SPECIAL MEETINGANORKSHOP Agenda Items were as follows: Call to Order. Mayor Pm Turn Sample ended the meeting to order at 5:30 p.m. in the Council Chambers. Council and Staff in attendance were: Counalmembers Johnson and Yehle, City Manager Ross, Assistant Oty Manager /Public Works Oirector Peeler, City Secretary Lenz. and City Pull Petrov. Mayor Fry was absent and Councilmebrber Heathcod did not attend due to possible conflict of Interest. 1. At 5:30 p.m., Mayor Pm Tom Sample closed the Special MaetingNJorkshop and convened into Executive Session in accordance with Section 551071 and Section 551.072 in Chapter 551, Open Meetings Ad, of the Texas Government Code. At 8:23 p.m., Mayor Pm Tom Sample closed the Executive Session and reconvened the Special MeetingMorkshop. No action taken. 2. Mayor Pro Tern Sample called me meeting to order at 6:30 p.m. in the Council Chambers. Council and Staff in attendance were: Mayor For Ten Sample, COUncilmembers Heathwi Johnson and Yehle, City Manager Ross, Assistant City Manager /Public Works Director Peifer, City Secretary Lenz, City Attorney Palmy, Police Chief Walker, Communications Manager Barber, Executive AssistaimAssistant City Secretary Evelyn, and Fire Chief Taylor. Councilmember Johnson led the Pledge of Allegiance. Secretary Lenz confirmed that the Notice of the workshop and regular meetings was duly posted in accordance with the Texas Government Code, Chapter 551. She strati however, that she mistakenly pasted the Regular Meeting for 6:00 p.m. instead of 6'.30 p.m. and took sole responsibility for the error and apologized to Council, the City Manager and the residents. Note: Mayor Pro Tom Sample took the Consent Agenda out of order and made it the first item of business. 3. Consent Agenda All Consent Agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a Council member requests in which event the item will be removed from Ox Consent Agenda and considered in its normal sequence on the agenda. City Facilities Lorm -Rana¢ Master Planning Matters related to the City Facilities Long -Range Master Planning and related future property Ownership. RecommendmACaon: Discussion only. Before taking public comments, Mayor Pro Tend Sample read the following statement: °On behalf of your City Council, Monk you for coming tonight. I am Susan Sample your Maya Pro Tem. Your mayor u out atown so I'm acting as yaw presiding officer tonight and I want to thank all of you borrowings tonight. This is really moving Some rights we show up and there may be three people out here and every, piece of business we conduct is important and On glad we are here tonight to show that you ere about your city and what goes on. I'm going to throw Mat out at you because this isjust a wonderful eight We welcome and value yaw comments. One thing, we are concerned that some of the facts surrounding this issue have been exaggerated a 'aepresented somewhat in ceder to alarm add stimulate opposition, so I'm going to give you a taw, facts and than well have a chance or everyone who signed in to speak Let me restate what I personally thought had been made clear We are not selling, trading or leasing Me Library, Senior Center or Me Community Building tract of land Our tacill consultant had Provided us each several options fa consideration in ow Lang Range Plan and, yes, that was one a many of the options. But you can rest assured that this Council real touching that property. I personally spoke to at least 60 people who expressed concern and Me ovenvlrelming contend was Me Ubrary add Community Center and we feel the same way. Second, we want to encourage all Page 3 hill ary Council Mlnums, November to, 2014 comments and opinions horn residents while we are in this pubicc input period The Council will not be voting on any potential property exchanges with the church until January of 2015 at the earliest After the results of the Town Hall meetings are analyzed (and we be having Town Hall meetings November 1r -one at 2,00 pm and one at 6.30 pm at Me Community Center and we hope you are all there), the City should at that time use all input to AMerties for Request fa Proposals (RFP) from the church to do what's best for our residents. This church is the most likely Me only viable entity qualified to propose, but once the RFP Is advertised it begins a 6"ay process before any amm can be considered. As is typical, City Council has Me right to accept any, all or none a the options in the proposals. This gives us 60 mom days her input Third, we understand some have voiced Mat Me City may prohibit the church from building and prevent their future growth, but that's not a viable option fa our city. They will have to build according to our City codes, setbacks, parking, height requirements, etc., and while legal opinions may vary, Mere is an doubt that the City would be selling itself up for significant financial liabilities and public relations exposure were it to engage in legal action against the church. Fourth, while it may appear measure that much of the recent discussions have mourned in richest Council measure, this is mufinely used by cities to protect the interest of the city and its residents, while discussing things like potential