January 15,2015
MEMBERS PRESENT: Steve Brown, Vernon Tyger, Frank Griffin, Charles
Marshall and Bruce Beneke
MEMBERS ABSENT: Sylvette Bobb, Denny Powers, Kris Westbrook and Muddy
McDaniel
STAFF PRESENT: Chief Building Official Clay Chew, City Attorney Alan
Petrov and Permit Technician Josie M. Hayes
GUEST PRESENT: None
[Call to Order] Steve Brown called the meeting to order at 6:02 p.m.
1. Notices,Rules, Etc. Steve Brown welcomed BSC members and staff to the meeting.
There were introductions of BSC members and staff. Steve Brown stated the alternate
voting members were Bruce Beneke and Charles Marshall. Steve Brown stated Clay
Chew is targeting the January 26, 2015 City Council meeting to bring forward the four
proposals that BSC has been working on.
2. Meeting minutes. Vernon Tyger made a motion to approve the December 4, 2014
meeting minutes. Bruce Beneke seconded. AYES: Steve Brown, Vernon Tyger, Frank
Griffin, Charles Marshall and Bruce Beneke. NOES: None. Meeting minutes approved.
3. Fences at Major Thoroughfares. Steve Brown stated this agenda item was being
revisited to determine when a traffic study would and would not be required. Vernon
Tyger made a motion to reconsider the approved proposal from the last meeting. Bruce
Beneke seconded the motion. AYES: Steve Brown, Vernon Tyger, Frank Griffin,
Charles Marshall and Bruce Beneke. NOES: None. Motion passed. There was general
discussion regarding the proposed changes to the ordinance regarding fences at major
thoroughfares. Bruce Beneke stated he saw the photos and asked what the standard was
previously for fences at major thoroughfares that brought this item to BSC and how is it
getting fixed with the proposed ordinance change. Clay Chew stated the traffic study was
done due to a complaint regarding the setback and the Zoning Ordinance currently has a
visibility triangle at intersections,but it is not sufficient. Steve Brown stated a traffic

study would not always be required. If the applicant,homeowner and the Building
Official could agree on the location of the fence, a traffic study would not be required.
There was general discussion regarding the visibility at major thoroughfares. Bruce
Beneke asked if a grandfather statement should be required for existing fences not in
compliance. Steve Brown stated the older fences would automatically be grandfathered
unless they are being replaced and a statement would not be required to be added. Alan
Petrov stated all new fences would have to be in compliance with the proposed new
ordinance. Bruce Beneke asked if there was a grandfather clause that was added to the
proposed LED sign ordinance. Steve Brown and Clay Chew stated there was not one
added to the proposed LED sign ordinance. Alan Petrov stated there was a provision that
states any existing signs could continue under the existing regulations; it does not have a
time period. Vernon Tyger asked if the last sentence could be changed to read "reduce
this setback to a minimum of 10'. Steve Brown asked for a motion to approve the
proposal with the revised modified changes to replace the previously approved proposal
and forward to City Council for approval. Frank Griffin made a motion to approve all
recommended changes. Bruce Beneke seconded. AYES: Steve Brown, Vernon Tyger,
Frank Griffin, Charles Marshall and Bruce Beneke. NOES: None. Motion passed.
Steve Brown stated the next meeting if needed would be on February 5, 2015. Clay Chew
stated there are two possible variance requests. The deadline to submit the variance is
January 16, 2015 at noon. BSC would be notified if a variance request is received. Steve
Brown stated the four proposals would be taken to City Council on January 26, 2015 and
BSC members are welcome to attend the meeting, but are not required to do so. Vernon
Tyger asked if two readings would be required to approve the proposals. Alan Petrov
stated if there is not much comment at the first meeting, then they go on consent agenda
for the second meeting.

Bruce Beneke made a motion to adjourn. Charles Marshall seconded. AYES: Steve Brown,
Vernon Tyger, Frank Griffin,Charles Marshall and Bruce Beneke. NOES: None. Meeting
adjourned at 6:31 p.m.
