Mayor Fry called the meeting to order at 5:30 p.m. in the Conference Room. Council and Stag in attendance were: Mayor Pro Tem Sample, Coundlmembers Heathcett, Johnson and Yehle, City Manager Ross, Assistant City Manager/Public Works Director Pander, City Secretary Lenz, Parks and Recreation Director O'Connor and City Attorney Petrov. At 5:31 p.m., Mayor Fry moved to dosed the workshop and convene into Executive Sewum to discuss Item 1, per Section 551.072 In Chapter 551, Open Meetings Act, of the Texas Government Code (discussion about the value or transfer of real property and other real estate manors) and Section 551.071 in Chapter 551 of the Texas Government Code (consulta#on with legal counsel to seek or receive legal advice). 1. Facili4es Master Planning Matters related to the City's Facilities Master Planning. After discussions, Mayor Fry adjourned the closed session and reconvened the workshop at 6:00 p.m. With no action and no further business, Mayor Fry closed the workshop at 6:00 p.m. REGULAR MEETING (5:00 p.m. in the Council Chambers) Agenda items are as follows. Call to Order. Mayor Fry called the meeting to order at 6:03 p.m. in the Conference Room. Council and Stag in attendance were: Mayor Pro Tem Sample, Councilmembers reallcod. Johnson and Yehle, City Manager Ross, Assistant City Manager/Public Works Director Peifeo City Secretary Lenz, City Attorney Petrov, Police Chief Walker, Parks and Recreation Director O'Connor, Fire Chief Taylor, HR Director Standoff and Finance Director Daugherty. Mayor Pm Tem Sample led the Pledge of Allegiance. Secretary Lenz confirmed that the Notice of the workshop and regular meetings was duly posted in accordance with the Texas Government Code, Chapter 551. City Council Minutes, September 29, 2014 2. Public Comments This is an opportunity for citizens to speak to Council relthng to agenda and non - agenda tams Mayor Fry announced that City Council cannot receive comments on matters that are subject to a public hearing once the public hearing has been center. He said the public hearings on the budget and tax rate were closed at the meeting of September 22, 2014 and, therefore, Council cannot receive comments on those issues tonight. There were no public comment. 3. Adoption of the 2015 Budaa[ Matters related to an ordinance adopting the budget for the fiscal year beginning January 1, 2015 and ending December 31, 2015 appropriating funds for such budget, containing findings and provisions relating to Me subject and declaring an emergency. Public Hearing has been closed. City Manager Ross presented and saitl staff is recommending that City Council approve the ordinance adopting the budget for the fiscal year beginning January 1, 2015 and ending December 31, 2015, including Me following bullets: • Authorize staff to immediately begin advertising for the vacant positions, using the salary ranges in the 2015 Budget; • Authouto the City Manager or his designee to make 2015 salary adjustments as needed during the remainder of 2014, with the understanding that the employees receiving the 2015 increases wetly will not receive an additional increase in 2015; and • Authorize Me City Manager to implement premium pay on a case- by-case basis, up to 15 percent. Councilmember Johnson moved to approve the 2015 Budget including the three bulleied items recommended by the City Manager. Councilmember Yehle recorded the mouth. Councilmember Yehle said he is okay with the first two conditions, but does not feel comfortable with the premium pay for a couple of reasons. He said by approving the budget, Council is approving money and is also approving a change in the pay structure, so Council has spoken on those points. Councilmember Yome said if More is a pay inequity situation, the job should be reclassified rather than throw what money at it. He said his would basically allow a spot modification to Me pay structure and he thinks such a Ming should come back to Church I it needs to be enacted at a later date. Councilmember Yehle moved to amend the motion striking Me Mind provision that authorizes the City Manager M implement premium pay up to 15 percent over established range as needed during challenging economic related hinng times. Mayor Pro Tern Sample meta d the amended motion. Councilmember Heathco0 said he is not interested in taking away the provision to hire a new employee at the new rate that would be effective January 1. He asked is this amendment asking away the City Manager's ability to negotiate the new salary with a new employee. Councilmember Yehle said his expectation is Mat it retains the ability to pay someone at the new pay structure, but not at a premium beyond the new pay structure. City Manager Ross agreed. A vote was made on the amended motion. MOTION PASSED. 2 of City Council Minutes. Adoption of the 2014 Tax Rate Matters related to an ordnance approving and adopting the 2014 Tax Rate, and declaring an emergency. Both Public Hearings have been dosed. Councilmember YeMe moved to adopt the 2014 Tax Rate to include adoption of the ordinance reducing the 2014 Tax Rate to .036179 on the first and final reading. Councilmember Heathoo t seconded the motion. MOTION PASSED. Ayes: Fry, Sample, Johnson, Heathcot, Yehle Noes: None Absent: None 5. Personnel Policies and Employee Handbook Matters related to an ordinance adopting revisions to the Personnel Policies and Employee Handbook and approving the oNlnance on the first of two readings. City Manager Ross presented and said teo additional changes have been made [hat are not in the Handbook revisions provided in the agenda packet. He said one is the premium pay issue discussed during the item adopting the budget and the other is adding wording regarding "e- cigarettes and similar devices'to the information relating to tobacco products. Councilmember Head moved to approve the Handbook as presented with the modifications stated by the Cry Manager. Mayor Pro Tern Sample seconded the motion. MOTION PASSED. Ayes: Fry, Sample, Johnson, Heathooh, Yehle Noes: None Absent: None 6. Revisions to the Fee Schedule Matters related to an ordinance revising the Fee Schedule. City Manager Ross presented and said there have been some slight modifications for Council consideration. He said primarily there were some minor changes to the ambulance service fees (medications and equipment), the garbage service fees, and parks and recreation fees. Councilmember Yehle moved to approve revisions to the City's Fee Schedule as presented on the first of two readings. CounismembarJohnson seconded the motion. MOTION PASSED. CouncillCity Manager Rentals City Manager Ross stated that when the budget was discussed he forgot to mention that there were two part -time park caretaker positions in the current budget that staff was unable to fill. So, staff would like to begin advertising for one full -time park caretaker (approved in the budget). He said because the two part-time positions were vacant all year, the salary savings are more enough to cover the costs. City Manager Ross said, as requested by Council at the last meeting, staff researched the "senior empr on". Finance Director Daugherty came forward to key that Council would need W diswss it, and if desired make a plan to raise or lower the exemption. The plan would then have to be adopted by fire and of this year in order for it to go into effect for tax year 2015. No change can be made for the 2014 tax year. City Manager Ross said staff will provide the background information and Council can advise staff R it wants it on an agenda for consideration prior to the end of Me par. 8.