real estate hansacfions and receiving legal imin'ce / Me City's aftmney. Also, things like the Texas Open Meetings Act prevent a quorum of city councilmemborm (that means 3 embers in our case) bom being able M have any communication with each other outside of posted meetings and we respect that Most of the information being spread as based on false premises, but there is really no way for councilmembers to responsib'y address d together without potentially violating the statute, which I refuse to do. We have heard the high level of contempt from some people, but Mole who sought the facts have generally saw the undertaking as sound even though they might disagree with elements of it On strategic matters one never expects to get unanimity and Mere are even disagreements among councilmembers on certain elements Just wishing that the status quo would remain unchanged is no way to run a any or to get ahead. Sometimes action must be taken. Failing to ais in this case would have had amoverrabne repercussions and I believe 1 would have been shirking my duties As a representative of you to sit back and watch what was proposed to happen, happen. Execution of gre Super Block is expected to occur and I prefer Is call it Municipal Campus because it's not a Super block. Our Intent is that the present owners may in their homes undisturbed until they decide to sell Long range master planning is one of the primary functions of an elected city council and one that Mis council takes very immunity. I want to hear it= all of you and we are going to move forward with public comments' Before public comments, Gouncilmember HeathcoX made the following statement : "Good evening I'm Ed Heamuch. I am a member and a Deacon at West University Baptist Church. This weak there have been some Ingukies as to why I did not cause myself it= Me current business discussions. I voted for the concept of creating a municipal campus, which has been released to as a Super Black. I voted to put the property up for sale at Me corner of Milton and College. These No votes did not involve West University Baptist Church. If Mere should be future dealings involved West University Baptist Church, I will recuse myself just as I did her the Workshop this evening and with that, I Monk you' Councilmember HeaMmtt recused himself from the meeting and left after making his statement. Since most speakers were present to discuss the City's Facilities Long -Range Master Plan, Items 5 and 6 were taken at the same lime. If anyone spoke on a topic other than the Master Plan, their comments are listed under Item 6, Public Comments. Before calling the first citizen to speak, Mayor Pro Test Sample said that this is an opportunity for citizens to speak to Council relating to agenda and non-agenda items. Speakers are required to register in advance and must limit their presentation to three minutes. Please stale name and address before beginning to speak and that'd applauses are held until Me end, everyone can get heard and out in a reasonable lime. Burt BallarHant, 3123 northeast, spoke M first commend Council far taking the action to put the issue about the buildings being sold to rest. He said he had spoken to Mayor Fry and told him that he thought selling the buildings would be a very unpopular proposal and he wishes he wand have taken his suggestion to remove It from the agenda. He said, however, that he thinks Mat enormous progress has been made on this Issue and he slid he would like to go back on a previous experience like Nis, which was the Vision 2020 plan from about 12 years ago. He said after that Count bumped into a buzz saw like this, it halted the project and hired Richard Murray from the University of Houston to conduct a poll and he thinks that Council should also do washing along those lines to find out if people support the broad concept and then Council can do it warrant and whatnot to implement the concept it indeed the support for it is there. Harris County Commissioner Steve Recheck, 1001 Preston, 91 Floor, Houston. Texas 77002, spoke to say that he doesn't know what the City's plan at the end is, but he wanted to let Council know that on October 15, 1939, a party by the name of Hayden and another parry by Me name of Austin executed a Quit Claim Deed giving the City this properly and also on the deed, which he has a berthed copy, there clearly is a reveler clause, which means Mat k this land is used for anything other than a City Hall, Garden Club, or whatever is owned by to City, the property reverts back to Page 5 of 11 City Council Minutes, November 10, 2014 Me grantors and their representatives. Mr. Radack suggested that City Attorney Petrov pay a lot of attention to the Deed, because any church that takes this land is going to bee it and he is prepared to ask the County Attorney and Hams County Commissioner's Court to do whatever is necessary to protect the interest of Harris County atzens, whetter they live in West U of not, for the use of this Library. He said clearly Council cannot get rid of this property. Councilmembsr Yehle asked Commissioner Radek to which property was he referring. Mr. Radak said he would urge Council and the City Attorney to look at it. He said it is where City Hall is and said it is a large piece of land, which was originally over 100 acres, and those people (Hayden and Austin) gave part of it to Me City. He said he would like to think that none of Council ever knew about this, but the fact of the matter is, clearly, beyond a reasonable doubt, Council cannot convey this property to anybody else or the City loses the property, because this land is steady covered by the reverter clause. Heidi Dugan, 2735 Arbuckle, spoke to say that she has been a resident for 32 years and said in all the years she's been here, she's never seen anything like this incident. She saitl residents have always voted (iea sidewalks, Colonial Park) on everything and so everybody is feeling like this is pretty underhanded. She said she has been a realist for 20 years and this is about what is in the best interest of residents and not what is in the best interest of the church or anyone else. She said when she takes clients around the City they fall in love with it because it feels like a 1950'6 throwback neighborhood, which is pad of me property values and why people want to live in here. Ms. Dugan saitl if Counal is truly looking at it from Me residents point of view, it would never even think of letting Nose things go away. She said the City should deny the church a permit and buy the land bads, because it is against the best interest of the residents to have more density in that area, particularly of non - residents. She said she has paid a lot of taxes in her 32 years antl she has always Nought that taxation came with representation so the residents should be the ones making the decisions on these types of things. Paul Monroe, 4118 Milton, spoke to say that he has been a resident for 33 years. He said Mayor Pro Tom Sample said Net Nis plan is intended to be in the best interest of the residents, but what it looks like it is in the best interest of a very small minority— the membership of the West University Baptist Church. He said cutting a deal that is going to benefit the church and impact negatively on the City forever in the future is not a good idea and sad moving the garbage trucks somewhere else will only make the City opeations less efficient and more expensive. He said Nat Councilmember Heathcott said he is refusing himself, but he has no doubt that he is using his influence and is on both sides of tables. He said the valuable resources that the City will give up are not lust the piece of ground marked up by property lines, the valuable resources are also all the development that has been on top of it. He said he opposes this. Doug Schuler, 4112 Sunset, spoke to say kudos to his neighbors for all the smalls he has received over Me last couple of days. He applauded everyone for being In attendance and said shame on Council and Me City Manager for keeping residents in Me dark on the details of this issue. He said the fads are hard to find, d there was a vote and what the vote was on, who voted on anything, etc. He asked who decided on 60 days, if it could be voted on to extend it beyond the 60 days, and if the City could amend the Code. He also asked why dosed sessions for all these types of meanings? He said he trusts his neighbors who are all smart men and women and said he wood show them the facts and what's at risk and let them vote on it. Mr. Schuler sad he agrees with Councilmember Sample when she said resident shouldn't be afraid of changing the status quo and he invited residents to think of that when voting for City Council. Page a of 11 City Council Minutes, November 10, W14 Flom Craft, 3833 Amherst, spoke to say she fill not sell her house. She also noted Nat Mr. Ross had been trying to contact her and asked what he wanted. Mr. Ross declined to comment during the Regular Meeting. Larry Kelly, 3319 Georgetown, spoke to say that he has lived in Me City for over 40 years and has served on Me Zoning and Planning Commission. He said he would like to know ff the building where the permitting division is housed is included in Me so-called trade, because it seems to him that trading a few lots with 60 year old houses on them for an office building and a warehouse is a bad deal. Michelle Moore, 3906 Rice, spoke to say that she opposes Council taking any action to implement any on of the Super Block concept until the residents can have a full review and due diligence. She said her feeling is Mat this project has been handled poorly from Me start and has not been helped by the recalcitrant behavior of the Council and the Mayor when faced with apposition from the residents. She said the Super Block plan or parts of it may weir be a good idea, but there is no way Nat a plan of the magnitude, Mat will change Me face and finances of the City, should he undertaken without input and approval of the taxpayers. Ms. Moore said she is yet W be convinced that owning a Municipal Campus of contiguous lots represents an advantage of what the City has now. She said she suggests Nat Council create a Facilities Planning Task Force call with concerned resitlents, similar to the Parks Master Plan Task Force. She said with at Facilities Planning Task Force in place, she believes the plan review, input from residents and due diligence mind proceed without further controversy. Candace Tenarink, 4222 Oberlin, spoke to say that she agrees with almost all the previous comments made and it is wonderful to see so many people here. She said she is glad W hear Mat the Library and Community Center are off the table. She said the Library is a pillar of the community and is a beacon where a lot of kids like to meet after school. She said as far as the trucks go, she personally likes having the trucks in town and don't want to pay to move them. She said it is her lit0e flavor of real life and she likes it and she really wishes residents could see more facts in order to make a better educated decision together. Brennan Reilly, 3731 Rice, spoke to say that at the last meeting he said he would come back with over 100 people and looks like that number was beaten by quite a bit. He said people have shown up for a couple of reasons, first because the process stinks. He said the process is important because the substance is important and people are very concerned about this plan. He said Council talks about waving 60 days and until January to make Mesa decisions, but the point is that bids should not ba going out until these decisions have been made. He said Council can't make the best decisions for West U until it has collected information and the information is disbursed to the residents throughout the City. Mr. Reilly said H Council doesn't have a public process, it doesn't have all vie information. He said Counal had the chance to put the issue on the agenda tonight and vote publicly to take the Library and Community Center off the table and vote to wait with after the Town Hall meetings before making decisions and before continuing to draw up bids and allow staff to take action to sell any City property. He said the Town Hall meeting will be a sham If all Council is doing is window dressing and not listening M Me comments and taking the information into account before allowing the bids documents to go out. He said Council needs to call a time-out and put it on the agenda for Me hard meeting for action. Pape 7 of 11 City Council Minutes, November 10, 2014 David Kuykendall, 3912 Milton, spoke to say that he is three blocks from the trucks and he ocean 't mind them, because they coal cause traffic , they don't cause much noise and at night they are really quiet. He said he would prefer to have the (cocks than a Youth Center with an noted number of cars coming through and creating traffic fa the toddler path across the street. He sad no one asked him and those Mat spoke for him were wrong, because he likes it the way it is. He said in terms of the workshops, by profession he is a trained psychotogist and there are two workshops scheduled. one of which is at 2:00 p.m. in Me supreme. He said chances of getting valid and helpful input through a workshop such as that are practically zero and he would be extremely upset if bids went out solely based on the information obtained during those had workshops. Mr. Kuykeridall said failure to notify residents in a meaningful way about proposed land deals does not look right. He said Mis is a trust issue, not substance. He said when residents expressed concems at the previous Council meaning, Me mayor basically stated that residents comments were not worthy of wnsiceatlon. He said this doesn't lack right He said a potential conflict of interest and a desire to push through land deals with the church as soon as possible don't lack right. He said the slides showing potential future church land was in Me original Facilities Master Plan, but is missing from Me revised exhibit and that doesn't look right. He asked what is a youth center, because what has been shown looks like a marketing piece for the church and he wants to know what Me projected traffic will be, where people will park, what the operating boors are, and the impact on Me neighborhood. Scud Humphries, 3815 Marlowe, spoke to say that Me City has been misreading what it is and is not allowed to do in executive sessions. For example, Making to the City Attorney in executive session is only an exampbon to be able to talk about pending or contemplated liligffiion or settlement offer, which this is not one of. He sad the other exception the City has used is the real estate exception, which states Met a governmental body can go into a closed meeting to deliberate the purchase of real estate, if deliberation in an open meeting would have a detrimental affect on the position of Me governmental body in negotiations with a third person, yet and a representative of that third person was sitting in Me meeting. He said that should not be a cosec session and is not proper. He said whal's'impudent for every resident to know and every coundl person to keep in mind is that when meetings are done, when bid packages are done, when debate takes place in closed session that were not proper, actions taken in connection with Mesa things can be voidable, Much means you can unwind Mom after the fact. Mr. Humphries said he would hate for the City to do something improper and have it undone after a lot of money and tax dollars have been spent, so he is in favor of absolusty ruling out for purposes of Mis Super Block Me Citys use of execlfive sessions. Mike I-egro, 3835 University, spoke to say that by Me number in of er dance it is clear that a lot of emotions have been aroused by this issue and he hopes that Council will slow down. Stew Fyke, 3920 Milton, spoke to say that at Me last meeting, Me mayor reminded residents of what a republic versus a democracy was and he is hereto remind Council that Its duty is to respond W ci( en's cormsems. He said to say Mat this is republic and not a democracy is not ethical behavior and accountability. He said the Super Block concept was not spelled out on the Ocleber 13, 2014 City Council agenda as such and said a Deacon of the Baptist church was involved in this process, which is a potential wnilid of interest. He said Me mayor said this has to be done next quarter, but yet Me pastor of the Baptist church sad he is willing to wait and see what's going to develop, Mr. Fyke said all he wants to knew is what traffic and parking are going to look like, what his taxes are going to be what his quality of life is going to be, and if the street he Ilws on is going to be fumed from a one-way street into a two-waystanet . Bob Kelly, 3720 Plumb, spoke to say that at the meeting 2 weeks ago he told Council it was way out ahead of Me citizens and suggested Mat it slow Mis Ming down and two weeks later this is proof of that and said Mis is a small group compared to who is really outraged by Mis. He said one Point that really shows why public input is needed, why Mere should be focus groups and town hall meetings, is because West U has a very smart constituency. He said these residents know what they are doing and he feels that had Council gotten resident Input, he is certain that it would not have been blundered by Commissioner basis. He said Council got behind the power curve and its paying for it. Bavid Butch, 3901 Rice, spoke to say that he was at Me first meeting when More were only six opponents and he gat involved at Mat time because his neighbor received a letter right before the vote saying that her house would be bought by the City. He staled that had the six of them not rallied that night and brought Mat vote to the communilys attention, it would have been put out for RFP and without equivocation Me church would have brought the Library and the Community Center. He said he is not nacesminly opposed to anything, but opposed to the process. He urged Council to listen and step back and discuss good solutions and good answers . Susan Oshfell 4101 Tennyson, spoke to say that she Minks Council needs ro listen. She said residents don't really know what happened because they have been kept in the dark, so they need Council to take a break and listen to the citizens. She said His plan might be a great idea, but she doesn't know if the traffic situation and the impact on Me neighborhood of having a Super Church in the middle of the City have been considered. Pieter Vrenckem 6700 Belmont #12, spoke to say Mat he has been a resident for 23 years and is the Chairman of the Senior Services Spad and member of Me Parks Task Force. He saitl it struck him as very strange that the City would have a Parks Task Force, but not one for something far more Important — the building of a Super Block and the disposal and acquisition of properties, which affects taxes. He said he commands Councilmember Johnson for having brought up a wish to defer consideration of this issue until after the next elections. but was turned down by the mayor, Which is in the (Senior Board) Minutes. Mr. Vranken said no costs have been provided for any of the options that are seemingly being considered and the cost of rebuilding the Public Works Department in order to accommodate Me church's tatting over of the block on Milton has not been provided, so a straight so-called land swap should take Mom costs into consideration. Melissa Pearson, 4215 Milton, spoke to say that she w coming forward to publicly request more information on the missile, including historical documents. She saitl when she that learned of this last week, the issue of the Library and Community Center caught her atenton so she checked out the Master Plan online, which had slides documenting that potential ownership swap, but when she looked this morning those slides were no longer there, so she wants to request Mat information be made available. She would also like to know the process by which changes are made, because it seems strange that a Master Plan can be changed overnight. Nitin Tandon, 4105 Lehigh, spoke to say that he has lived in West U for about 8 years and said his kids have learned a lot of their reading at the library and they go there frequently. He said he is amazed because he would think Mat Council would have recognized the enormous push back it would have trying to move, close or destroy Me library. Nevertheless he stated that the permit needs to change to reflect the realities of the parking situation during the swim meets. He said Transportation Code rules are not practical and no one enforces them. He said fire hydrants are blocked, can: park up and down West Point and care park bumper to bumper at corners.
